BACKGROUND, ANALYSIS, AND ALTERNATIVES IDENTIFIED

En glewood's righl-o f-way for i he Ca bin M ea dow Tran smountain Dive rsi on Pr oj ec~ w hich is loca l ed
in Grand County ac ross fro m ih e Winter Park Ski area. In order to accomplish this, a license
agreemen t is required . A lega l des cripti on is in cl uded in the crossi ng agreem en t and a m ap of th e

Reservo ir, whi ch is part of Englewood 's raw water rights.
The Cit y reserves th e right to make full use of the property necessary in the opera ti on of
th e Ca bin Mea do w Tran smount ain Di ve rsi on pipe or any other of its fac iliti es or

Mr. Wo odward sugges ted modifying paragrap h #2 in future license agreements to clari fy
that three bu siness days notice is required prior to commencement of cons truct io n. Mr.
Wood ward also requested that th e tim e frame for future contracts be clarified.

3. 92" STORM SEWER COLLAPS E AT OXFORD ANDS . PLATTE RIVER DR .
Tom Brennan , Util iti es Engineer, appeared before the Board to di sc uss the 92" stonn
sewe r co llap e. On May 26 it was disco vered that th e bottom of the slo1m sewer pip e at

W. Oxford Ave. and th e S. Pl aue Riv er wa s eroded and there was a 12" hole in th e sid e of
the pipe . On Jun e 6, 20 09 initial repairs were mad e and a 4' sec tion of pip e was rep aired.
A second failure occurred th e evening o f Jun e 25, app rox imately 40 fe et downstream of
the first repair, ca usin g a large sin khole and th e pip e to co ll apse . On July 10, 2009
anoth er maj or storm occurred (2" in 20 minut es). Thi s caused the sinkho le to double in
si ze, necessitatin g clos in g two lan es of traffic in W. Oxfo rd Ave .
After investigation , it is believed that th e fai lure was due to th e earth supp orting the pipe
bein g disturbed afte r the initi al washout occ urred. Discu ssion ensued regarding initi al
design in adequacies . Du e to th e urge ncy of th e situation , American Civi l Constru ctors
was mobi li zed on Jun e 26 to open th e drainage path , remove th e damaged pipe ar.
sta bili ze the hol e. The initi al emerge ncy wo rk was co mpl eted June 26 .
The immediate problem has been fixed , but infrastructure improvements will be on goi ng.
Th e Utiliti es Dep artment is continuing to work with American Civil Co nstructors and
several oth er suppli ers on pipe av ailability and replacement options . Preliminary
es timates for th e total project range from $100,000 lo $300,000 . The project should be
com pl eted by th e we ek of Jul y 20 .
4 . LITTLETON/ENG LEWOOD WASTEWATER TREATMENT PLANT
PERMIT .
Ms. Mary Gardner, Regulatory Program s Administrator, appeared befo re th e Board to
discu ss th e Colorado Di scha rge Permit System draft perm it for discharge from th e
Littleton/Englewood Wastewater Treatment Pl ant. As requested, th e Water ~ualit y
Control Division granted an extension of th e publi c comment period until Jul y 6, 2009.
Co mm en ts and requests were documented and submilted by the deadline.
Mary reviewed key issues and comments of the draft permit. It was not ed th at th e tiered
permit limit s based on di sc harge flow were approved . The Co mmission approv ed th e
seasona l temperature shift and temporary modific ati ons throu gh 20 14 . A compliance
schedule is provided for al,emate disinfectio n with a favo rable emuent limitation for
fecal coliform . A co mpliance sc hed ul e for ammonia is also ne eded and was om itt ed by
th e Di vis ion . Al so, effiuent limit s for cop per, sil ver and lindane we re removed fr om the
draft permit.
Mary not ed that pennit cha llenges to be addressed are, I) the maxi mum daily limit for
:otal inorganic nitrogen , 2) some permi t limits are lowe r than th e preliminary effiuent
limit s th at were used in th e design process, 3) th e iron limit is lowe r th an is measured in
the effl uent and 4) the plant rece ived a cyan id e permit limit.
Th e Board also receive d a memo that gives an ove rview of th e bas ic statu tory and
reg ulat ory framework of th e Co lorado di sc harge permit sys tem .
5. WATER RIGHTS UPDAT E DATED JUNE 5, 2009 FROM DA YID HILL .
The Board received fro m David Hill , Englewoo d's Water Attorney, a water right s upd ate
da ted Jun e 5, 2009. Stu di sc ussed deve lopm ent s in wa ter liti gation cases in whic h
Eng lewood is invo lved .
6. DELINQUENT WATER BILLS AT ENGLEWOOD POSTAL FACILITlES
(USPS).
Th e Board received an upd ate from EnglewooJ's Cit y Attorney, Dan Brotz man ,
regarding the past-due bills fo r th e IJSPS fac iliti es at 3330 S. Bro adway and 9 15 W.
Lehigh Ave . As of July 2, 2009 th e USPS has agreed to pay th e past du e wa ter, sewer
and concrete bi ll s, but will be optin g out of th e concrete program on future bills . The
USPS wil l not be res ponsible for pas t or future storm water charges, and the City is
waiv in g these charges . A dr aft of an agreement has been submitt ed to th e City Att orn ey's

The Bo ard r ece ived a copy of Mr. Bac k's repl y, which noted th at rate increases have been
necessary to fund major co nstru cti on projec ts at th e Littlet on /Eng lewood Was tewater
Treatment Plant and th e mandated proce sses th at were added to comp ly with th e Fed era l
Clea n Water Act. Th e reply also di sc uss ed the ra te in creases that we re approved by the
Englewood Wat er and Sewe r Board , the Englewood Cit y Co un cil and th e
Litt leton/Engle woo d Wastewa ter Trea tm ent Plant Board of Directors.
