BEnVEEN THE BOARD OF COM MISSIONERS OF ARAPAHOE COUIITY,
CO LORADO, BY AND THROUGH THE ARAPAHOE COUNTY CLERK AND
RECORDER, AND THE CITY OF ENG LEWOOD , COLORADO , TO CO NDUCT A
COO RDINATED ELECTIO N ON NOVEMBER 3, 2009 .
WHEREAS , pursuanl 10 the Unifonn Election Code of 1992 (Artic les I 10 13 of Title
I, C.R.S.) as amended , governmental en1i ti es are encouraged to cooperate and
consolidate elections in order to redu ce taxpayer expenses; and
WHEREAS , the City of Englewood ha s panicipated with Arapahoe County in
conducting coordinated elections since 1993; and
WHT .REAS, Arapahoe County and the City of Eng lewood have ~etennined that it is
in the best interest of the taxoayers and the electors to conduc.t a Coordinated Electi on on
November 3, 20(\0 · and
WHERE/ · .1. pahoe County and th e City of Englewood desire to set forth their
respective responsibilities for the Coordinated Election pursuant to the
Intergovernmental Agreement.
NOW, THEREFORE , BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF ENGLEWOOD , CO LORADO , AS FOLLOWS :
Section I. Th e Intergovernmental Agreement for Coord inated Election is attached
hereto as "Exhibit A". The Intergovernmental Agreemc .. • for Coo rdinated Election is
hereby accepted and app roved by the Englewood City Co uncil.

• INTERGOVERNMENTAL AGREEMENT
FOR COORDINATED ELECTION
ARAPAHOE COUNTY
NOVEMBER 3, 2009

This Intergove rn mental Agreement is e ntered into by and between the Board of Cou nt y
Commissioners of th e Co unty of Arapaho e, Sta le of Colorado and th e Arapahoe County Clerk and
Recorder (hereinafter jointl y referred to as th e "County") and th e

WHEREAS, pursuant to th e Uniform Election Code of 1992, (Articles 1 to 13 of TIiie 1,
C.R.S.) 3s amended, governmenta l entities are encouraged lo cooperate and consolidate elec tion s
in order to redu ce taxpayer expe nses; and
WHEREAS, th e Cou nty and th e Political Subdivision have determined that it is in th e best
in te rest of th e taxpa yers and the electors jo conduct a Coordinated Election on November 3, 2009;
and
WHEREAS, the County and the Politi ca l Subdivision desire to set forth their respe ctive
respon si bilities for the Coordina ted Election pursuant to this Intergove rnmen ta l Agreement.
NOW, THEREFORE, IT IS AGREED by th e County and the Politic al Subdivision as follows :
• 1. The November 3, 2009 election shall be co nducted as a Coordinated Election in accordance

with the Uniform Electio n Code of 1992 (Articles 1-13 of Title 1, C .R.S .). The election
participants shall be required to execute agreements with Arapahoe County for th is purpose
and may include munici palities, school d istricts and special dis tncts within the Arapahoe
County limits and the State of Colorado .
2 . The November 3, 2009 election shall be conducted by th e County as a mail ba llot e lecti on .
3. The A rapahoe County Clerk and Recorder shall be designated as th e Coordinated Electi on
Official and th e Political Subdivision hereby iden tifies Loucrishia A. Ellis, City Cle r k
as It s Desig nated Election Official.
4. The Coun ty shall perform th e fo ll owing ta sks· in relation to said electi on, to wit:

Negoti ate an agreement for th e printing of th e officia l ballots .
Provide a copy of th e ballot layout and th e text of the officia l ballot to th e des ignated
election offi cial for proo fr ead ing before authoriza ti on to begin printing of all ballots.
Certify the r.o mplete number of registered elec tors within th e Arapahoe Cou nty portion of
the Political Subdivi sion no later than October 14 , 2009 .
Pro vide a copy of th e political subdivisio ns' legal boundaries as d efined in th e
Arapahoe County Stree t List Lo ca tor no later than July 30 , 2009 .
Provide suppo rt on the date of the election by tel ephone an d in p e rson, sho uld th e need
arise, until co unting of the ba ll ots is com pl eted .
Provide unofficial results of the election on el ec ti on night by t eleph one or by facsimile
tra nsmitlal upon requ est.
g . Main ta,n a list of actual voiers from the November .3, 2009 el ecti on, and upon request,
genera te a printed li st of th e persons wh o voled follow ing the election . The co st will be
$.005 (1/2 cent) per name .
h. Store all vo ted ball ots for a minimum of 25 mo nth s, a nd all oth e r m at eria ls req ui red by law
(Section 1-7 -802, C.R.S.) to be save d, in such a ma nner that the y m ay be acces sed by the
parti cipa tin g jurisd icti on, if necess ary , lo reso lve any challenge or o ther legal qu es ti ons tha t
mig ht arise regarding th e ele cti on.
Kee p a careful and accurate accou nt ing of li me, suppli es, printin g co sts an d salari es
att rib utable to th e Co unty's admlai strati on of th e e lecti on for th e Ju risdiction . The
parti cipating jurisdicllo~·s prop orti onal sha re of actual costs shall be based on Co ~n ty
expendit ures re lati ve to the Novemb er 3, 2009 election .

Publi sh and post th e required legal notice pursuant to C .R.S . 1-5-205 that is published no

o. Provide and o perate th e County's electroni c vote-counting equipment. There wilt be no
cha rg e for th e pre-electi on pr eventative maintenan ce on th e e lectro nic vote-counting
eq uipm ent for th is e lecti on cyc le.
5. The Political Subdivi sio11 shall perform th e following ta sks in re lation lo said election, to wit:
a . Ce rtify the candidates, if applicable, and th e li st of ballot issu es and /or ba ll ot questions on a
diske tt e or by email (with recei pt con fi rm ed by the County Election D e partme nt) in Mi crosoft
Word formal along with a pape r copy no later than 4:00 p.m . on S e ptember 4, 2009 . Th e
ba llot co ntent must be cert ified in the ord er In which It will ap pear on the ba llot. Th e
ce rti fie d lis t of candidate s, ballot iss ues and/or ballot question s shall be fina l and th e
Co unty wi ll not be responsible for making any changes after the certification .
b. Within one day of receipt, proofread th e layout and the text of th e jurisdiction's portion of
th e official ba ll ots before a uthorizing th e printing of all ballots.
c . Pu bli sh and post any requ ired leg al noti ce s for th e jurisdiction's candidates , ba llot issues
and /or ballot questions, other th an the notice required by C.R.S . 1-5-205 that is published no
later tha n 10 days prio r to the ele cti on. A co py of such publi sh e d legal notice shall be
submitted to the County for its record s.
d . Prep are , hand-count and deliver to th e County Cl erk, th e required t est deck of ballots for
tes ting the electronic vote co unting equipment. Participation in logic and accura cy test,
dale to be determined .
e . Remit payme,,t directly to Arapahoe County within 60 da ys of billing for its prorated share
of ALL COSTS ,e la ing to th e printing and malling of ballots and all other election expenses
de scribed In Sectio n 4.

7. Unless otherwis e agreed in writing, this Intergovernmental Agreement and the interpretation
th ere of shall be governed by the laws of the State of Colorado .
8. Should any provis ion of this Int ergovernme ntal Agreement be determined by a court of
competent jurisdiction to be unconstitutional or otherwise null and void, It is the intent of th e
parties hereto that th e remai ning provisions of this Intergovern menta l Agre ement shall be of
full force and effect.
9. Notices to be provided under thi s Intergovernm enta l Agreement shall be given in writing either
by hand delivery or deposit In the United States mail , ce rtified mail , return re cei pt requ es ted,
with sufficient postage , to the following persons :

COUNCIL GOAL AND PREVIOUS COUNCIL ACTION
The City of En glewood has participated w ith Arapahoe Coun ty in conducti n g coordin ated electi ons
fo r every City of Englewood General Municipal Election sin ce 1993.
RECOMMENDED ACTION
Staff recommends City Council adopt a bill for an ordinance approvin g an intergovernmental
agreem ent betwe en th e City of Englewood and Arap ahoe County fo r the November 3, 2009
Coordinated Mail Ballot Election .
Beca us e of Stat e Legislation and th e Taxpa ye r's Bill of Rights (TABO R) ame n dment approved by th e
voters in 1992, coordinated electi ons are to be co nducted throughout th e State by Co un ty Clerks .
Arapahoe County has advised the City of Englewood it will be conductin g a Mail Ballot Elec tion on
N ovember 3, 2009. Th e County has the capability of coordina tin g th is elec ti o n and including th e
City of Englewood.
The Election Commission agrees th at it is in th e best in teres t of th e elec tors of Englewood to
conduct futu re electi ons jointly with the oth er politica l en tities wi th in the Coun ty. In ord er to
participate in th e 2009 Coordinated Elec tion, the City of Englewood mu st enter into an
intergovernmental ag reem ent with Arapahoe County.
Staff has rev iewed th e propos ed intergovernmental agreement an d concurs w ith th e Commi ss ion's
reco mmend at ion .
FINANCIAL IMPACT
Since c osts are hased on severa l va riabl es, e.g. the number of regis ter ed electo r; in th e City of
En glewood at th e tim e of th e electi on, th e number of ba ll ot qu es ti ons, th e number of entiti es
parti cipa tin g in the elec ti on, the financia l impact is onl y an es timate. Based on the known facts, th e
cos t of th e 2009 muni cipal elec tion has been budgeted al $25,00'l.
