WHEREAS, th e Co lorado Co nstituti on has be an ame nded relati ve to possessio n of marijuana/drug para ph ernal ia which legalizes medica l use of marijuana an d para ph ernalia fo r persons sufferin g from debilit atin g medica l cond it ions ; and WHEREAS , the pa ss age of this Ordinance will amend th e Englewood Muni cipal Code to ali gn it with the Co lorado Co nstituti on relative to possession of marijuana/dru g paraphernalia fo r medical use ; NOW , THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ENGLEWOOD, COLO RADO, AS FOLLOWS : • Section I . The City Co uncil of the City of Eng lewood , Co lorado hereby authorized • amending Title 7, Chapter 6D, Section 1:, of the Eng lewood Muni ci pal Code 2000 , entitied "Possess ion of Marijuana Prohibited " to read as follows : 7-60-12 : Possession of MffffHHHHI ~ Prohibited. A. Defini tions . Co 11 s11mptio11 or Use of~~: Shall be deemed possession thereof. Marihuana or Marijuana : .A.JI parts of the plant cannabis sativa L., whether growing or not, the seeds th creof1 the resin extra cted from any part of the plant, and every compound , manufacture, salt , derivative, mixture , or preparation of the plant, it s seeds , or its res in . It does not include fiber produ ced from the sta lks, o;I or cake made fr om th e seeds of the plant , or sterilized seed of the pl ant which is incapab le of 5orrni nati on , if these items ex ist apart from any otl1er item defined as"~ ~11 herein."~~" does not include~ Wi!Wl!.i1Wl co ncentrate as defined above . ~ ~ Co11centra1e: Has hi sh, tctrahydrocannabinols , or any alka loid , sa lt , derivative, preparatio n, compou nd or mixture , whethe r natu ral or synthesized, of tctrahydrocannabinols. However, in impos ing psni shm ent or minors for violati on of thi s Sec ti on , the Coun is limited to the restriction s of subsec ti on 1-.-1 B "f this Code . 7-6D-12-I : Dru g Paraphernalia. A. Definiti ons . As used in this Section, unl ess th e con text otherwise requires : I. Drug paraphernalia mean s all equipm en'., prod ucts, and materia ls of any kind wh ich are used, intended for use, or des igned for use in planting, propaga ting, cultivating, growi ng, harvesting, manufacturing, compounding, cm ·,erting, produci ng, process ing , preparin g, testing, analyzing , packaging, repa ckagin g, storing, containing, concea lin g, injecting , ingesting, inhaling, or otherwise introdu cing into the human body a controlled substance in violation of 'he laws of this State . Drug para phernalia in clud es, but is not limited to : a. Testing equipment used , intended for use, or designed for use in identifying or in analyzi ng the strength , effect iveness, or purity of controlled sub stan ces under circumstances in violati on of the laws of this State; b. Scales and ba lances used, intended for use, or designed for use in weighing or measuring controlled substances; c. Separation gins an d sifters used, intended for use, or designed for use in removing twigs and seed s from or in otherwise cleaning or refinin g marijuana ; • d. Bl end ers, bowls, co nt ai ners , spoons, and mixing devi ces used , intended for use , or des igned for use in compounding controlled sub sta nces ; e. Cap..-.ul c.c:, balloons , enve lopes, and other contai ners used, intended fo r use, or designed for use in packagi ng sma ll quantities of controlled substances; f. Containers and other objec ts used , intended for use , or designed for use in storing or co ncCt1.ling contro ll ed substa nces; or g. Obj ects used , intended for use , or designed for use in ingesting, inhaling, or otherwi se introducing marijuana, cocaine, hashi sh, or hashish oil into the human body , such as: (!) Me~1 !, wooden, acrylic, glass , sto ne, pl astic , or ceramic pipes with or without screen s, permanent scree ns, ha shish heads , or punctured metal bowl s; (2) Water pipes; (3) Ca rburction tub es and devi ces; (4) Smoking >.,Jd carburetion masks; 2 • • • • (5) Roach cli ps, mea nin g objects used to hold burni ng materia l, such as a marijuan a cigare tt e th at ha s beco me too small or too short to be held in the hand; (6) Miniatur e cocaine spoons nnd cocaine vial s; (7) Chamber pip es ; (8) Carburetor pipes ; (9) El ec tri c pipes; (JO) Air-driven pi pes; (I I) Chillums; (12) Bongs ; or (13) Ice pipes or chill ers . 8 . Det ermina tion ; Cons iderations . I. In detennining whether an object is drug paraphernalia, a court, in its discretion, may consider, in addition to all other relevant factors , th e following: a. Statements by an owner or by anyone in control of the object co nce rning its use ; b. The proximity of the object to controlled sub stances; c. The exi stence of any residu e of controlled substances on the obj ect ; d. Direct or circumstantial evidence of th e knowledge of an owner, or of anyone in co ntrol of the object, or evi dence that such person reasonably should know, tha t it wi ll be delivered to persons who he/s he kn ows or reasonably shou ld know , cou ld use the object to faci litate a violation of thi s Section; e. f. g. h. i. j . k. lnstru cti ons, oral or written , provided with the object concemi,~~ its use; Desc ripti ve materials accompanying th e object whi ch exp lain or depi ct it s use; National or loca l advertising concerning it s use ; ll1e mann er in whi ch the objec t is displa yed for sale ; Whether the owocr, or anyone in control of the object , is a suppli er of like or related items to th e community for legal purposes, such as an auth orized di stributor or deal er of tobacco product s; The exi stence an d sco pe oflegnl uses for the object in th e communit y; Expert testimony con ce rnin g it s use . Advertisement of Drug Parnp hcmalia ; Penalty. An y person who pla ces an advertise men t in any newspaper, magazine, handbill , or other publication and who intends thereby tr pro mote th e sa le in thi s Cit y of equ ipment, products, or materi als designed and intended for use as drug paraphernalia co mmit s a vio lation of this Code, ~~dance wit ll..Sc,.J jpg 14 of Art icle xvm of the Colorado Constitution- F. Defenses . The common la w defense known as th e procurin e ag,:mt defen se is not a defen se to any crime in this Section . Section 2. Safety Clauses. The City Counci l hereby find s, detennincs, and declares that th is Ordin ance is promulgated under the ge nera l po li ce power of the City ofEnglewood, that it is • promulgated for th e health, safety, and welfare of th e pub lic , and that thi s Ordinance is necessary • for the preservation of hea llh and sa fet y and fo r the protecti on of publi c co nvenience and welfare . The City Co uncil further dctcnnines thnt the Ordinance bcnrs a rational relation to the pro per legis lati ve objec t so ught to be ob tain ed . Secti on 3. Sevcrnbility . If any clau se, se nt ence, paragraph , or part of thi s Ordina nce or th e ap pli cati on thereof to an y person or circu mstan ces shall for any reaso n be adjudged by a co urt of competent j uri sdi cti on invalid , s uch judgment shall not a nCct, impair or invalidute th e rem ain der of this Ordinance or it application to oth er persons or circum stan ces. Section 4. Inco nsistent Ordinances. All ot her Ordinances or portions th ereof in cons istent or conflicting with this Ordinance or any po11ion hereof are hereb y repea led to the ex tent of such inconsistency or con flict . Section 5. Effec t of repea l or modification . The repeal or mod ificat ion of any provi sion of the Code of the Cit y of Englewood by thi s Ordin ance shall not relea se, extinguish, alter, modify, or chan ge in whole or in part any penalty, forfeiture , or liabilit y, either civ il or crim inal , whi ch shall have been i11currcd under such provision, and each provi sion shall be treated and he ld as still remaining in force for th e purpos~ of s ustaining any and all proper ac ti ons , suits , proceedings, and prosecution s for the enforcement of th e pena lty, forfeitur e, or li ability , as well as fo r the purpose of sustaining any judgment, decree, or order which can or may be rendered, entered, or mad e in such ac ti ons, suits, proceedings, or prosecutions. Section 6. Pena lty. RECOMMENDED ACTION Th e Police D epa rtment is recommendin g th at City Council adopt a Bill for an Ordinance amending Title 7, Chapter 6 D, Section 12, of th e Engl ewood Municipal Code 2000. It is recommended th at 7- 6D-12(B) entitled Poss essio n of Marijuana Prohibited, be amended to read, "It is unlawful for an y p erson to possess one o un ce o r less of marijuana, except in accordan ce with Sec ti o n 14 of Articl e XV III of the Colorado Consti tuti on. Seco ndly, th e Police Department recommends that Titl e 7-6 D-1 2-1 (C), Drug Paraph ernali a be amended to read , "Po ssess ion of Dru g Paraphernalia. A person commits possessi o n o f drug paraphernalia if he/she poss esses dru g paraphernali a and knows or reasonabl y should know that the drug paraphernalia could be used under circumstan ces in v io lation of thi s Co de, except in accordan ce with Secti o n 14 o f Article XV III of th e Colorado Constitution."
