JS SERIES OF 2009 -- BY AUTHOR ITY COUNCIL BILL NO . 36 INTRODUCED BY CO UN CIL MEMBER WILSON AN ORDINANCE AMENDING TITLE 4, CHAPT ER 4, SECTION 4, SUBSECTION 7(C), OF THE ENGLEWOOD MUNI CIPAL CO DE 2000, PERTAfrllNG TO RET AiLER AND VENDOR FEES FOR SALES TA)(. LICENSES . WHEREAS, the Englewood City Council authorized th e estab lishment of a vendor fee which provided a five percen t venoor fee to cover the vendor's expense in the co ll ec tion and remittance of sa les tax by the passage of Ordinance No. 32, Series of 1961; and WHEREAS, the passage of Ordinan ce No . 32 , Series of 1968 reduced th e fee from the initial rate of five percent to 2.5 perce nt ; and WHEREAS, the passage of Ordinance No. 27, Series of 1970 reduced the fee to 1.6 percent ; and WHEREAS, the pa ssage of Ordinance No . 58, Series of 2002 reduced the fee to .5 percent ; and WHEREAS , the passage of this Ordinance will reduce the Vendor fee from .5 to .25 percent in order to preserve City funds that can be used to maintain staffing and provide necessary services to the community ; NOW , THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ENGLEWOOD , COLORADO, AS FOLLOWS : Secti on I. The Cit y Council of the City of Englewood, Co lorado hereby authorized amending Title 4, Chapter 4, Section 4, Subsection 7(C), of the Englewood Municipal Code 2000 , entitled "Sales Tax Returns" to read as follows: 4-4-4-7: Sales Tax Returns . A. Every person required tc ,btain a sa les tax li cense pursuant to the provision s of Section 4-4-4-4 , shall file a sa les tax return , with payment of ta x owed, if any , upon the standard Muni ci pal sales and use tax reporting fortn as adopted by the Executive Director of the Co lorado Department of Revenue, not later than the tw entieth da y of each mo 1th for the preceding calendar month ; provided, however, that if the accounting methods regularly employed by the licensed reta iler in the transac tion of his/her business, or other conditions, are such that reports of sa les made on a calendar monthly basi s will impose unnecessary hardship, the Director may, upon request of said retailer, accept reports at such interval s as will, in his/her opinion, better suit the convenience of th e taxpa yer, and will not jeopardize the collection of the tax . 1 B. C. RETAILER RESPO N SIBLE FOR PA YM ENT OF TAX, w hich prov ide d a five percent vendor fee to cover th e ve ndor's expense in the coll ecti on and remittance of sa les tax. This fee has been red uced sin ce its initial rate of five percent to 2.5 percen t by th e passage of Ordinance 32 , Se ries of 1968, to 1.6 percent by th e passage of Ordinance 27, Series of 1970, and to its c urrent rate of .5 percent by Ordinance 58, Series of 2002. RECOMMENDED ACTION Staff recomm en ds Counc il approve th e pr oposed bill fo r an ordinance amendi ng 4-4-4-7C of th e Engl ewood Municipal Code. This ordinance was approve d on firs t read in g at th e August 1 7, 2009 Council mee ti ng. We subseq uentl y discove red that the effecti ve date had b een omitted from th e ordin ance and consequently, we are reques ti ng that C oun ci l approve th e amended ordin ance tha t now in clu des th is inform ation. BACKGROUND, ANALYSIS, ANO ALTERNATIVES IDENTIFIED The Code all ows a ve ndor filin g a timely sa les tax re tu rn to the City of Englewood to retain one-ha lf of one p ercent (.5%) of the taxes req uired to b e co ll ected. City staff recom m ends reducing this fee to a quarter of a percent (.25%). Thi s act ion w ill preserve City funds th at ca n b e use d to main tai n staffi ng and pr0> ,de necessary services to th e community.
