I spoke to yo u earlier about ha vi ng a wall for Nancy Peterson and the community's awards that were go ing to be tossed . This is a petition and we have 57 people that have ci gned it, who would lik e a wa ll , not a cab inet. .. not just one little th ing in the cab in et , but we want a wall with all cf the awards on it, please . It is as much for Nancy as it is for the community because the community helped her to get it in the first place . I don 't think you 'll ever gel find ~nyone that can get the community behind the m like she did. We 'd appreciate having it for her sake as well as the community 's. I appreciate your concern . Ordinances , Resolution and Motions • (a) Ap prova l of Ord inan ces on Fir st Reading • • • Englewood City Council March 23, 2009 Page 3 (i) Hou sing Finance Specialisl Grimmelt presenled a recommendalion from lhe Co mmun ily De velopm en t Department 10 adopt a bill for an ord inan ce authorizin g the redemplloa and subsequent sale of 290 Ea st Bellewood lrive, acq uired through the foreclosure process as defin ed by Colorado Stale Slalules. She sa id th is partic ula r , operty was redeemed by lhe Hous ing Rehab Program , Fund 46, on the 1 a" of February , proceeding our normal rules and pol icies Iha! we t,ave through the rehab program . II was reviewed by the loan committee and reco mmended for redemptio n last September . II went lo public sal e th is February 2009 and we had lo fil o our inlent lo redeem within eight days of that date , which we did do . Fu nds we re transferred on February 18". We now have title to the property so this is alwa ys don e a little bit backwards . We're now ask ing Counc il lo approve lh is redemption , that has alread y taken place , and lo autho rize the sale of th is property . The property will be 13nled , I bel ieve , until the settlement of a lawsuit that is also invo lved in th is part icular property . But as soon as that is ·e solved , then we wi ll proceed wit h hav ing that property sold . Funds would th en be returned back to the Hous ing Rehab Program , Fund 46 . Are there an y questions? Mayor Woodward asked do we have any idea of approx imate value of this partic ular property . Ms . Grimmett re pl ied that the county assessor has it listed , I think , at a little over $200 ,000 , around $205 ,000 , I believe that in the market today that is still fa irly accurate . II was substantially rehabbed and it is listed as a three bedroom , two bath , and finished basement so it does have some nicer amenities than some of the other homes in this are a. It sit s in a nice r neighborhood . I thin k that would be accurate . Mayo r Woodward asked if there we re any other questions . There were none . This topic was di scuss ed al the March 2, 2009 Sti:ay Sess ion . Basically what was presented was the Foundation bel ieved that its bud get was correct when we tr,nsferred money from lhe sale of lh e RTD property . Whal happened was Iha! Englewood City Council March 23 , 2009 Page4 we had some soft costs wh ich included legal costs and othe r costs that were substantially higher than expectert . We had expected lease proceeds from leases that we were working on and also we had a cash ... this is really partially a cash flow iss ue as well . We expe ct to have some funds repa id from RTD for work we are doing for them th is year. A part ial payment , $600 ,000 .00 . by the end of the year will be made back to the General Fund Long Term Asset Reserve . So we are as ki ng for $800 .000 .00 . A portion of that will be used for operations . a ,epayment th is year of $600 ,000 .00 . and in 2011 , another $100 ,000 .00 . But if the property is leased and we do start having lease payments . those lease payments will be returned to the L TAR as well . RESOLUTION NO . 33 , SERIES OF 2009 A RESOLUTION TRANSFERRING FUNDS FROM THE GENERAL FUND 'S LONG TERM ASSET RESERVE (LTAR ) TO THE ENGLEWOOD MCLELLAN RESERVOIR FOUNDATION (EMRF ). (ii) Hous ing Finance Specialist Grimmett pres ented a recommendation from the Community Develo~ •nl Department to approve a resolution authorizing staff to apply to the Colorado Divisi on of Housing for a port io,, ~f the Arapahoe County 's allocation of Federal Ne ig hborhood Stabil izat io n Program funds . She said I'm here to request approval to apply for approx imately one million dollars to the State of Colorado for part of Arapahoe County 's portion of the Ne ighborhood Stabilization Program funds . These program funds were initially approved by Congress last July 2008 . Each state was approp riated mon ies and certain cities and the State of Colorado has rece ived a little over 34 mill ion dollars to be distribu ted . The State went through a rather elabo rate process to determine the highest areas in the entire state that were suffer ing , from the lack of anyth ing else , the effects of the high foreclos ures rates ir, the area . Those areas then were ide nt ified and the State th en awarded monies down to various additional commun ities : Arapahoe County be ing one . Arapahoe County has chosen not to adm inister the ir own funds but Ins tead has taken the pos ition that they will just support certain app lications and that those applications th en would be handled directly with the State . So we are here th is even ing ... we are requesting permiss ion to appl y for those funds . Staff did file an inte nt last November telling the State that we intended to app ly . So we are here th is even ing to formally put that into play . The application , as I stated , will be for approxi mate ly one million dollars . It will initiall y allow us to purchase approximately four pro perties and use that money th en to acquire those properties , rehab th ose propert ies . do an y marketing as necessary and it also covers some staff time . Those funds will then be recy ~led back . The goal is that we hopefully will do at least a minimum of ten . Hopefully, more than that given the ti meframes that we have to re cycle the funds . These properties mus t be purchas ed from lende rs only . The y must be vacant. They then can be acquired just with in an eighteen month timeframe . So tha t's what staff is hop ing to be able to do . Our application is in the cycle that has been set up and du e to the State approx imately April 1 •. We are hoping then tha ;1 will be ta ken to the State Hous ing Board for review during the month of Ma y • • and if approved at that level . then we 'll be back to Council , probably ie June , for the formal approval of the • ordinance approv ing an intergove rnmenta l agreement with the Sta te of Colorado . She asked if there were any questio ns. • • • Engle•:~od City Council March 23 , 2009 Page 5 Council Member Wilsen sa id yes , I have a cou~·le . Is th is affordable hous ing or low inco me or ne ither ? Ms . Grimmett repl ied it actually has its own spec i~I income limits . They are still co nsider ing it .;ifordable but the income lim its are sel higher lhan any other pre Jram that I have worked with . They 're considered set at 120% of the area med ian income . For a family of four , that roughly means that their income can be at $91 ,000 .00 or lower and st ill be able to purchase the home as an eligible buye r. We are asked to try , if at all possible , to des ignale some part icipat ion with famil ies that are at 50 % of lhe area med ian income , wh ich is generall y the population that works with the housing authorities . We are go ing to make an attempt to have them be pr iority appl icants for any homes that we have ava il abl~ to purchase . Some famil ies are going currently through their fam ily self-sufficiency program and the ir manager , Marlene Mossman , has been very successful at being able to get some of the famil ies into ho , ,e ownership . So we are going to attempt to allow them the first opportun ity to be able do that. But if they cannot qualify , th ,n we will open it up to any family that meets that In come li mit that has been set , at the higher level. Council Member Wilson said now if they buy the house , say they want to move . Is there profit set at a certain amount or can they ask anyth ing for the house or how does that work ? Ms . Grimmett repl ied the program regulations have been changed . Initially when the regulation was put out , there was no profit that the buyer could realize . We cannot sell it at a profit either . We can sell only for the cost of the acquis ition and the rehabilitation . That has since been changed . In some of the new legi slat ion , in the Recovery Act , it's been modified because frankly it was really becoming a burden to be able to say that a buyer could not realize any ga in in the potent ial market. So that has been changed . At this particu;ar time, unless there is some other down payment assistance with it , it will just be required to be owner occupied but there would not be any requirements for le ngth of residency or length of ownersh ip. They would then be able to sell it just like they would any ott,er home , at whatever the go ing market rate would be , at the time . Council Member Wilson said okay . Which will then turn it possibly into to the $91 ,000.00 bracket ? Ms . Grimmett repl ie d the $91 ,000 .00 bracket is the annual income for a family of four , the maximum they can earn to be a poss ible purchaser. Council Member Wilson said but it probably would not turn back into a less affordable housing for a fam ily who is making 50 %. Ms . Gri mmett said probably not. I would guess that the market is go ing to dictate the sale of the prices of the homes . Right at the moment , they are still fairly level in the areas that we will probably be purchasing , wh,ch we will be able to purchase In most residential areas in the City . I think ten of the thirteen census tracts scored high enough by their foreclosure risk rating that the State had put together that we can purchase from . There are only a couple of them that are no t eligible . And those neighborhoods have bee n fairly stable with costs . I antic ipate that we are gJing to be selling probably around the $180 ,000 to $185 ,000 range , if I had to guess . That all depends upon what the cost is from acqu isition as well as the cost of rehab . Bu t tha t's probably a fairly soli d figure in most ;;f the res ident ial ne ighborlhoods throughout the Ci ty . In the past , purchasers that have been in these types ,,f programs have been long term homeowners . They have not turned the property over . But we are not anticipating , at this time , to having an y additional restrictions . There is the possibility that if we were to help them with down payment assistance , then there may be some requirement that Is attached to that . That might require a min imum of five years or tens years occupancy but at the moment , if it's a straig ht purch ase , there is not go ing to be any requ iremen t along those line s. Council Membe r Wilson said okay , thank you . Council Member Penn said ,f they meet th e requ irements for the federal $8 ,000 .00 grant , would they still be able lo get that as a payba ck for tax incentive ? Ms . Grimmett inqu ired for the tax credit yo u're referencing ? Coun cil Member Penn said yes . Ms . Grimmett replied I bel ie ve so if the y are a first time home buyer and can qual ify under those separate regula tions , yes . They would still be eligible . Council Member Penn said and the y will be notified about that also ? Would we get the m information abou t that so that they are aware of that? Ms. Grimmett salo I think that part of the requ irement is that we have to provide eight hours of home buyer counselin~ and I believe that is disc ussed during those home buyer counseling sess ions : that the tax credit Is available and how they would go abou t applying for that , yes . Council Member Penn said than k yo u . Mayor Woodward sa id Janet, just to be clear. Th is is not part of the stimulus plan . Ms. Grimmett said correct. Th is is not. Mayor Woodward said th is Is ent irely a different program . Ms. Grimmett replied yes . Ma yor Woodward sa id and initially we were , I be lieve , talk ing the possibility of up to three million dollars. Ms . Grimmett said when I had filed our letter of in tent la st October that is what our letter stated , that we had inten ded to reques t, that amou nt. Unfortuna tely, there's not thal much available . Ma yor Woodw ard said yeah , I see lhat all Englewood City Council March 2S , 2009 Page 6 of Arapahoe County only has 2.1 million . Ms . Grimmett sa id so we 're applying for the one million that we can get. It's not to sa y that we may not be able to get more in the recovery afterwards ; the additional funds that were approved for the Neighborho od Stabilization Program . My understanding is that the State is looking at doing kind of a partnersh ip application . That process , for those addit io nal funds , will be handled more on a nationa l competitive basis so we may be applying for a second round to that process . But it is too soon to know how that is go ing to develop . Mayor Woodward said we heard this from the Secretary from HUD last wee k, a number of us at the National League of Citi es , and he was certainly encourag ing us to be applying for the ne ighborhood stimulus grants as well as Representative DeGette , while she was here and in Wash ington so th is is a nice start . RESOLUTION NO . 34 , SERIES OF 2009 RESOLUTION AUTHORIZING THE CITY OF ENGLEWOOD , COLORADO , TO FILE AN APPLICATION WITH THE COLORADO DIVISION OF HOUSING FOR A PORTION OF THE ARAPAHOE COUNTY 'S ALLOCATION OF FEDERAL NEIGHBORHOOD STABILIZATION PROGRAM FUNDS . Mccaslin, Moore , Woodward , Jefferson , Wilson , Oakley None (iii) Director Eaton presented a recommendation from the Human Resources Department to appoint , by motion , a hearing officer for a disciplinary appeal filed by Police Officer Jason Pearson . She said Council has prev iously appointed three hearing officers to a panel . wh ich we are requ ired to do on an annual basis . The ir resumes are attached to the back of the packet that I provided you with . The cho ices are Ronald Cohen , John DiFalco and Bennett Aisenberg . Mayor Woodward said we 've used Mr. Cohen in the past on some of these , as I recall . Ms . Eaton replied yes we have . Mayor Woodward sa id is there were any recommenda tio ns as to who to use here . of the three . I would recommend Mr . Cohen if there aren 't any other re commendat ions . Co un cil Membe r Mccaslin asked ha ve we used any of the others before . Ms . Eaton replied I be lieve that we have used John DiF3lco in the past. City Attorney Brotzman sa id we have actually used all three at one time or another . Council Member Mcca slin sa id so all three of them have been used . Mayor Woodward said just for clarification , you are looking for us to select one of these and ... City Attorney Brotzman said correct. The process that we have agreed to with the un ion is we 've selected three and we can 't give you a recomm endat io n out of th e three . Council actual ly has to pick one . General Discussion (a ) Mayor's Choice (i ) Mayor Woodward sa id first I want to address Ms Cumm ins , bring ing in the petition and her suggestion of displaying the awards received by Nancy Peterson and the commun ity for the Neighborhood Watch . I'm glad to see you put in ·and the commun ity " because we as citizens and as block capta ins and as old people that live in lhe ne ighborhoods , who had participated , you and I both . I had met with Nancy a week ago last Friday. She had another ... she had found another one of these awards. And it was , In my m ind , probably the most impress ive award there was . I brought it here tonight. And as I mentioned to Gary last week , It was naming Englewood the Capital for a Day. I believe it was back in 1997. I don't remember exactly which year but it was in Decembe, of that year. Gary and I have been discussing about where some or these th ings could go. For example, Iha: one , which is very nicely framed , with the State seal on it and Roy Romer's signature. we 're looking at and have been discussing , above th e trophy case, the case out front, there is the area that shapes that. where there may the possibility of placing the awards that have been received . I just wanted to mention tha t. The rest of Council certainly hasn 't heard about that... Gary and I have been talking about It. Council Me m be r Mccasl in sa id do you want us to wait to comm ent oo :hat? Do you want us to wa it until our turn to comment on this or is it open fo r discuss ion now? Mayor WoJdward sa id if you wan t to comment on it now or comment on it at an other time , that's fine . Council Membe r Mccaslin said I'll wait . Mayor Woodward sa id okay. Ma yo r Woodwa rd said so the tim ing is ki nd of inte resting since that was something that I brought in tonight. (ii) Ma yor Woodward sai d next I wanl to acknowledg e Kraig Stovall . In the last few wee ks since our Sl udy Session, I know that a number of contribution s have come in for the 4" of July celebration. Arapa hoe Co unty , Cenlenn ial, an d Sh eridan all have come forwa rd as they had last yea r so th e program looks like It is moving forward. I'm sure Kra ig is try ing to tak e a ba ck sea t but I 'm sure he's right in the middle of it. (iii) Ma yor Woodward sa id I also wanted to mention that the National League of Citie s trip , I bel ieve, for the Co uncil Members and the students was ve ry beneficia l and a real opportunity to hear from othe r citi es, to do some or the wo rk shops, and learn about , certa inly , some of th e th ings that are coming avai lable as far as st imulus and stimulus package and th ings that are available fo r the City of Englewood . I personally sp ent more lime in classes and lhat sort of th ing than I had before . I was pretty exhausled when we got back . But I lh ink that was a total success for the studenls and I think they really are able to bring something ba ck to the high school. Th ey were very up-front with o ur legislators in lalki ng to other Natio na l people and the othe r youth group s tha t were there fro m other ci tie s (iv) Mayor W oodward said I would also like to make a motion that.. City Attorney Brotzman po inted out that th is is a speci al me et ing and no motion s can be made Mayo r Woodward said so rry Ra nd y Englewood City Council March 23 , 2009 Page 8 (v) Mayor Woodward said then the la st item I have Is , I JUSI wa nt to just mention , is that we ha ve lost a number of people here just through the last few weeks I want to extend my perso nal condolen ces to them . The families of Harold Rust, Rusty, who was our Citizen of the Ye ar in 2000 and was very much involved with the commun ity for a long tim e, He jus t pa ssed away a couple of weeks ago , Last week , the wife of former Mayor Eugene Otis, Ruth Otis, passed away and Is having a memorial service tomorrow. And then my personal cor.dolence to Wayne , who lost his siste r last week , la st T hursday (b) Council Members' Choice (i) Council Member Penn : 1. He said thank you Mayor. Just a couple of notes . We do have W omen In Business and it will be downstairs in the library tomorrow morn ing at 7:30 a.m . fo r all of you people Men are in vited also There is a good speaker, Gina Greenwood , will be here from Veclra Ban k 2. He sa id Washington D.C. was an excellent tr ip aga in, I too k more classes , like Jim , than I had in the past. I would like to , and maybe none of the other members would hke th is , I would hke to have a time in a Stud y Sessio n where each board member or each Council Member bring two or three Item s that they would like to share , possibly move on to the departments and not just let th is sit In our brain Let's show and talk about it. Hopefully we can do th is. The National League of Cities was an excellent time to get out and get that done, 3, He said in the information packet, there is a th ing from the Greater Englewood Chamber of Commerce, kind of laying out the expenses. I know that the City has been really hel pfu l and we are going to cut back at least by 10%. And then if we don't request money from Community Development and ACE , we cut bac k • even S2600 .00 more. We are trying to do our part at the Chamber, try ing to do that an d th at's why you have • that letter. Hopefully that will explain some of the th ings that we are doing 4, He said if you have a chance, get down to th e Women in Bu si ness and listen lo th e speaker. It will be the fi rst time in two ye ars !hat we ha ve had that. Mayo r Woodward said than k you . (ii ) Council Member Mccaslin : 1. He sa id a couple of things . First of all , I th ink th is d isplay for Nancy Peterson Is a w onderlul token ol app reciation for what she has done. I hope we don't 1ust limit it to a wall. I hope that th ere a re other avenues or othe r things we can do to d isplay th is stuff, Creative ways that we can .. , so the sa me th ing like wh•t you want to do with a wall only not limit it to a wall ... a case or something . I want to kin d of leave th at open I know th at I saw in the petition that it was a cabinet and then inserted a wall. I ag ree with everything that ha s been said ton ight. We need to do it right , whatever ii takes . 2. He said the Nat io na l League of Cities conference , it had a little different atmosphere th is year hav ing to do with administration . Of course , the key word Is stimulus or recovery package , whatever you want. Any seminar that I went to started off on the topic that it was generally suppose to start off on but somehow ii always got around to what was going to be happen ing with the stimulus money an d what we could do . So I think the Ideas that we all brought back from that , when we talk about them, will bri ng some stuff out. (iv) Council Member Wil son said I just appreciate when the com munity comes forward and tal ks about something that they feel passio nate about. Thank you for com ing . (v) Council Member Jefferson : 1. He said I will just agree with everyone that the NLC trip was a success , with lots of great Information there . 2. He said I too would like to see something done for Nancy . I've never really seen the community come forth in th is kind of a way for some sort of community pride about what's been going on here . I agree . We should definitely get someth ing together. 13. City Manager's Report (a) City Manager Sears sa id I have several topics that we need to tal k about al Study Session . did want to say one thing . Lance Smith will be here at the next meeting , in two weeks . We really have got some great news that we rece ived . We had the Insurance Services Organ ization (ISO) review of our Bu ild ing Department and we 've had a seven rating for quite a while , over the last 7-8 years or as long as I can remember. Because of the work In ou: Bui lrll ng Department , our Code adoption , the whole review of our Bu il ding Departmen t, went up to a three . n,,, ISO has a one to ten rating , kind of grouped into : one to three , then three to six , and seven to ten . But th is is a full report ... Lance has a full summary that we will put in the packet. They did a very detailed review of plans , enforcement of plans review , all of our Codes , how we enforce th ose , cus tomer relations response . II is a very impressive report . It shows aga in our Bu ilding Departmen t is rig ht 10 the front and as a result of the redu ction from an Insurance viewpoi nt , ii means that th e homeowner s, from an In surance viewpo int , could have a redu cti on in the com merci al amount in the ir fees that the y may pay for the ir insurance . It really is a great reflection ... I sent Lan ce home because of the hour but he 'll be back here in a couple of weeks with a full report . Council Member Jefferso n said I have one more comment on the NLC . He asked Council Member Mccaslin if he wanted to comment. Counc il Member Mccaslin sa id go ahead . Council Member Jefferson sa id I was ju st go in g to second what Rand y sa id as well about sharing Info rmation becau~e tha t is what we kind of lacked last year that will really get that valu e out of there . Council Member Jefferson said also , I guess , go ing forward I th ink we talked about poss ibly try ing to redu ce the expense s. It seems that there are lots of ways to do that. There are ways lhal we can do il .. whether il is on a rotational basis or just trying to get each of us lo lower our expenses on t,,ese types of trips .
