WHEREAS , th~ood Cit)' Councii ,uthorized the app lication for and acceptance of
Justice Assistance Grants (JAG) wit!1 thr, pa ,sage of Ordinance #49, Series of 2008; and
Ordinancc#l 2, Series 2009; and
WHEREAS , the Bureau of Justice Assistance is requiring the City to collaborate with other
metro agencies in the application for and the administration of the JAG grant; and
WHEREAS , the City wishes to join Arapahoe County and Ute Cities of Aurora and Centennial
in cooperating in the JAG program; and
WHEREAS , the Justice Ass istance Grant is a non-matching grant number 2009-09198 -CO-DJ
of Thiny-Five Thousand, Two Hundred and Thineeo do ll ars, ($35,213.00);
NOW, THEREFORE, BE IT ORDAINE D BY THE CITY COUNCIL OF THE CITY OF
ENGLEWOOD , COLORADO , AS FOLLOWS :
Secti on 1. The City Co uncil of the City of Englewood, Colorado hereby authorizes the
intergovernmenta l agreement 10 apply for and accept the Justice Ass istance Grant from Edward
Byrne Justice Assistance Grant Program, attached hereto as Exhibi t A.
Section 2 The City Manager is authorized to execute said in tergovernmental agreement
regarding the grant for and on behalf of the City of Eng lewood .

hereinafter re fe rr ed to as COUNTY , th e CITY OF AURORA, th e CITY OF ENGLEWOOD, and
the CITY OF CENTENNLA.L, on behalf of th e ARAPAHOE COUN TY SHERIFF'S OFFICE
whom the CITY OF CENTENNIAL contracts with to pro vi de law enforcement and emergency
management serv ices, hereinafter referr ed to as CITIES, all of Arapahoe Co unty , State of
Colorado, witn esseth :
WHEREAS , the Edward Byrne Memorial Ju stice Assistance Grant (JAG ) Program provides
grants to states, trib es, and lc,cal governm ents to support a broad range of acti-,ities to preve nt
and control crime based on th eir own local nee ds and conditi ons: and
WHEREAS , the CITIES and the COUNTY wisi1 to obtain funding from the Edward P.yrne
Memorial JAG for fundin g th e fo llowing:
Arapahoe Countv Sheriff's Office ($42,354) and the City of Centennial ($31.697), in joint

WHEREAS , the COUNTY and the CITY OF CENTENNIAL are in a co nt ractual relat ionship
for the COUNTY to pro vid e law enforcement and emergen cy man age ment serv ices to th e CITY
OF CEN TENN IAL , the CI TY OF CEN TENN lAL agrees to turn th e fund s over to th e COUNTY
to be used to benefit th e CIT Y OF CENTENN IAL : and
WHEREAS , eac h governin g bod y fin ds that th e performan ce of thi s Agree ment is in th e best
interes ts of all parti es, that th e und ertaking will benefit the publi c, and that th e divis ion of cos ts
fair ly co mpens ate s th e perfo rmin g party fo r the se rvices or fun cti ons under thi s agreem ent: and
NOW , THEREFORE, th e COUNTY and CITIES agree as follows :
Section 1
The CITY OF A UR ORA will submit the grant application and take receipt of the fund s when
disbursed . The CITY OF AURORA will then submit to the COUNTY and oth er CITIES their
allo catio n as agreed upon in this Agreement. Said funds will be sent to the account and financial
institution provid ed to the CITY OF AURORA by th e COUNTY and othe r CITIES. The CITY
OF A UR ORA will i:eve fifteen business days to disburse th e allocations to the COUNTY and
other CITIES after th e CITY OF A UR ORA receives the funds from the United States
Department of Justice .
Section 2
The CO UN TY and CITIES agree to all oc ate the total amount of JAG funds of$1 ,7 43 ,612
avail abl e in fe deral grant moni es to all partie s in the folio · ,;ing amounts:
To the COUNTY : $4 2,35 4.
To th e CITY OF CENTENNIAL : $31 ,697 .
To th e CITY OF AURORA: $295,436 .
To th e CITY OF ENGLEWOOD : $35 ,213.
Section 3
COUNTY agrees to use $4 2,3 54 of th e JAG fund s through Septemb er 201 2, the period cov ering
the gr ant.
CITY OF CENTENNIAL , in joint coop eration with the Arapahoe County Sheriff's Offic e,
agree s to use $31,697 of the JAG funds through September 2012 , the period covering th e grant.
CITY OF AURORA agrees lo use $295 ,436 of the JAG fund s through September 2012, the
period covering the grant.

Section 4
COUNTY and other CITIES ag rees to submit to CITY OF AURORA all fina ncial reports,

calend ar qu arter so th at the CIT Y OF AURORA may co mp lete and submit the mand atory
quarterly repmt lo the federal governme nt.
Section 5
Ea ch party lo th is Agreement wi ll be respo nsibl e for co mply in g with the terms and condition s of
the gra nt and for its own actions in providing services under this agreement and shall not be
li ab le for any civi l li ability that may aris e from the furnishing of the services by any oth er party .
Each party understands and agrees that, for purpo ses oftl1e grant, th e CITY OF AURORA shall
not be cons id ered a "pass-through entity" within th e meanin g of 0MB Circu lar A-133. Th e
CIT Y OF AU RORA 's status shal l be that of a fisca l age nt and, as such, the CITY OF AURORA
shall bear no res ponsibili ty for monitoring the use of grant fund s by any of the oth er partie s to
this Agreement. Accordingly, each party to thi s Agree ment shall be cons id ered a co -r ecip ient of
th e grant and, in th at ca pacity, shal l be di rectly accountabl e lo th e United Sta tes De partm ent of
.Justice for all mailers co nce rn ing gran t comp li ance. •
Section 6
The parti es lo th is Agreeme nt do not intend for any third party lo obtain an y rig hts by virtue of
thi s agree m~nl or lo create any rights in any party not a signatory hereto .
Section 7
By entering int o thi s Agreement, tl1 e parties do not intend lo cre ate any obligations expre ss or
;rnpl;ed oth er th an those set out herein. TI1is Agreeme nt represen ts the entire and inte grated
ag reement betwe en th e COUNTY and CITIE S and supersedes all pri or negotiations ,
represe ntati ons or agreements, eith er written or oral.

COUNCIL GOAL AND PREVIOUS COUNCIL ACTION
On September 19, 2008, Ordinance #49 was approved, authorizing th e acceptance of a Ju stice
Assistance Grant between th e City of Englewood and the Justice Ass ist an ce Program . The grant, in
the amou nt of $10,360 was utilized by th e Police D epartm ent to purch ase t ec hno logica: tools.
On M ay 4, Counci l approved Counci l Bill 14, authorizing applica tion for and acceptance of a
Re covery Act Justice Assistance allocation.
On May 28, 2009, th e City of Englewood was notified th at th e Po li ce D epa rtment h as been
awarded $35,213 via anoth er Ju st ice Assistance Grant Allocation, pursuant to application .
RECOMMENDED ACTION
The Poli ce D epartm ent recommends th at City Council ado pt a bill fo r an o rdin ance auth o rizin g th e
appli ca tion for and acceptance o f En glewood's po rti o n of a Ju stice As sistance Grant (2009-G9198-
CO-DI). The Justice As sista nce Grant requires that th e City of Englewood Po li ce D epartm en t
coll aborate with th e C ity of Aurora and the Arapa hoe County Sheriffs Office. Til e to tal
disburs em ent fo r thes e agencies is $404,700. Engl ewood's share of th e to tal is $35,213. Th e
Aurora Po lice D epa rtment w ill be th e fiscal agent for th e gra nt.
BACKGROUND, ANALYSIS, AND ALTERNATIVES IDENTIFIED
The Police Department ha s determined that its all ocation w ill be use d to proc ure a digi tal ev idence
archi ve software program, ins tr uc tor training and training equip ment for self-defense purposes,
add itional lasers, portable breath tes ters, two gun cl ea ring d ev ices, and o ne lapto p computer. Th e
digi tal evidence archi ve w ill manage and sto re all form s of digital ev idence, thu s eliminating th e
need to store digi tal evi dence in th e Ev id ence/Property Room o r on desktop com puters .
FINANCIAL IMPACT
This is a no n-mat chin g grant in th e amount of $35,213 . The Police Department will fo ll ow standard
City of Englewood purchasin g practices by reques ting quotes from private vendors o nce th e gran t
monies are award ed . It is expected that subse quent yea rl y maintenance agreemen ts for th e Digital
Eviden ce Archive w ill be $2,400. Th e m aintenan ce fees will be paid o ut of the Police Operati ons
budget.
