AN ORDINANCE AUTHORIZING THE ACCEPTANCE OF A VICTIM ASSISTANCE LAW
ENFORCEMENT 0/ ALE) GRANT FROM THE VICTIM ASS ISTANCE LA \V
ENFORCEMENT BOARD OF THE 18TH JUDICIAL DISTRICT .
WHEREAS, the City of Englewood Safety Se rvice Department applied for fund ing under the
VALE Grants Program to be used for funding the Victim/Witness Program in the Englewood
Municip•I Coun; and
WHEREAS, the Victim/Witness Program in the Englewood Municipal Coun has served the
victims of domestic violence since 1990; and
WHEREAS, the City of Englewood has previously applied and been granted VALE Grants
for the years 1990 through 2008 ; and
WHEREAS, the staff seeks Council approval of an Ordinance accepting a 2009 VALE grant
funding in the amount of $16,740, for the period of July I, 2009 to June 30, 20 IO ;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNC U, OF THE CITY OF
ENGLEWOOD, COLORADO , AS FOLLOWS :
Section I. The City Council of the City of Englewood, Colorado hereby authorizes the
acceptance of the VALE Grant and accompanying intergovernmental agreement, a copy of which
is marked as "Exhibit A" and attached hereto .
Section 2. l11e City Manager, the Chief of Police and the Director of Finance/Administrative
Services are ~ereby authorized to sign said VALE Grant and accompanying intergovernm ental
agreement on behalf of the City of Englewood .
Introduced , read in full , and passed on first reading on the 1st da y of June 2009.
Published as a Bill for an Ordinance in the City 's official newspaper on the 5" da y of June, 2009.
Published as a Bill for an Ordinance on the City 's official website beginning on the 3"' day of
June , 2009 for thirty (30) days.

VICTIM ASSISTANCE AND LAW ENFORCEMENT BOARD
CONTRACT
Pursuant to the Assistan ce to Victims of and Witn es se s to Crime s and Aid to Law
Enforcement Act , Article 4.2 Title 24 C.R.S., th e Victim Assistan ce and Law Enfo rce ment
Board of the 18th Judicial District has made the following award :

Purpose of Grant Funds: La w Enforcement Victim Services
Services/Equipment Being Funded : Portion of Salary and Benefits for Victim Assistance

Grant Period : Jul y 1, 2009 to June 30 , 2010
Amount of Grant Award : $16,740 .00
Quarterly In stallments: Four (4) Quarterly Payments of $4 ,18 5 .00
BE IT UNDERSTOOD THAT :
(1) All disbursements of awards are continge nt upon the availability of VALE funds.
(2) The contents of the grant application will become contra ctual obligations or the grant
recipient and are incorporated into this contract as if fully set forth herein .
(3) The grant recip ient is required to submit Financial Reports quarterly: October 30, 2009 ,
January 29, 2010 , April 30, 2010 a nd July 30 , 2010 for funding for 2009/2010. The report due
on July 30, 2010 shall be the year-end report. The VALE Board will provide Financial
Reporting Forms. Grant rec ipients are required to use these forms .
(4) The grant recipient is required to submit Program Reports on : January 31 , 2009 and July
31 , 2009 for funding for 2008 /2009 . These reports must address any special conditions that
are listed in this con tract. The report due o n July 31, 2008 shall be the year-end report . It shall
show totals for the entire ye ar and must address any special conditions that are listed in this
contract . The VALE Board will pro vide Program Reporting Form s. Grant recipients are
requ ire d to use thes e forms .

(5) Failure to submit these required reports on the dates due may result in suspension of the
grant , termination of the grant, return of awarded funds or the loss of future funding by VALE.
(6) Special conditions for the award which have been stipulated between the VALE Board and
the grant recipient are as follows :

(7) Any equipment purchased with VALE funds must remain with the grant recipient.
Equipment must be us9d for the purpose designated in the grant application. Any use by
others or transfer of ownership must be reported to the VALE Board , in writing , prior to the

occurrence of such >JS'3 N trar :sfer. The Board may approve such use or transfer or may •
request return of the equipme.m.
(8) ADY change in the use of grant funds shall be approved by the VALE Board. The request
for such change sh all be in writing . Approval of the VALE Board shall be o bt a ined prior to any
such use .
(9 ) Amendment of any other terms of this contract shall have prior approval of the Board .
Requests for amendment shall be in writing .
(10 ) The grant recipient shall submit written notification by June 1, 2010 to the VALE Board if
the grant re c ipient will have any remaining funds at the end of the grant period .
All unused funds shall be returned to the VALE Board unless the grant recipient makes a
request in writing for use of the funds beyo nd the grant period and such request has been
approved by th e VALE Bo ard .
Such requ e sts shall include:
The amount of remaining funds
How the funds will be used
When the funds will be expended
Why the funds were not expended. •

Upon receipt of th e request , the VALE Board shall de cide whet he r to gra nt or de ny the request
without further presentation or hearing.
(1 1) The grant recipient agr ees that all funds received und er this grant shall be expended
so lely for the purposes stat ed above and that any funds not so expended, including fun ds lost
or diverted to other purposes, shall be repaid to the VALE fund .
(12) The grant re cipient agrees to comply with the letter and spirit 0f the Colorado Anti-
discrimination Ac.t of 1957 , as amended, and other applicable law respecting discrimination
and unfair emplc,yment practices (C.R .S . Sec . 24-34-402) and required by Exec utive Order,
Equal Opportunity and Affirmative Action , date April 16, 1975 .
(13) Non-com plianc e with this contract may include failure to submit reports , making
unapproved changes to the budget , performance failures or adherence to special conditions .

(14) All grant rec ipients shall ma ke available to the Board or its authorized designee all current
books, records , procedures or other information relative to th e grant application and
implementation.
(15 ) The fun ds granted by this co ntract for Victim Services shall be disbursed in quarterly
Installments pending VA LE Board approval of all required reports and verifi ca ti on of expenses .
The fu nd s granted by this contract for equipment may be dispersed by a single payment for
the full amount, pe nding VA LE Board approval of all required re po1s and verification of
ex p e nses .

The grant recipient, through the following signatories , understands and agrees that any VALE
monies received as a re r-ult of the awarding of the grant application shall be subject to the
terms of this contract.

Authorized Official : The authp rized official is the ~erson who is , by virtue of such person 's position , authorized to
enter into contrac ts for the grant recipient.
This could include : Mayor or City Manager , Cha irperson of the County Commissioners , District Attorney, President
or Chairper son of the Board or Directors, Superintendent, or other Chief Executive Officer .
Financial Officer : The person is responsible for all financial matters re lated to the program and who has
responsibility for the ac counting , management or funds, ve rification or expenditures , audit Information and finan ci al
reports . The pe rs on who actu ally prepares the finica l reports ma y be u,,der th e supe rv ision or the Financial
Offi cer . The Financial Offi cer must be a person other than the Aut horized Offi ci i.: or the Project Director .
Pro ject Director : The per son who has direct re spon si bility fo r the Implem en tati on of the pr oj ec l. This person
should combine knowledge and experience In the project area with abili ty to admin is te r the project and supe rv ise
personnel . He /she shares responsib ility with the financial Office for seeing that all expendi tu res are wi th in the
approved budget. This person will normally devote a major portion of his/her time to the project and is responsible
for meeting all reporting requirements . The Project Director must be a person oth er than the Author ized Official or
the Fina nc ial Officer .
