Call to Order ENGLEWOOD CITY COUNCIL ENGLEWOOD, ARAPAHOE COUNTY, COLORADO Regular Session September 8, 2009 The regula r meeting of the Englewood City Council was called to order by Mayor Woodward at 7:44 p.m. 2. Invocation The invocation was given by Council Member Mccaslin. 3 . Pledge of Allegiance The Pledge of Allegiance was led by Council Member Mccaslin. 4. Recognition of Scheduled Public Comment (a) Mayor Woodward sa id Fire Ch ief Mike Patta •ozz i and Publ ic Works Director Rick Kahm will pres•:u Robert Kav insky , Ron Norden , Re x Templeman . and Gerald Wier with life-sav ing awards . Fi re Ch ief Pattarozz i sa id Mr . Mayor . City Counci l members . it is my privilege ton ight to present the Fire Department Life-saving awards to four members of the Public Works Department. If we could have them come forward and stand . I will read the Citat ion for you . "On July 8, 2009 , four members of the Englewood Publ ic Works :.Jepartment were working on an asphalt project at the intersection of Delaware and Union . A citizen had pulled over and was underneath his vehicle doing some repair work when the vehicle fell upon him . The Public Works employees Robert Kav insky , and Gerald Wier from the Streets Division and Ron Norden and Rex Templeman from the Traffic Division acted quickly to remove the man from under his veh icle by lifting the ca r by brute strength alone . One of the members of the crew contacted dispatch and initiated the emergency response . Due to the extraordinary actions of these individuals . which may have possibly made the diffe rence between life and death for th is citizen , fire crews were able lo quick ly transport the patient lo Swedish Hospita l. For representing the City of Englewood and for the ir incred ible life saving efforts , Robert Kavinsky , Gerald Wier , Ron Norden and Re x Templeman are hereby awarded the Fire Department Life-Saving Award ." He said thank you gentlemen . There was applause . The award was presented to each individual . There was app lause . City Manager Sears said congratulat ions and var ious Council members also congratulated them . Mayor Woodward said prior to our Recognition of Unscheduled Publ ic Comment...nolicing that a number of the • people are here to discuss Centennial and Jason Park ... Mayor Pro Tem John Moore would like to say a few • words about what we will be doing and the process that has come from our Study Session . Mayor Pro Tern Moore said Your Honor , before I get into that part , all through our Study Session , we discussed that we would continue the Study Session , after this regular meet ing , fo r the sake of catching some items that we ran out of lime for. After talk ing with the City Manager, he agreed we can just defer those subjects to our next gathering so we will , unl ike what we sa id before , we will not be resuming the Study Session tonight afte r this . Now for the sake of the individuals who are here about ... or want lo speak abou t the dog issue , I just wan t to make sure that everyone understands what we agreed to in Study Session tonight , because Council has agreed to a course of action . On September 21", in here , we will have a motion in front of us . I will go through the detai ls of that motion in a moment. Bui included in that motion . is that we will then have a Public Hearing on October S" to get feedback from the Public on that motion and then , if all goes well , we will presumably proceed to a vote or October 1 g'•. To key provisions of the motion that will be brought in here for discussion , which may change during the process , of course , but just for a starting point . Council has agreed that we gel to look at having separate times for the summer and the winter . Summe r will be defined as March through October and winter is Novembe r through Februa ry . There will be morn ing and evening times ... l'm sorry , these times are for when the parks , the existing off-leash parks . will ha ve off-leash privileges . So , off-leash priv il eges will have morning and evening limes. The morn ing limes during the summer will be 6 :00 a.m. to 9:00 a.m. The even ing limes in the summer will be 7:30 p.m. to 11 :00 p.m .. park clos e. In the winte r those times would change to be 6 lo 11 in the morning and 4 to 11 in the evening . And then lhe mo tio n will sugge•;t that this goes into effect January 1. 2010. That is kind of the lime line we are work ing with and the startir,g point that we will formally present next week to then be so liciting your reactions to an y of the components of that mot ion I just wanted to make sure that everyone that wasn 't at the Study Sess ion had the benefit of that information . So , thank you . Mayor Woodward sa id thank you John . 7. Recognition of Un sched uled Public Comment (a ) Marti Kucharski , an Eng lewood resident , said we understand that the property at 601 West Dartmouth , wh ich has been taken over , more or less . by a group tha t is a private organizat ion . Urban Garden Associ atio n. And the first not ice tha t the res idents got that th is wa s happen ing was on Jul y 7" when the y ha d • Englewood City Council September 8, 2009 Page 3 • two little signs out on the property . We looked int o it an d called about it , but then we didn 't hea r anything more about the project until later when it was accepted by the City Council that they were going to let them go ahead with this garden . This property was designated , I think , as a park . This is going into agriculture and I thin k you have to have a zone change on that , to beg in with , wh ich hasn 't been done . I asked Mr. Jeffers ~., if he could check that out , the des ignation . whether it was park or open space . But anyhow , we went to the Planning and Zoning in approx imately 1998 , when they were going to tear out all the northwest Englewood area here to build high rises and th ings . The depot had been moved in there in 1992 . A house was still standing there and it was in terrible , terrible shape and I am the one that went to the City author ities and got the old house torn down .. ,that left the property . It was under weeds clear over your head all the time . It was a mess . We went over, my husband and I would clean as much as we could over there until we got the City to turn it into an open space and a park, which it is now. Talking to some or the men that work on It from the City or Englewood , the total cost to change that into an open space with a sprinkler system , trees and grass , was pretty close to $20 ,000 .00 . Now you are turning this over to a group that is going to tear it out and , by the head guy 's own adm ission , these gardens only last for about a ye ar to two years and then they are finished . You have a garden on the corner of Elati and Eastman . which is a community garden that is in terrible shape rig ht now and it has only been going for two years . I want to know why the placement ... was allowed to do th is ... and als o to look at the future cost to do this , because if this doesn 't work , the City Is going to end up paying almost 50 % more than they did in 1998 to get this done . That is pretty expensive . Especially with our budget and you 've got now ... you 've got Sheridan coming up that they may have to come to us for police , fire and rescue help in here . So , I think my suggestion to the girls , I went down to the meeting , there is another lot on the opposite end of Galapago and Cornell that is the same size and owned by the City as a property that they are going to tea r out . that is unde r weeds all the time ... that has come to our attention since this has come out. When we started out , I called Mr. Jefferson and talked to him about it and then I talked to a few oi the neighbors and they called and , so far , we quit having them call Mr . Jefferson . because I have received over 300 calls on this , against this , that they don't want this done to this piece of property . Many of them have come up with pieces of property that the City owns in other areas , where they could do th is and it would be welcome . The man that lives next to the property • on Cornell in the 3000 block on West Galapago , would be thrilled to death , because he sa ys he has to call the City all the time to get you to come and pull the weeds over there ... and then you don't pick up the trash and he has to pick up the trash . It has two ... I think there was a duplex on it at one time , so you have two water ma in s coming in and a sewer line there . And we can 't understand why they can 't move this garden and leave what is there . I live across the street almost from it and that garden is used a lot. Thete are a lot of young children playing there . because they can 't play in the park , because the big kids pick on them and cause them trouble , so they go over there . There are a lot of mothers who bring their bab ie s over there and they run and play in the park . I had one woman come and call and she said it became her place of prayer after her husband was oxecuted on a power line In Aurora . She could see Mount Evans and she would sit on my property , or on tile property Lyle Bentner owned at that time . and she could meditate and pray . So . it means a lot to a lot of people in there . And I wish you would go bac k and reconsider your decis ion and take a look at it. Cons ider what we 've said with the cost , which is Lad at this time . If this was not a private organ ization , and I understand they have applie d for a grant , which is good , I work with a group that is working to save the old Riverside Cemetery in Denve r and we appl ied for a grant . We had every I-dotted . every I-crossed, everyth ing and it has been two years . We were accep,ed for the grant , but we haven 't received the grant yet. In talking to these girls , they plan to have yard sales at the Depot. They plan to have a farmer's market. which changes the whole th ing , because now you are go ing into a business . Tha t property was condemned a long time ago ... you could not use it. That nobod y would plant a garden on it . Dur ing the northwest Englewood tear out here , I did a so il sample all over. It came up condemned and contaminated the same as the General Iron Works ... had the same thing , as it was used to park the semi's there in the S0 's and th e 60 's. So , I don 't see how they could pass FDA to be able to sel l vegetab les there and I don 't th ink anybod y is going to want a farmers market right there all the time during the summer . So . if you will pleas e, go bac k and reconsider this . We would greatly appre ci at e It. Than k you ver y much . Ma) Jf Woodward said thank you . Several Council members sa id thank you . (b ) Colleen McManus . an Englewood resident , said Your Honor and City Counc il. I thank you for • the opportunity to speak . I just wante d ... in regard to setting hours at Jason and Centennia l Parks and now you are considering all off-leash areas ... lo ple ase cons ider an idea or an opt,on of odd and even days , with al ways considering sporting events first. Also , on a sid e note . the 7 compla ints that Code Enforcemen l has had in the las t 2 years . to my understand ing , ha ve not come from En glewood 's spo rt ing associations . So , you know , we Englewood City Council September 8, 2009 Page 4 really haven 't had a problem with the sport ing , it has been more the pa vil ions and the playground at Ja so n Pa rk. • So , maybe , for example , having off-leash on odd days of the mon th and on-leash on even days of the month and maybe rota te that between Jason and Centennia l and Duncan , so then , everybody has an opportunity to go somewhere that is off-leash or is on-leash that day . It is jus t an idea th at we had . We know that th is works on certain hiking trails in certain areas . Also , I wanted to ask you and confirm with you that ... will all parks remain on -leash at all times ? I mean , we are not considering no dogs allowed , is the question that I am posing as well . And then , so in the conversations , we haven 't ... it has never really been clear that , you know , at Jason and Centennial that you will st ill be able to ~ave your dog on leash at all times . We are j ust talking about hours for off-leash . I just wanted to clarify that that was what we were discussing ... that on-leash is still going t~ be acceptable in all City parks in Englewood . She said okay. And then I'm th inking that Dunca n Park maybe should be left as it is, until the new Master Plan is rolled out a couple of years do wn the road , which it could be . It is actually built and up and runn ing and be ing used as a multi-use park, because by adding hours, you mig ht act ually cause issues with the park users today . That is al l I had to say and thank yo u for you r time . Mayor Woodward said thank you . (c) Doroth y Haefel i, an Engle wood resident , said and I am sure. you 've heard all I have to say several times over and I just heard what wa s sa id previously about the hours . And I would like to say that if we have to ,ve it... for me , I would say it would be safer for children and young and old if we ha ve dogs on - leashes . Bu t, if we have to have hours , let's don 't have them on Saturdays and Sundays with dogs off-leashes , beca use the families really part icipate on Saturdays and Sundays ... all of the picnicki ng , fishing and sporting , all those things , and we don't need dogs running wild amongst them . So , le t's ... I'm sure we will hear all of this again on October 5" and we will go through it. And you know where I stand on it, so I'll just sa y thank you and sit down ton ight. Than k ;ou. Several Council members thanked Ms . Haefeli . (d) Martha Griego , an Englewood resident , said after I was at the Study Session listening to you all • talk about the hours and I feel pretty good that you guys were looking at both sides . Mayor Woodward sa id we need your address for the record . Ms . Griego said you guys don 't have it by heart? She then gave her address . But I was lis1t1~in g to you guys ... does my time start now or did ii get interrupted ? She was told it starts now . She said I agree with you guys on some of those hours that you did giv e out and the 6 to 9, I thin k works really well , because th is gi ,es a chance for the elders to be out there and walking their dogs when they want to walk their dogs on leash , it P'Otects them . But the 7:30 to 11 o'clock , I have a small problem with that. I would like to see ii at 8 o'clock in the evening and the reason is because of the T-ball . They are out there until after 7 o'clock . And so yo u are going 1o be running into t~;. T-ba ll , because I have been there where the y finished playing T- ball, the families have l(C or whatever and they are at the oavi lions and they are there eating while the kids are playing . I just don 't wan t to rush these fami lies because I think, you know , family ties are the bonding and you should reall y take '.I a 'ime out and be with your famil y. Instead of saying , we got to get out of here at 7:30 , the dogs are going to be !,t loose . To me , what kind of fun is that for a child to know that the y can 't ea t, they have to hu rry up and eat and If they want to play , they 've got 5 minutes and then they 've got to leave the park . So , I would suggest that if it can go until B o'clock , I mean to me , I thin k, the people that wanted the dogs to be on- leash at all times ... I be'ieve we are compromising and you know , to me , it is just a half an hour to have the famili es to be together. I think that would work out great. Th e winter hou rs, 6 to 11 and 4 to 11 p.m., I think is good hours for the winter. But. I do have to disagree with the weekends . On 7 days a week , aga in the par ks are for the people and their families to be together. I have "', ·· out there on the south side of the park at 8 o'clock in the morning just to get a place to play volleyball w, o:-ne famil y members and th ings like tha t. So to me , you know, we are out there and I'm sure a lot of you guys nave had barbeques , picnics where yo u are cut there chitchatting with each other and by the lime you know it , the sun has gon e down . And you are like , oh wow, ;tis already , you know , after 8 o'clock, 8:30 or what have you . I don 't think that the families , again , should be : ush ed during the weekends and you know , we have to remember that there is st ill Canine Corral and th e 1• ',1Ieton dog par k for the people that want to use other parks . We aren 't telling them not to br in g their dogs , we are just saying , put the dog on a leash . That is all we are asking . So , I don 't think that is a whole lot to as k. You gu ys kept on talk ing about the soccer games . Can we mo ve the soccer games up and this and that , well • yo u know , we 've got the fam ilie s and 1•ou need to remember that there are other sports that are being played there . And I was j ust gett ing the feel from that meeting , is that you guys were try ing to move all the sports around j ust to accommodate , you know , an hour here and there for the dogs . And to me , we 've got two other Englewood City Council September 8, 2009 Page 5 • parks right close by in range fo r them to go if ii is not suitable fo r them , but we have to remember that this is a people 's park . And it is lik e Jil l stated , that you know , it is like dog and people th ing , to soc ial,ze at these parks and to ge t together. Well . I understand that . but there is also these other two dog parks lhat people can go and soc ialize and be o,,e with each other , just like we want to be one with our families and gel together and en joy the days . So , I have a problem with that one . The other th ing is. oh yes, the re were some people that came up to me in the commun ity of Jason Pa rk and have come to me and have said that they don't want to come here anymore , because they have lost belief in you guys . They are very frustrated with the deci sio ns and how long this Is going and how the y have been here and how it has been ~oing with their speeches regard ing the dog s and they are feeling like you guys are more out for the dogs than for the people . They are really frustrated with that. I mean , I am frustrated too , but I'm still here and I'll continue to be here unt il I am satisfied . The same with people from Centennia l Park. So , I would just appreciate It if you guys would really start listening to the people and the families and the children , because this ir. really what counts . I mean , we are the ones that are ra ising these kids to know society , to come to City Cour ;oil, you know . And like they say , you can 't fight City Hall . Well , you know . if it comes down to you guys voting with the dogs and having all these hours and this and that , we will understand that you can 't fight City Hall ... that you guys are more or less for the critters , you know, whic h is really kind of sad . And as Colleen had expressed that having odd and even days ... that is just more co nfus ing . There Is no way that we can , okay we can go to thr. park on a Monday or Wednesday or odd day s or even days , that to me , is you know . you are looking at the weekends again and so you are telling people , we ll yo u can 't come to the park on th is day , because of this , because of that ... I don 't see as working . And as far as Duncan Park , to leave that alone . you are going to have the dominos affec t. When you put these hours into effect at Jason and Centennial Parks , you can ~1ve Northwest Greenbelt and you are going to have Duncan Park and you are going to have the sam~ problems that you have now . You may not thir .K so , but look how long it took us to come here and we 've been doing th is every two weeks since the beginning at summer. I did go to Northwest Greenbelt today to see what that park was like . It is a beautiful small park . There was a couple there and I happened to , you know, ask the m are you guys from here and the guy sa id yes , I'm from here and he says I work right down the street. So, I asked him what his thoughts were about dogs being off leash compared to • be ing on-leash and he said he can 't stan d it... I can't stand it , he says , you know, it bcthers me that these dogs are here and this and that. So , I told him what was go ing on lonight and I told him if he didn't like It, I told him to come over here and represent Northwest Park and then that way , they can have. you know, a feel for you . I said because there is no activities nere at this park . So , he was fearful , he had two little kids with him ... probably around three and five and he was not happy abcut that Idea . He said that he would go with the set hours that we have . that the other parks will have . but he says that he wants to have set hours or else have the dogs on leash at al l times . So , you know, we know that is not going to happen , but you know , I think , that if you do the hours and if we have to come back , I would sat put the doqs on leash 24 17 . (e) Tracy Jones . a Highlands Ranch res ident , sa id I just have a fe w notes that I want to say . The hours , I agree mostly on the hours , except fo r I don 't th ink it should be seven days a week . I th ink it should just be Monda y through Frida y, because there are so man y activities done on the weekends , not just the soccer and T-ba ll but with just families out there tryi ng to have fun with barbeques . There are a lot of people who have barbeques and play a picku p game of basketball or football at night and it actually lasts over an hour . Some of you might be thinking that kids shouldn 't be at the park past dark or whatever, but there Is a street light in the center of Jason Park, so the kids do have light to play in . So , I just think that 8 o'clock issue , should go until at least 8 in the even ing , Monda y through Friday . And I don 't think the dogs should be off the leash on the wee kends . Your winter hours are fine . I am fine with that. I even mentioned to a coup le of Councilmen that I wouldn 't even care if the dogs had the whole park during the winter every day . It doesn 't bother me because there are going to be warm days where we can take the kids out there, but It is j ust a few , just a few days . I think the hours should go for every park , including Duncan and Northwest. just because you are going to run Into that problem of people us in g Duncan Park and then a year from now , then they are going to have to do the • hours and you are going to have to the full warning leeway thing for two weeks or a month ... however long you guys are going to do it. And it is just go ing to be mo re of a headache . Th is way you can get them all done and over with at one time ... instead of people having to come ba ck and fight th is issue again . And you guys , I am sure are sick of fighting it . I th ink th e signs are a great idea and I th ink they should be big signs and when you Englewood City Council September 8, 2009 Page 6 do pul them up , j ust like the new stop signs that are on corners wit h the littl e red flags on them , because it • definitely catches peoples attention and they are go ing to walk over , read it and see what the new news is. also bel ieve that the hours should be from 8 at night weekdays and the weekends , not just for the little kids , b•Jt for the older kids ... the teenagers and young teens who don 't have schoo l. I know some peop le might think tha t kids cause problems at parks , but the y are a lot better off at the parks than they are at hom e 1oing nothing , because that is when they come up with the worst ideas and decide to do worse th ings . Trust me , I knew a lot of them and I know a lot of stuff that they have done ... it is not good . But I think that we are getting there and hopefully we can all agree on 11 ,o hours . I really hope that you guys do a Monday through Friday , not seven da ys a week , because it is not go i ,g to work out very well . Like we said before , we are not saying that , no dogs should go to the park, it is just when you do go to the park between the hours , for us that you just put your dogs on a leash . If you want your dogs to run off the leash then you could take them to the Canine Corral unlll Jaso n Park or whatever hours open up or you could take them to the next nearest park that you can run you r dogs . (f) Kim Love , a Littleton residen t, sa id good even ing City Council an d Honorable Ma yor, than k you for your time th is evening . He said I am also Pres iden t of Englewood Unleas aed and thank you for your time and listening this evening . I would really like to thank City Council and the Parks and Recreation Comm iss ion for the time they took to listen to both sides of the issue concern ing Jaso n and Centenn ial Parks . We respect the vigorous stand that our worthy opponents have brought fr,:lh and we are happy that we have reached a milestone of compromise with th is group . I would like tn reite ,ate that whatever hours we come up with in the end , bas ically , hours equal off-leash , so we want to ma ke sure that those are enforced and I think som! of the ideas have come up tonight in Study Session are good . I think you do need to have that public time , so I am glad that you guys are having time for publ ic comment , so we can all have some input on the nours . We would like the City Council to also consider that Englewood Unleashed has organized cleanups twice a month during some of the tim es that you have scheduled ... or suggesting . Being off-leash , of course , we • come in ... for example ... at th is lime of the year, we start at 10:00 a.m. witn a cle&nup and that would be right In • the middle of be ing an on -leash lime. So , when we are there clean ing up the park on behalf of Jason or Centennial , you kno,11 , we wan t t~ make sure ... right now we are only doin g it at Jason, that we are clean ing up the park we start at 10. And in the winter lime , we move it to 12 , bec .•use most of the time in the winter we are the only group that is there at all ... is fam ilies with dogs . So we move it to 12 noon specifically , becaus e as you know, it is way too cold in the winter to have a brunch and cleanup since as you arc probably aware , the dog parts slick to the ground and the y are difficult to get up anyway since they are frozen ... so that is why we move it to noon . So , we would like that to be a part of your consideration . We also strongly suggest that Council consider winter hours , wh ich would be bas ically November through February , as be ing off-leash , because often we are the only groups that are in the park. Our families are also there in the park both on weekda ys .lnd weekends . Our fam ili es like to use the park as well with dogs and especially on weekends , so winter hours are important to us as well . Because , aga in, we are probably the only ones there . It is very rare to see ch ild ren on the playground equ ip ment because , you know , usually too cold to be sitting on . We respecttull y disagree wi th Martha . When T-ball stops at 7:00 p.m., we watch and I've been there , I've watched many times , the children ... so do the parents, so we th ink that 7:00 or 7:30 p.m. is really a fa ir compromise . Because we would like to have at least some daylight hours to be able to be there . The best in summer , we are talking about 8:30 and it starts to get dark , so it gives us basi cally an hou r less lime to have light to use the dog park . Most dog park users don 't stay past dark . There are a few exceptions , but most of them don 't stay past dark . Englewood Unleashed understands that government legislation takes time . We co mmend the City Council for listening to both sides and scheduling public comment. Th is is the way representative government should work , so we commend all of you for doing that. I apprec iate your time th is even ing . Thank you . Mayor Woodward sa id th ank you . (g) Matthew Crabtree , an Englewood resi dent , sa id good even ing . You know, I have been listen ing to this conversation abou t the cogs and made my comments last tim e about let 's fi nd a permanen t solut ion fo r this problem . It seems at this po int , the other side is interested in setting times and spec ific hours . I go with Joe 8l and John , that th is is probably not go ing to be a permanent solut ion , but we hope it is . The th ing to cons ide r - here though , Is le t's not keep moving the times . What you have is you 've got 11 hours of proposed t,me , you have 11 hours for dogs and 5 hours for people . I th ink there is a concess io n be ing made here by th e other side . These parks are fo r equa l use . Le i's not make one particular group ft>el that they can 't use the park and then enforce specific times . Bel I th ink th is time th ing will work out well f<,r another reason . The ccre problem here , I th ink with Jaso r. Par k, is that these parks are getting owr l.'Se J. I don 't think that any point when the park was first off-leash that it was a problem , unt il it started gett ing "'·' there ... th is park started getting used and used and used , more people showed up , more people showed up , n1Ne people showed up . The one thing tha t th is will do , if you enforce th is across the table at every park with th is time , it will limit people and ... I shouldn 't sa y limit... but it will discourage people from going to one specific park and it will discourage perple from us ing th is one spec ifi c park for dog use . I think ii has an opportunity to even it out across the board and I th ink that will fix the problem . But don 't leave one park totally off-leash . I don 't th ink tha t is go ing to fix the problem . The grant in and of itself provides for salary and benefits of three entry level police officers over a period of three years . She said I'm here this evening to as k Council to consider entering into an agreem ent for a grant agreemen t, with the State of Colorado , to receive S1 ,253 ,379 .00 as part of the Hous ing and Economic Recove ry Act, otherwise known as National Stab ilization Program . The particula r program was an application that we subm itted to the Stale in March . It was approved by th e Hous ing Board at tha t particular time in July . The funding th at we will be receiving is specifically deemed to purchase a min imum , in lt1ally , of 6 houses that we will then leverage into 10 houses that are foreclosed properties owned by lenders that are scattered throughout the City of Englewood . The areas that we will be work ing in are specified as 1 0 of the 13 census tra cks that were identified as high areas with foreclosure problems in those particular jurisd ict ions . The program also has a limited time with wh ich we can spend the funding . The money is a time clock start ing at the time the State received the funding in March , so we must commit all funds by September 2010 . The households that we will be serving are meet ing income requirements stipulated in the program of 120 % of the area med ian income as set by HUD and a min imum 25 % of those must serve fam ilies that are at 50 % or lower. We are required that...of the 1 O houses that are in our agreemen t... that 3 of those houses will be so ld to famili es that are in tha t 50% area med ian categ ory . We w·11 be giving priority to famil ies that are serving ... are participating with family self-sufficiency programs , such as the on e with the Englewood Hous ing Authority. Minimum purchase prices will be at a 1% dis co unt of the appra ised value , as we purchase them from lenders . There is an admin istrative fee of up to 2% that we will be able to reta in, as we ll as a developer fee . The project is work ing towards getting underwa y. We ha ve ex isting staff that has the expert ise to be ab le to Initiat e and operate th is particular program . It is intended that Fund 46 , the Hous ing Re hab ilitati on Fund , will co ver al i of the in itial costs of the particu lar program . We wil l us e leverag ing thet we ha ve with ou r exi sting partne r bar,ks, as we ll as be able to try to leverage with add itiona l ban ks, so tha t we can acqu ire the full 10 tha t we need to , to me et our goals of th is particular program . The proceeds must be completel y spent with all prope rt ies sold by March of 2013 , which is the conclus ion of au , grant agree men t. If we do not have the properties sold by that particular lime , we may be required fo r a ti me be ing to hold them as rentals until such lime as we can get them sold , after the fact. Is there ... am I miss ing someth ing there ? Housing Finance Spec ialist Grimmett replied no you are not . The minimum federa l requirement I ,as a minimum 25 % and that is also stated ... if you look at the same exhib it, it's on page 6 of Exhib it B of the agreement , in paragraph 8.4 Eligible Households , it restates the 25¾. So , that's what we 're referencing . It is a minimum the State has opted that 25% ... because they designed and designated three households , It comes out to two and one-half and they just rounded up , making it three . Three being 30 % of the total ten . It's not a discrepancy . It'; just the way they decided to state it. Mayor Woodward said okay . Mayor Woodward sa id and th e other question . Going back to ... it was months ago when we Initially did this ... it seemed to me that we had to purchase the properties at a reduced rate from the banks or from the mortgage companies . Has that been titted , that requirement? Ms . Grimmett replied it has not been titted , but it has been modified . Ths in itia l requirement was that we were to purchase at a minimum 5% discount , averaging 10 to 15%. I think the Congress re-thought that and in later legislation , tha t I believe was passed with the ERA , the percentage was cJecreased down to 1 % of the current appraised value , so that is what is in effect at this time . Englewood Unleashed, the City , and all kinds of people ... for Eng lewood Da ys . It was ... of the three that I have been around for , it was , by far I think , the most successful. I know I spent the day , up until around 4:00 , on the west side with the census and saw a lot of people . But in drivi ng by the east side , on my scooter a couple or times , I noticed there were a lot more people on the east side . So , tt was probab ly one of the biggest events we've had in town and I thought it was very successfu l. I have heard noth ing but posit ive things about it. So congratulations and thank you . • (ii ) Mayor Woodward said next I'd like to mention that last Thursd ay , I did attend the open house for the early ch il dhood development, al Maddox ... what used to be Maddox Elementary . Th ey are now open and have been open since July . But it is a new fac ility . Th ey have moved over from Lowell and I believe , from Clayton ... all into one build ing I th ink there are some real good things that can happen there , in that , I'm sure tha t their enrollment is go ing to increase over the years with their earl y childhood program . (iii) Mayor Woodward sa id also Thursday night I attended the disaster house event in Emerson Par k. I didn 't know what to expect. If people don 't know what the disaster house is , it is a house that has gone through disasters all summer long . Thal is , elephants have clogged the plumb ing , roller derby people have gone through and broken the walls , they dropped a car from 70 feet in the air onto the driveway and th is has all been filmed fo r a program on DY i -TV and I believe it is for October 6'". I th ink it is a three part series . I know , certa inly, Gary Sears , the City Manager , has a number of stories that he could te ll about des ires of the producers such as jet engines , ro ck and roll bands , and some things like that. So , the y showed us a couple of the actual shows , including the car dropp ing ... first, from 50 feet , and all it did was crac k the sidewalk , so the y dec ided lhe y had lo bring it up higher 10 do the damage that was needed to show the repa ir. They got luggage carrier~ from the airport to lhrow , starting with suitcases , whi ch did noth ing but bounce , and moved to all kinds of things ... ending with an anvil that ii took three people to swing and throw down these sta irs. And then this crew did all of these repairs . You may have seen It last Tuesda y or Wednesday evening , on 9News . It was the house that had the dump truck sitt ing on it , ups ide do wn , and lhen it crashed down . By , I th ink it was 10:00 the next morn ing , the si te was demolished and • cleared . So , there is going to be a new house go ing up there . (b) Coun cil Members ' Cho ice Englewood City Council September 8, 2009 Page 14 (i) Council Member Penn : 1. He sa id again , congrat ulations to the four gentlemen on the life sa\'ing award . I happen to know almost all of them ... I know them all. What a great thing that they did . It was just amazing that they could do that. Congrats to them aga in. 2. He said the Englewood Da ys ... Jack ie is to be commended . I think we started in January and have been working on it. Gary , if you would pass on to everybody from the City of Englewood , that all of the help that you guys gave us and arranged for us ... got us through this . I too , like the Mayor ... think it was an excellent thing for Englewood . Hopefull y, we brought 5,000 to 8,000 people down to Englewood and that was something . Unfortunately , we'll start talking about it in Janua ry again . So , we'll get it going . We welcome any , any suggestions because the comm ittee is meeting aga in . I know we want to make it better and the only way we can , is if we have your input. I know that I talked to Joe today and he has already got his survey from us . Please fill them out and be crit ical , so that we can make it better and we can get that going . That's really all tha t I have . It has been a great week . So , than k yo u. (ii) Council Member Mccasl in : 1. He said I would also like I~ commend Englewood Days . It was great. It started at 7 in the morn ing with breakfast with the Mayor, which I en joyed, kind of. There was laughte r. I enjoyed all of the venoors . I have a few suggestions , so I'd like to be on that lis t. He sa id Wednesday night I attended the School B,,ard Meeting . They were so impressed by Englewood Days . They loved it . I can't tell you ... the positive comrrents ... from all of the principals , to the superintendent that attended ... the Englewood Foundation ... they couldr.'t talk enough about it. It was so positive . In fact , I walked awa y from that School Board Meeting feeling we are headed in a new direction, especially with the school district. They couldn't say enough positive things About Englewood Days, so If you would please pass it on . It was a great day . 2. He sa id, again , speaking abou t the school, I think we 've come a long way to bu ild tha t relationship back with the school district and I defin itely believe ... just by listen ing to the super intendent on down , that we are headed in the right direction . Mayor Woodward said thank you Bob . (iii) Council Member Oakle y: 1. He said I too attended Englewood Days . I spen t most of the time over on the east side , since I am a classic car buff. I did notice that the parking lot on Acoma was completely ful l. The Masoni c Temple lot was completely full . Cars were lin ed up and down the streets all around there . I've attended all of them and that was by far the biggest crowd I've seen there . I especially enjoyed the no on dedication to our country and to our servicemen and women . That went off real well . 2. He said ... moving on to the ladies that appeared .. who were talking about the garden . I too asked that question 'Nhen we first started to do lhat...if we couldn 't find something that was needed ... that nee ded more improvement and move ii there , bu t we didn 't come up with this at that time . So , if there is anothe r lot close by that we can take a look at , I don 't think that would hurt anythi ng . 3. He said on the quest ion of have we ever cons idered no! allowing unlea shed dogs in the parks , my answer is no , I've never considered that and I don 't th ink anybody else has either . The other thing we haven 't considered is weekends and I'm sure that will come up in our future discuss ions , so I'll let that go un til that time . Mayor Woodward said thank you Wayne . (iv) Council Member Wilson : 1. She said congratulatio ns to th e staff in help ing that gentleman . Tha t's huge . She sa id to the people around the dog park situ ation ... thank you all for coming aga in . Good to see you . 4. She sa id to Ma rti, with the garden , it did go through all of the proper channels and it did go to P & Z. II is not a private group ... it's the Cultural Arts Comm iss ion , which is citizens ... a group of citizens working and partnering with Den ver Urban Gardens. They have the grant money that we will be us ing . They are working on the ir 90" garden . There won 't be a Farmer 's Markel there , or if there was , it was misinterpreted , But what we will have is plots for homeless shelters . So , they always need food and so we will have plots that will just be specifically for them , and the food banks that are in Englewood . I will try to get in touch with Mart i and also connect her with some of the people that may have certain questions that she needs answered and we can go forward with tha t. Tha t's it. Mayor Woodward sa id thank you Jill . (v) Council Membe r Jefferson : 1. He sa id I too had a bias• al Englewood Days. I was on the east side handing out free samples from the Twin Dragon . I will agree what a wild success ii was for the whole community . Just kudos to everybody who worked on that. 2. He sa id I also just wanted to thank the gentlemen who rece iv ed the award for their service to our City ton igh t. We talk about a lot of things , but none of them are life and deal~. So , when something like that comes up , ii is really nice to see the service lo the community in a real Ille or death situation . 3. He said ... just some comments on the disaster house . I did not attend their party there, but I just hope that in the future maybe we will be a little more considerate of some of the neighborh M ds . I heard a lot of • complaints from a lot of the neighbors there and it would be different, I think , if there was some benefit to our community , but I didn 't see really any benefit besides ... ! actually didn 't really see any benefit and just thought ii was a little bit disruptive to some of ou r residential areas there . I just hope that , from a policy perspective in the future , we will be a little more conservativ e about what we approve in the residential areas . Mayor Woodward said just lo add to that , I th ink a little more lnfonnation next time too . Council Member Jefferson said agreed , agreed . I th ink we all sort of le a:ned our lesson . I'll say candidly that I was caught off guard, as were the rest of us , in not knowing what to expect and not knowing what was going lo happen . I thought that we had a reasonable amount of information going from the beginning , but I realized about half way through it that we didn 't ... we were knee deep by that point and we didn 't really know what to expect. Aga in , I'll just sa y that in the future , I just would like for us lo be a little bit more co nservative about what we approve in res id ent ial areas , administratively . 4. He sa id to Linda and Marti, I wanted to thank them ior coming down and expressing the ir concerns about the co mmun ity garden . I will echo JIii 's comments that , yes I agree that ii did go through the proper channels ... and notices ... and I was actuall y surprised that I probably received .~out five calls from citizens on the issu e. who claimed that the y had no notice and they didn 't know what was going on and they had lots of questions and concerns about the gardens . And so I'm hopeful that I can , we can , put her in contact with th e right people , address some of these con ce rns and see If this alleviates a lot of their concerns or if it is someth ing that the res t of Council would be willing to cons ider . I'm open -minded to the idea of taking ii to a different location . Council Member Wilson said also ... can send those people my way ? Counci l Member Jefferson sa id I certainly will. .. thank you for that , because I wasn 't able to answe r all of their questions . Ms . Wilson sa id that would be fine and if I can 't answer questions , I'll find out about ii. Mr . Jefferson said I suggested they come down and just be able to all tal k about it... and mee t... and whatno t. I thought that perhaps they would stick aroun d, but I • certainly understand why they didn 't. But I will pas s along their contact infonmat ion to you . I am sure we will see • you at the Public Hear ing and we will hav•, plenty of opportunity for additional comments . City Manager's Report (a) City Manager Sears said I just wanted to let Council know that the reason why we had the two budgetary issues in the packe t was , one , to let you know that we are print ing the budget. You should have the budget by next Monday night. The budget ref,ects the changes tha t Frank Srygl ewicz put Into that. The budgets are moving targets ... there are things that are happening from one week to the ne xt and so we 've incorpo rated these changes into the budget. I think the spreadsheet that Frank included will prov ide a summary of where those amounts are . But as we talked about.. .especially with potential transfers from the L TAR Fund ... the numbers are changed per what's in the packet infonmation that you got. (b) City Manager Sears said part of the reason for the health insurance discussion ton igh t was to let Council know that we have gone fo r a zero percent increase . We were able to work with Kaiser to come up with an opportunity for a zero increase into our budget , which means that there is an additional $123 ,000.00 transfer back into the General Fund ... meaning less of a transfer needed from the LTAR Fund . Part of tha t...to ach ieve that. .. Is a change of some of our amounts ... or contributions by employees that requ ire Memorandums of Agreements with our unions . We have met with the union s. Mike and Sue have been involved with doing tha t And we have also sent a letter out to emp loyees regarding this proposed change . And , so far, it has been very pos itively accepted . The preliminary with the un io ns has been ve ry positive . They have some more meetings for later th is week , but this is rea lly to notify you of the change that we are proposing , again , in the budget, as a final piece. (c) City Manag~r Sea rs sa id I will be gone on vacation and also at a conference over the next week and a half. Mike will be here ne xt Monday night and Mike, Sue and Frank can aoswer any questions that • Council may have . I can try to address those , if Counci l has any . That was the primary reason why those two items were on the agenda . Just really a notifi cat ion as you get you r budget documen , th is ne xt week ... that those changes will be in effec t. Unless there are any questions , that is all that I have . Council Member Jefferso n said , before we ad journ , I would j ust like to go back to our sign code discussion . kno w we don 't want to get too deep into this , because we decided not to continue the Study Session atter th is meeting , so I will try not to belabor it too much here . But I guess I would just as k other Council people if any of them fee l comfortable , at th is time, with directi ng staff to withhold enforcement un til we are able to get our arm s around the issue . Or if th is needs to have further discussion before or just no . Mayor Woodward sa id, speak ing for myself, the idea was to bring it back next Monday on the Agenda for the Study Session . So , we would be in no different place than we would be tonight. Council Membe r Jefferson said so there aren 't an y bus inesses who are unde r a time restraint to come in to compli ance before fu1ther enforcement action will take place ? City Manager Sears sa id it is my understand ing that we have given warnings to the in divi duals . Tom , would )OU speak to that. Pol ice Ch ie f Vandenmee said yes , all have received warnings and so far , all have voluntarily come into compliance for the time be ing . Council Member Jefferson sa id okay . So , if there was an add itiona l violation , we would aga in go through the process of giving them not ice and an opportunity to come back into compl iance . Correct? Police Chief Vandermee said a first complaint would require a notice of violation ... that gives them 7 days to correct it and then we would give them a warning b~yo nd that. Mayor Woodward said I th ink it also gives us the opportunity Joe :o have ACE 's input , which meets th is week . • And I th ink that would be of value .
