HomeMy WebLinkAbout2009 Ordinance No. 030• • • ORDINANCE NO . :iJ SERIES OF 2009 -- BY AUT HORJTY COUNC IL BILL NO. 30 INTRODUCED BY COUNC IL MEMBER McCAS LIN AN ORnlNANCE SUBMITTING TO A VOTE OF THE REGISTERED ELECTORS OF THE CITY OF ENGLEWOOD AT THE NEXT SCHEDULED MUNICIPAL ELECTION A PROPOSED AMENDMENT TO ART IC LE III, SECT ION 22, "TERMS'", OF THE EN GLEWOOD HOME RULE CHARTER . WHEREAS, the founding fathers set forth the principal of se rvice to governme nt by citizen representatives ; and WHEREAS , the City of Englewood 's Home Rule Charter currentl y sets forth that "no member of City Council shall serve more than two consecutive terms in such office"; and WHEREAS , th e Englewood City Council reviewed wheth er allowing an additional term would create an entrenched bureaucracy, which would be incon sis tent with thi s phil oso phy; and WHEREAS , after due consideration the Englewood City Council ba s detennined ~'lat it is more beneficial to retain an experienced Council memb er for one more tenn if the ci ti ze ns wi sh to reelect that memb er. NO W, THEREFORE, BE IT ORDAINED BY THE CITY COUNC IL OF THE CITY OF ENGLEWOOD, COLORADO, AS FOLLOWS: Sec tion I . There is hereby submitted to the re gistered electors of the Cit y of Eng,ewood at the ne xt scheduled municipal election on November 3, 2009, a proposed amendment to the Home Ruic Cha rt er of th e C it y of Englewood , Arti cle ill, Sec ti on 22, to rea d as follows : Questi on No. Shall th e Home Ruic Charte r of the Cit y of Englewood , Article ill, Section 22, be amended to read as follows : 11 b iii 22: Terms. ARTICLE ill LEGISLATIVE BODY Tenns of Councilpersons shal l begin at 8:00 P.M. on the day of L'.e next regularly scheduled City Counci l meeting following the election . Seven Co<1ncil persons shall be elected at the regular City election to be held on the fir,t Tuesday after the first Monday in November, 1959. The candidate receiving the highe•· .Jmber of votes from District 1 and the candidate receiving the highest n1,mli or , ' ates from Distri ct 3 shall hold office for four years, and the candidate rece i ,j1•& ;lie ;-u ghest number of votes from District 2 and the candidate receiving the hi _ ,.,s! number of votes from District 4 shall hold office for two years. The two candidates at large receiving th e highest number of votes shall serve for four years, and the candidate at large receiving the third highest number of votes shal l serve for two years . Thereafter, all candidates elected shall serve a term of four years, and a general municipal election shall be held at two-year intervals. (!) In order to broaden the opportunities for public service and to guard against excessive concentrations of power, no member of City Council • shal l serve more than !We ~consecutive tenns in such office. This Amendn,ent may be modified in form only to comply with the ballot requirements of th "lovember 3, 2009 Coordinated Election. Section 3. Each registered elector voling at said election and desirous of voling shall indicate !tis/her choice by depressing the appropriate counter of th e voling machine or by th e appropriate marking upon paper ballots where used . Section 4. The proper officia ls of01e City of En glewood sha ll give notice of said next scheduled murticipal election , such notice sha ll be published in the manner and for the length of time required by law, and th e ball ots cast at such election shall be canvassed and th e result ascertained, determined, and certified as required by law. Section 5. Only if the question is approved by the registered electors of the City of • Englewood shall the Section be amended and the Charter, as amended, certified to the Secretary of State. • • • Section 6 . Any City o f Englewood registered el ector desiring to protest a proposed ballot titl e and/or submission clause for any iniliatcd or referred mea sure may file a written pro t st in the offi ce of the City Clerk. Said noti ce of protest shall be filed no later that 5 :00 p.m. on the Friday immediately preceding the date upon whi ch the City Council will consider the ordinance, on final reading, setting the ballot title and/or submi ss ion cl ause. The notice of protest shall set forth with particularity the ground s of the protest. Such protest sha ll be heard. oonsidered , and resolved by the City Council prior to the adop ti on of said ordinance . Section 7. If any section, paragraph , clause , or other portion of this Ordi, !u1cc iJ for any reason held to be invalid or unenforceable, the invalidity or uneoforceabili t)' shall not affect any of the remaining portions of this Ordinance .
