WHEREAS, th e Big Dry Creek Bas in Intercep tor is a maj or trunk line se rvin g the Southgate, South Arapahoe, South Englewood Sanitatiun Distri cts and pan of the City o f Eng lewood fo r sani tary sewer transport ; and WHEREAS, the Englewood City Council approved entering the Big Dry Creek Basin Interceptor Agreement between Englewood , Southgate Sanitation Di strict , So uth Arapahoe Sanitation Distri ct and the South Englewood Sanitation Di strict No. I, by the passage of Ordinance No . 30, Series of 1990, which in~l ud ed "line and advance tap fees" for capital constructi on; and , • .... ·---..,. -..... ,1 ,,. ' ·, • _, • WHEREAS, the Englewood City Council authorized the passage of a Resolution in 2004, establishing repair, mr imena nce and rehabilit ation fees for Big Dry Creek Basin Intercept or; and WHEREAS , the t:nglewood City Council approved an amendment to the 1990 Big Dry Creek Interceptor Agreement penaining to those maintenance fees, by the passage of Ordinance No . 26, Series of2007; and WHEREAS, after the completion of three capital project s, Southgate Sanitation Di strict reassess ed the condition of the interceptor and detennined th at the interceptor has capacity adequate to meet the existing and future demands and that no funher capita l projects are needed so L~at Southgate tenninated the Advanced Tap Fee collection for capital projects and disbursed the unu sed tap fee capital revenues to the panicipating districts; and WHEREAS , under the 1990 Agreement, th e ori ginal financial arrangements lo fund the repair, maintenance and rehabilitati on program provided for sc heduled periodic increases; the next inc rease is to be effective for the 2009 billing period when the per thou sand gallon charge will increa se from $0 . I 08406 to $0 .159 I 23 ; and WHEREA S, th e Englewood Water and Sewer Board reco mmended approval of these amendments at it s Februa ry 3, 2009 meeting; NO W, THEREFORE , BE IT ORDAINED BY THE CITY COUNC IL OF THE CITY OF ENG LEWOOD , COLO RADO, AS FOLLOWS : 9 bi Section I. The intercepto r begin s at Clarkso n and Orchard , run s n o rthwes terl y alo ng Bi g Dry Creek to Sa nta Fe D rive, and th en no rth to th e Littl eton/Englewood Was tewater Treatm ent Pla nt. In 1990 the Ci ty of Englewood entered in to the Intercepto r Bas in Ag reement (IB A) with So uthgate Sa nitati on Dist rict, alon g with oth er connec tin g sa ni ta ti o n dist ri cts. At the tim e of the agreem ent, eight capi tal co nstructi o n p rojects were anticipated. Under th e 1990 Agree men t, funding must now be provid ed to p roceed with a repair, mai ntena nce, and reha bil itation program . FINANCIAL IMPACT Th e original financial arrang emen t scheduled periodic inc re ases; th e ne xt one is l o be effective for the 2009 billing period . Th e per th ousand ga ll on charg e will increase fr om $0.108406 10 $0.159123. The typical res id ential customer will see th eir bill go fr om $9 .00 per yea r to approximately $1 2.00 per yea r. When th e Big Dry Creek Interce ptor fund started to distribute its unus ed capital m onei ' lo the agreement's members, the En glewood Waler and Sewer Boa rd determin ed that ii would us e that money lo pay th e 1,626 inside City, non-sanitati on district customer's Big Dry Creek Interce ptor maintenanc e fees for a peri od of time. This will continue until those funds are depleted. On the basis of a twenty frve year projection of rehabffltation needs the annual BIA Line Charge was increased (effective 2007) to $0 .108406 per 1,000 ganons of winter water consumption . That finance restructuring scheduled periodic increases in the BIA line Charge . It is time to implement the increase effective for 2009 . Please adjust the BIA line Charge to $0 .159123 per 1,000 gallons of winter water consumption . For your convenience I have attached a copy of the 12/28/06 BIA financing spread sheet. • ~. Lega ll y, the Ci ty of Englewood is not und er any obligation to do site cleanup during a main-c aused sewer backup . Englewood's responsibi li ty extends 10 making a goo d fa ith effo n 10 reasonabl y maintain the sewer main s. 11 was noted that any coverage provid ed by a resi den t's homeowner 's in surru;ce polic y usuall y requires a specia l rider. Mr. John Bo ck , Utilities Manager, appeared 10 discuss the existing policy of cleaning up after a sanitary sewe r backup ca us ed by a blockage in th e Englewood sewer main . 11 has been th e Uti liti es Depanmen i's policy 10 provide aid in the form ofa "gross cleanup," which is basically water/sewer extraction , sanitizing and making drywall flood cu ts for mold prevention . The issue of replacing carpel , tile or linoleum was discussed . The Board rev iewed thi s policy and discussed changes, if any, an d what should be included in cleanup effons. The Board concurred that th e exis ting po li cy be continued and provisions made 10 include replacing carpel and/or tile or linoleum that has come loose . Mr. Bock noted that the propen y owner must sign an agreemen t authori zi ng 1hr cleanup services and the agreeme nt outlines what is included the gross clean up. Mr. Woodward suggested an anicle discussing sewer backup remediation be in cl ud ed in the next "Pipeline." The Board received a lette r from CDM dated Janua ry 21 , 2009 discu ss in g a review of th e most recent data for naturall y occ urrin g radioactive materi al in Englewood water treatment pl ant residual samples . Mr. Bill McCormick, Operations Superintendent , appeared to discuss the results and noted that the dat a supported continuation of the current practice of disposal at the Foothill s Landfill. Bill noted that the State has given their preliminary approved and Foothills has agreed to honor existing hauling rates. 6. WA TER RIGHTS UPDATE . The Board received fro m David Hill , Englewood's Water Attorney, water right s upd ates dated January 13, 2009. Stu discussed deve lopment s in water liti gation cases in which Eng lewood is involv ed. 7. SEWER LINING PROJECTS . Mr . Bill McCormick discussed quot es rece ived for sewer lining projects for 2009. The sewer utility will be lining 960 feet of clay pipe wi th cured-in-place linin g. The projects are the lining of 310 feet of sewer main at Flo yd and Delaw are and 650 feet in the 2900 block alley betw ee n Bannock and Cherokee. Wi ldc at Civil Service s was the winning bid at $34 ,340. Another project is possible at Fox and Mansfield with th e same contractor. At this location a manhole must be installed first to accom mod ate the project. The contractor will honor the same per-foot-price for the third project. 8. ECONOMIC STl.MULUS LOANS . Stu discu ssed the pote ntial State revolvin g loans . It appears th at th e bond mark et ma y be more advantageous than the state revolving loans to fund such future proj ec ts as th e ultraviolet disinfection system at th e Allen Water Treatment Plant. • • • • • • 9, PRETREATMENT ORDINANCE. Hi s concern is that the prop osed hex av alent chromium sta ndard would be cost prohibiti ve for hi s bu sin ess. Stu noted that hexava lent chro mium is a po renti all y cancer-causin g compound and carries an EPA fine ofup to £30 ,000 pe r <lar, Wastewater treatm ent pl ant staff will be responding to hi s co ncern s.
