Recognition of Scheduled Pu blic Comment (a) Matthew Crabtree , an Englewood res ident, sa id for the benefit of the record, I'm part of a commun ity group in the City of Englew:iod by the name of Englewood Citizens fo,· Open Government. I'm go ing to start my presentation off this evening with a, should I say , a bold quest ion and , ! important question . Where is and what happened to the representative government in the City of Englewoo • I What I mean by that is that each and every one of the repres entatives up here at this time were elected to re •::,msent the views , concerns and ou tlook of the people of th is community . It seems that lime and time again , ..:ouncil dec ides to make decisions on their own , accord ing to their own agenda , own opinions and own ideas, disregard ing the views of the people . There was a situ;,tion that occurred over the last few City Council meetings that does just prove that. Aga in for the benefit of the record , I'll explain a little history on this situation . February 17'", Nancy Peterson came before Cou ncil with a box of plaques that were going to get thrown away . These plaques were for the Natio nal Night Out and Neighborhood Watch Program, pla ques that the City of Englewood residents worked very hard , along with Nancy Peterson , to earn these awards . She asked , basically , that if the City was actually go ing to throw the se plaques away ... but she not be told about it. On March 23", a member of our community dedicated and passionate about this issue , came before you with a petition ... a petition of 57 signatures . A petition asking Council , please don't throw any of these awards away and plea se display all of them for the benefit of the people of this community . The p~tition request was pretty specific ... it was to display them here prett y much in the CltyCenter was the primary request. City Council actually had a pretty overwhelming response to it. There were, you know, many of you commented on the record that evening , that you w•re happy to see the request and were happy to look into It. But you failed the motion that night. You had to go Iv Study Sess ion to discuss this topic. Now , it Is a little perplexing , because most of the time these issues that are brought forward with a problem, the issue and the solution all in one issue , you were normally very happy to hear it. But th is particular issue , for some reason, had to go to Study Session . You spent nearly 20 minutes discussing it, at the Study Session. And that is really where things started to go wrong . You started critiquing the fact that first these awards were meant to be in the department that they were earned at... Safety Services Department or the Police Department. .. that that was actually where the awards were provided to and that is the department that won the awards . Then you started critiquing each plaque as to the quality of the frame or if it was cracked or chipped or scratched ... lo sing sight of what these awards really mean to the commun ity and losing sight of the fact that no , the Safety Services Department didn 't win these awards alone . Yeah, Nancy l'eterson did a lot for this program and ll'as ~robably one of the ma in reasons that the plaques were received , but the ~ommunity , the community" . •~d very hard to receive these plaques. If ii weren 't for the community , we wouldn't have received the m. So , the decis ion was made to not display all of the plaques as go ing aga inst th e vo ice of one member of this community . The decision was made not to display them in the CityCenter ... again going against the voice of a member of th is community . You decided to display them al the Police Department , a place that not many people of this commun ity go to . I know , myself , I ha ve only been the re twice ... one time was to look at the plaques and the other lime was to file a poli ce report . And I have livsd here , for what , six years now . It is not a very public place . A9ain , I think we lost sight of what these plaq ue s really truly mean . So , you only displayed four of them and there are well over ten plaques . One of the plaques was actually pro vided by the Governor of the State of Colorado in 1995 for the most Nat ional Night Out programs . That is not even displayed . Now , I believe it was April 20'", that same ded icated me mber of this commun ity , that was so rassionate about th is issue , ca me before you and was frustrated ... was genu inely upset and I could totally understand wh y ... because her vo ice was n't her. Things were sa id, but the pmbl em I see is the way the situation was handled. Spec ifically , on e of the co mme nt s made by our Mayor , Mr. Woodward . You had stated quote , unquote , and th is is verbatim from th e record "ii is the dec ision of seven of this Board here to decide where the display will be .· Aga in, "it is the decision of the Board of seven people here to dec id~ where the display will go.· He said what about the 57 people that signed that petition? What about the voice of the people ? Aga in, where Is the representative government In the City? Shouldn 't you be listening to us , and for such a miniscule , or what would appear at th is point , to be a min iscule issue . I'll get into where this leads to a much larger issue in a minute here . But su ch a simple solu ti on ... just display them above the display case in the City of Englewood , so that the people that pass by here ... probably well over hundreds of people that pass through here ... can look at those awards and look at someth ing to work towards aga in. Becau se, may I rem ind • • • Englewood City Council May 4, 2009 Paga 3 • you that we haven't won an awa rd since 2006 ... sin ce Nancy Peterson left . So , what has happened to the progra m? And th en you are hid ing the plaques somewhe re that they won 't be seen? Come on guys , th is is upsetting . To not go into any more detail , I guess , of the 20~ meetin g, I am go ing to the second part of my presentation here ... how this lends to a much bigg er issue . The National Night Out program , part of the Neighborhood Watch Program, is a huge program . And it really works , that's the great th ing about it. Yet for some reason and some way this program has virtua lly disappeared over the last three years . Now , I did hear at a couple Coun ci l meet ing where there were meeting s In the community and what not but , you know, I talked lo my ne ighborhood block captain on my block and sa id, well how are things go in g. They said , oh , we haven 't rece iv ed any communicatio ns from the City in three ye ars . The block partie s that we had the last three years were on our ow n accord . That's concerning . That ,s Interesting , that a program so Important to the community , so important to bring this community together, is disappearing , it 's dis!,olvi ng before our eyes . Now j ust to make sure , I requested ... an information request to the Safety Services Departm~n t... requesting each and every one of the blnck captains , a list of each and every one of th e block capta ins in the City . I rece iv ed 4 pages . I don 't think this is complete . There are many, many more bloc ks in this City than there are names li sted here . None of them include addresses , so I wasn 't able to really confirm any of t~ese . But, th is is it? Four pages? What 's happened to th is program? You know, I look at what's happening with Council . They are so interested in enforc ing codes . So Interested in passing new laws that tell people how tney can park on their property or what they can and can 't 1, •• , on their own property . Ye t a program that really did a good job bri nging th is community together Is being ov enc.oked . I think there is a mismatch in priorities here , guys . So , you know, I'll actually confess to one thin g with the Neighborhood Watch program . Shortly after I moved to this City and shortly after actually , the very firs ! block party I went to ... Ne ighborhood Watch Block Party ... there was a ... how can I say this ... a disaster at rr.y house . There was an emergency that happened at my house . Thankfully I wasn 't there when this happened , becaus e I lik ely wouldn't be standing here right now. But regardless , when th is occurred my block knew exactiy 'Nhat to do. They knew to call the pol ice . They knew who I was . They knew my full name . They knew my phone numbers . They knew how to contact me and they knew what to do . And I • contribute that to two things, first of all I have the greatest group of neighbors that anybody cou ld ever ask for on that block . But , second of all , I contribute that to the success of the Neighborhood Watch program . And aga in, where is it? What happened to it? Why isn 't it a priority? So, I conclude th is evening , by saying , guys it is time to step up to the plate . let's fix this program . Let's find out why there are only four pages of block captains here and why my bloc k captain and many other bloc k capta ins in the City haven't received anything from the City in years . And second of all , come on , th is Is an easy Issue with the plaques . You 've got lhe voice of 57 people !hat wan! lo see those plaques ... all of them on disp lay. It doesn 't matter wh at th ey look like . They wanted to see every single one of !hose pla ques and they should be displayed here where the community , the people that worked so hard to win those awards , can see them and have someth ing to work towards and look forward to in the future ... maybe ·Nill get the award in 2010 . There is a pretty good chance that unless mirac les happen here in 2009 , we are probab ly not go ing to gel one this year either. But , maybe we 've got something to work towards in 2010 now. Recc,gnltlon of Unscheduled Public Comment (al Jerry Furman , an Engl ewood resident , said I want to tell you guys that on May 9, 2009 , at Englewood High School , th ere is a Spe ci al Olympics meet and I really would like to see some people come and watch the athletes compete . And that's it. Co l cil Member Penn sa id Jerry , what time ? Mr . Furman sa id at 9 o'clock in the morning . Mayor Woodward sa id thank you Jerry. (b) Rick Gillit, an Englewood res ide nt , said I ap preciate Council tak in g the time to hear us again . One of the items 11,ave, jus t as a ci tizen , 1s I understand my Council , since I've been pay ing attention . You know how it is , once you pa y attention then things kind of come to light. If you 're not paying attention , you don 't • know what ha ppens , you do•i't know wha t to th ink . Our Council has gone to Washington , D.C. fo r the past couple of years that I kno , o f. I don 't know how long it has been going on , bu t I guess it has been go ing on for awhile . And, I was just wonde n,,g, because I know I haven 't heard anyth ing from the last year, formally , othe r than we know we heard from some of the kids wh o we nt last ye ar. But I know we haven 't he ard an yt hing Englewood City Council May 4, 2009 Page 4 formally from th is Counc il announc ing ... here 's what we learned , here's what we spent ... well over $20 ,000 .00 of the City 's money for , here 's a benefit that I think our citize ns are going to get out of th is. As a resident In the City , I know that our City is go ing through some hard times , I sat through some of the budget meetings last week and I know the se are tough times . Obviously . there had to be real , real importart reasons for this Counc il to dec ide to spend the City 's money to go to Washington , D.C. I don 't know what that reason Is . You know , rumor is tl1at you guys had a great vacation . I'm sure you did some business , but wouldn 't it be nice for you to announce ... on thi s night we are going to give a synopsis of what happened in Wash ington , D.C .. why it was so important for the City , why it was so Important for my Council member to go , Why it was so important tor the Mayor , who also went. It would just look really nice that the City not say ... we are just going to take your money but we are go ing to give you a nice presentation on ,hat as we ll. I've been keeping track and if it happened , I apo log ize , but I just haven 't seen it happen. So , I ,vant to ask that Council kind of give us a little upd c and something formal , something nice , maybe something the citizens can take home with them , and say , you know, for the last two years it is over $40 ,000 .00 worth of City money . I'm a bus inessman , I have to give reports to people who giv e me money to do business with them . It is nice that , you know , you guys kind of work for ,,s . You represent us , you represent our desires . I just think It would be a nice thing to do . And , hopefully , you could even make an announcement that on this night , we are go ing to give an update of National League of Cities and why that is important to us . The second thing ... and I am going to make it br ief, I know my five min utes are up , or just about up . I heard a concerning statement com ing out of ou r Study Sess ion the other nigh t...or a couple of weeks ago , of one of our Council members concerned about some things on the internet. I even brought pages of internet to show. I would remind Council that this is still a free country . We still have the right to freedom of press . We still have the right to express our ideas . Them~·· ,ou hear about you on lhe outs ide , the more you should understand that you are not telling us enough . If yoo '!' •a us what we are looking for. .. just talk to us . Mr. Oakley , you are my representative ... not once have you said, Rick I would like to ta lk to you . No t saying that you have to ... but it probably would have alleviated a few things ... say you know I hear about you, you 're my constituent. .. let's talk . I have talked to a couple of the other members up here . Understand , we live in a country where we still have a right to talk . I lived in Europe under socialism ... I lived where you couldn't have the freedoms we have . I defin itely appreciate that here . And you know, I heard a statement that Thomas Jefferson said 'people who fear the government are people who live in tyranny ... but a people whose government fears them , are people in liberty '. I hope that we still have liberty in th is country . Thank you . Mayor Woodward said thank you . (c) Jenry Furma r said one more thing . I lalked to a bunch of you guys about the place , by my place , that it looks like a fen ce has been knocked down . And I showed the picture to th is officer right over here , the Ch ief of Police , who is the head of Code Enforceme nt. I to ld three people about this and nothing has happened over there and I wanted to know why . Because there have been people living over there and I am guessing they are spending the night over there ... many times and it is just getting ... if we keep doing it , the crime rate of Englewood is go iny to go up , because people are homeless , they need the money too and they find ways to steal th ings and stuff. We are losing money because vi that one little fence that has been knocked down . I have a picture on my cell phone . I will show you guys . Is it okay if I •oproach the bench? Mayor Woodward sa id yes . you may approach . He passed his cell phone around . Mayor Woodward sa id while you are doing that , I would like to ask Commander Condreay ... ev idently )'OU have talked to Mr . Furma n regarding this ? Commander Condreay sa id yes sir . Mayor Woodward said and ma ybe we can turn thi s into a Council reques t. I don 't know what this specific problem or issue is . City Manager Sears said we can follow up , you know the address and we can report back to Counc il on th is. Council Member Penn said do you hav e the address? Comments were made , but they were not aud ible . Someone said it is the Seminary . Mayor Woodwarc sa id okay Mr. Furman , we are going to have a Counc il request on that and get some feedback , so Counc il ~n ows exact!y ... everybody knows what you are discussing . Communication,, Procl1matlon1 and Appolntmanta (a) A Proclama ti on declaring Eugene Ot is as lhe 2009 Englewood Citizen of the Year was cons idered . Mayor Woodward read the proc lamation in full. COUNCIL MEMBER MOORE MOVEO, AND COUNCIL MEMBER McCASLIN SECONDED, TO DECLARE 1:UGENE OTIS AS THE 2009 ENGLEWOOD CITIZEN OF THE YEAR . Mayor Woodward asked if there were any comments . Mayor Woodward sa id I would just li ke to mention that fonner Mayor Otis has obv iou sly been in the commun ity a long time . He came on Council and was selected Mayor and served as Mayor for 8 years which , in my mind , Is qu ite a fea t. Hav ing known him ... I got to know him through Lions Club over the last few years and uti1 ;,1ng him as a mentor. .. he is someone that is truly an Eng lewood person . He is one of those rlght-down-t~arth people that understands what volunteering is ... what supporting the City and community is. My congratulations go out to Mr . Otis. None Mayor Woodward sa id I just want to mention that next Monday at the Malley Center, I believe it Is 7 o'clock , there will be a celebration for Mr. Otis , ce lebrati ng him as our Citizen of the Year 2009 . (b) A Proclamation declaring the week of May 17 through 23 , 2000 as National Public Works Week was cons idered . Mayor Woodward asked if the re we re any commen ls. Mayo r Woodward sa id lhere is just a c.Juple of thi ngs that I want to read here ... that I rea ll y wan t to acknowledge Pub lic Works , because they are the p1,ople that are out lhere that a lot of limes we all see the ir resu lts , but a lot of ti mes we don 't know who they are or what they have done . Th ey are an integral part of our citize ns every day lives . Stneets, certa inly clea ning stroets ... our Serv lC enter fi xi ng our equ ipment , mak ing su re that the equipment is worki ng , provi ding and do ing the type of work that prepares parks and other th ings , medians within the streets, tho se types of things . I also want to mention that the effectiveness of our facili ties an d th e plann ing an d lhe design and cons1ruct ;0n is likely dependent upon the efforts and skill of the Pub lic Works offic ials . We have some very excellent , very dedicated and some very long-tenn employees that come from Pub lic Works . And I th ink ij also ment ions here that cillzens of the City of Eng lewood are welcome to come and vis it local Publi c Works Departments and better famil iarize themselves with the Important safety inlom .dtion and services prov ided by these public services . I am glad lo see ev erybod y here ton ight from Pub lic Wo rks . I am sure th e people rea li ze that beh ind th e scenes these th ings are go ing on. When they get up In the morn ing after Englewood City Council May 4, 2009 Page 6 a big snow storm and the streets have been sanded and plowed , that the re are a lot of people those people and people that support those people . They are all doing their job an d they are getting paid adequate wages, but nevertheless they are ded icated to their work too. And I appreciate them. Council Member Mccaslin said well I was going to wait until the end to say th is, but I know that my wife , who is the Principal of Bishop Elementary , really wanted ... in fact she sent her thanks , over dinner tonight, over the phone to everyone , but. .. supplying the mulch for th e community garden at Bishop School and in the past you guys have been great. I mean, any time , you know ... we talked about the relationship in our community between the City and the schools , and we have never had any issues. You guys have been wonderful. I would like to extend my gratitude and my wife's gratitude for everyth ing you guys do. I mean it from the bottom of my heart because, you know, my wife's school is kind of in a ... it is not the most updated school and It is in a part of town that is kind of old . You know, we are working on it but we appreciate all the help you guys have done. I can 't tell you how much she appreciates what you guys have done . Thank you so much. Public HHrlng Items No publi c hearing was scheduled before Council. 11 . Ordlnanc&1, R&1olutlon and Motions (a) Approval of Ordinances on Firs! Reading (i) Director Fonda presented a recommendat ion from the Utili ty Dep artment to adopt a bill for an ordinance authorizing a Big Dry Creek Interceptor maintenance fee increase . He sa id a number of years ago , we had to pay for repa irs to the interceptor . We set up tap fees to finance that , with the anticipation of not on ly rebuilding the Interceptor, but also setting up permanent financing to ma intain it. Southgate District actually really up-fronted the money that we needed , wh ile the tap fe es came in . We collected the tap fees , we rebuilt a lot of the sections of the Interceptor that needed to be rebuilt. And then we had some money iefl over from the tap fees . I just want to ask ... a Council request from the City Manager's office or City Attorney's office ... as to whether that home ... this is a home that suffered a fire and Is basically condemned , as I understand it...if there is something we can do to relieve and expedite the cleanup and removal of that particular piece of property or of the th ings on that property? I think this citizen has documented very well about the concerns of what Is there. (ii) Mayor Woodward said the next item is that I want to acknowledge ... there were two, in the last couple of weeks , volunteer appreciations . One was at the Malley Senior Center and the other one at the Library, this past weekend . I want to publicly acknowledge those volunteers that reall y put in and dedicate themselves; literally, it's over a thousand hours. II is in the thousands of hours that they give up their time and it really makes a difference, I think, at both the Malley Senior Center and certainly at the Library. So , I just publ ic ly want to say thank you to them . They really do a great job. (iii) Mayor Woodward said I just want to mention that the Farmer's Market was Saturday and I'm sure that Randy has some things to say about it. I enjoyed it. (Iv) Mayor Woodward said yesterday morning the South Suburban Foundation dedicated the trail that starts at the Mary Carter Greenway, at the Platte Riv er , and goes from Sheridan through • Englewood , through Littleton , through Greenwood Village, and into Centennlal. .. 14 miles to the Highline Canal. • It is the first time that the City of Englewood has had an actual r.edestrian-bicycle trail from Englewood to the Highline Canal. That one last missing link , which was directly south of Kmart , is now complete and open and it is really a very, very pleasant area . At least the part I have been on , wh ich is from the Mary Carter Greenway all the way up to the apartment buildings in Englewood . It is a really nice, pleasant place. Sc, I would encourage people and bicycl e riders and runners to take advantagP vf that. I know Bel' Bradshaw, forme r Mayor and Council member here and who is president of the Foundation , has been working ... they've worked on this, I think it's been 12 to 13 years . I know that I have been in recreation , education, the insurance business and telecommun ications and there is always some sort of continuing education , I th ink this is a great continuing education piece fo r Council people. In fact , I feel proud, because I just passed the first, bronze level for tra ining , for attend in g classes. So trust me , there is a lot of learning going on, And ail of the partying , like I heard someone else say , I'd like lo know where they are al because I m issed them. I will agree with you that it probabl y lends to a little bit bigger situation of what's going on with the National Night Out program generally . I think it is an important resource and an asset to the commun ity . • 2.
