6. Recognition of Scheduled Public Comment
(a) Jerry Furman, an Englewood res ident , sa id the thing is we don·t have anyth ing to show our
proof that we have fine military people in the City of Englewood . I went to the library to ge l I~,. inforrnelion , and
why we don 't keep up on dates of our fallen people tr memorialize them? And we need lo memorialize our
fallen mil itary and war people because they protected our City and helped us through battles and stuff and we
don 't have anything to say , like the Purple Heart th ing . So it doesn 't have th e names of the milit;;:y people who

got the Purple Heart or the names of lhose who died fo r s .rving our City of Englewood . I counted 52 , because I
went through the library at Ftlogan .com and gel all my information . And righ t no w, I don 't see nobody 's name
or hear anybody 's name ... only one person and that is Ed ward Penn . And what I th ink what we co uld do is start
a th ing lho ugh , if we do lhat, the veteran ... if I name him for a veleran , and I can't fig ure out what the terms
would be for ii. And the thing is we need to honor our veterans more because they protected our lives and
protected everybody who is here righ '. now . Mostly because Randy Penn lost his brother who loughl in the
Viet nam War. I didn 't even know at>,ut that unti l I talked to Bob Mccas lin and Doug las ... I can 't get his last
name ou t... told me about him . What ! think is that what we need to do is honor all by givin g in format io n cul. It
was hard to find th is information . I think we need to get to know who we lost If it was a fam il y member of
anybody up here , would you want your family member to be honored ? I think it would be a yes . So right now
we don 't have anyth ing to honor any of our fine military or po lice officers . Actually , we need to know who falls in
the line of duty to say thank you to the family who lost a loved one . And I think we do need to do that because it
is part of our history and we are losing it daily ... because the library doesn 't even have it...any information about
any of our fallen mi li tary people . Thank you . Bye .

7 . Recog"ltion of Unscheduled Public Comment
(a ) Stacy Stevens Crane , an E·,glewood res ident, said good even ing . I am here tonight to

represent the many people who believe in · ,e Eng le s:ood summer drama progra m. There is a famous saying
that I am sure you have all heard 'the show must go on'. We believe that and plan to do whatever it takes to see
that happen . This program began in 1966 under a man named Jack Fisher , who we now remember and honor
with the name on the Englewood High School auditorium . He wanted to start a summer show so that the
children of Englewood could be exposed to the art of the theater and be excited and knowledgeable members of
this program when they reached high school. In the 44 summers that have followed , it has grown into •
so methi ng more than that. If the program ends , it will leave not only a hole in the Englewood commun ity but in
the Denver metro community as a whole . There is no other program that we know of in the Greater Denve r
area where the on ly requirement for being in the show is your des ire to be a part of the show. That's itl
However, for safety and maturity reasons the kids have to be at least 7. Other than that , it does not matter what
club you t>elong to . religion you practice , how well you can sing or how many years of dance lessons you have
ta ken . If you have a des ire to be a part of the show, you will be a part of it. This is a family that acce pts an yo ne
willing to work for the good of the fam ily . There are people lhal Join th is prc,ram that discove r talent and
ded ication that the y never knew they had . There are others that take those talents that they already ha ve to
new he ights . Then th ere are the kids . The ones that Jack Fis he r started th e program for . They hav e a love and
a pass ion for this program that we , as adults , often just can 't fathom . They start looki ng forward to the next
sur:mer show the moment the old one ends . They look at many of the teenagers and adulls and staff as people
th tl the y truly admire ... as heroes even . Th is program teaches kids and adults that we can share a common
goa l. That we can work togeth er and actually have a lot of fun do ing ii. Oh , and they don 't re ally mind that it is
a lot of hard work and sweat because they are active . involved and doing what they love to do : singing ,
dan cing , acti ng , pa inting , building sets and learning a new craft . What other program offe rs th is won de rful
oppo rtun ity to our yo uth and old alike? Th is connection is not found in many pla ce s thes e days . The
Englewood Summer Drama Program represents great memories fo r me and my fa mily . Nearly 25 years ago , I
joined the summer drama program and fell in love with it. Four years ago , I came back and was able lo share it
with my daughters , who also fell in ,eve wi th the program . On e I an, sure that they will hold dear to the ir hea:ts
and will share r.,emories with thoir children . It is a great program in which all ages come together and work as a
team . Where 100 iad ividuals can put a sh ow together in two months time , proves hard work , drive, ded ication
and devotion which I bel ieve we would ancourage in all of our children . I have been a citizen of Englewood
commun ity for almost 40 years and my family has resided here since the 1930 's. We have experienced the rise
and fall of Cinderella City , the closing of Cinderella Twin drive-in and Flood Middle School , formerly known as
Englewood Senior High . The more that closes, the less likely people will move here and spend the ir money
here . As each estab'ishment closes , the more our citizens tend to look for other options for schoo li ng and •
shopping venues . Where does that revenue go ? Not Englewood . History has made this City what it is and
brought a community here to live where they can br ing up the ir fam ilies in a loving , caring com mun ity .
Englewood has seen many declines th ro ughout the years but if we close every program , we will have nothing
for our future citizens nor will we be able to keep Englewood a grow ing community . We truly believe that th is

program needs to continue . We want to do whatever it takes and we want the City to st ill be a part of ii. It will
make the journey to each summer eas ier. We understand that balancing a budget is not easy . In the past two
years , we have ga ined a lot of ground to balancing our budget and have plans toward ach iev ing that goal th is
year. We hope you will reconsider the cutting of the Eng lewood Summer Drama Program . We look forward to
its reach ing its 50"' year in 2015 and going beyond that as well . It is with our deepest hope that you will find a
way to help make that come true . Thank you for your consideration .
Mayor Woodward sa id thank you . There was applause .
(b) Don Seymour, an Englewood resident , sa id now you all know where I live , right? You better not
get rid of the summer program . I know where he lives for sure and the rest of you , I can figure it out. We ll you
know , first flyer doesn 't have a chance , you know. I mean she has been with it 25 years , right? I have been
with it 35 . My boy was one of the Fisher kids , my oldest and I'm not sure about my daughter . I had three kids
go through the program . I've been In the program .
Council Member Moore said Your Honor , do we want th is testimony in the Public Hearing? These are budget
issues and we are having a Public Hearing tonight, so I would rather have lhe budget issues come under that
agenda item If there is no problem shifting to that.
Council Member Wilson said I thought we were doing the Unscheduled Public Comment.
Mayor Woodward said we are but these are talking about budget questions and if ... John , if you want to go on .
Council Member Moore sa id If these are budget comments , would they be better off undAr the Public Hearing
section ? He said I would rather have ... once we set something up for a Public Hearing , its best that we collect
infonmal ion under the Public Hearing . All it means Is that we would shift you a minute or two on the schedule .

Council Member Oakley said I had told Don earlier th is evening thal he was welcome to talk during Public
Comment and at the Public Hearing if he wanted to , so , you know ...
Council Member Moore said generally when we set a Public Hearin1,, we really should limit the infonmation that
we as Council reflect should be the stuff we collect in the Public Hearing . So what I would like to do to the
extent that anyone who wants to speak on a budget matter like this, It will just be under Item 10 which is com ing
up shortly . That would be my preference but Your Honor , you can make the call .
Mayor Woodward said Don , I would like to leave it up to you because that is the record . The Public He ~· 1s
the record of the budget and this is certainly part of the record also .
Mr. Seymour said well I will still be here for the Hearing . I never wen t home early from a dance in my life . There
was laughter.
Mayor Woodward said you weren 't signed up but I will give you the opportunity to sign .
Mr. Seymour said well , okay . I was told sh-sh -sh and will probably chime in later .
Council Member Moore said I apologize for the confus ion but if you wouldn 't mind then , I would like to keep to
the budget issue because that is just the fonmal thing .
Mr. Seymour said he doesn 't even know me and he knows how long winded I am . There was laughter. He sa id
yeah , I can, you know , just like I say , I'm still here .
Council Member Jefferson said how about Ms . Stevens Crane ?
Mayor Woodward said I am going to give her the opportunity if she would like to spea k again then . You don 't
have to go through your whole thing again but if you wanted to , I mean ... whateve r.

(c) Chris Du is, an Eng lewood resident , said good even ing , I'm co-chair and coordinator of
Englewood Days . I would like to take this publ ic opportun ity to thank the Counc il, City workers and the people
in our comm ittee for th is year's Englewood Days even t: Jack ie Edwards , for work ing so meticulously on record
and bookkeep ing ; Bill Parks , for setting up our web site and keep ing it current ; Doug Cohn , for working with the
City on the perm its and other items ; Englewood Unleashed , the dog show was a big hit. Also , a big thanks to
the many volunteers who helped make it all happen . I would like to say thank you to all the sponsors of th is
yea r's Englewood Days Car Show event. There were 45 sponsors for the car show alone . They contributed
goods and services as well as funding . A special thank you to Meadow Gold for their huge contribution and
provid ing free Ice cream all day ; the VFW and the American Leg ion for provid ing the noon time salute to the
military . A spec ial thanks to Mayor Woodward for accepting my invitation and showing up for the First Annua l
Breakfast with Mayor, 7 am at the Breakfast Queen . The art work for this ye ar's poster was drawn up and
donated by Dale Moore at Phantom Graphics . The framing and plaque is by Brian Hart from Frame de Art.
This is a pre,entation to the City of Englewood in appreciation for the ir commitment and cont inued support of
the Englewoo1 Days Car Show and events . I hope it can be displayed in a way that Englewood cit izens can
see it and know that the City of Englewood supports the civic pride that goes into Englewood Days . We in the
Car Show Committee wo uld like to extend ou; appreciation for the commitment and continued support the City
has extended to us to make th is event a success . With Council's continued support , we can continue to make
this showcase even t a success and the envy of the surrounding communities . So I wou ld like to present this to
you , Mr. Woodward ;Jnd have you open it.

Mayor 11':aodwar~ sa i~ :nis is an o,~~inal logo for the 2009 Englewood Days Show and I want to turn this , I
guess so that Cound l can see it also . And I thin k ii was a friend of Chris' that actually had done this art work
and I t11 ink I had mentioned at the previous meeting , my personal thoughts , having been there most of the day ,
what a great e'/ent it was . And I feel like with the exception of the 4th of July , wh ich is a hard one lo beat , this
was the la rge st, I saw , participation within the City . It has bee a real pleasure , I th ink , and a real benefit to th e
City of Englev,ood doing our partnership with Englewood Days and all the other partners . And I think another •
one th s! needs to be mentioned , because I was on the west side working , is Englewood School District who
partic ipated pretty strongly and had a lot of kids ' things for them to do and different teachers coming and
different sc;hools and look ou t...the T-sh irts would change colors and there were different teachers there . II was
just such '• successful event all the way around , Again thank you to Chris, to Doug , to Jackie , to Randy and to
everybo cy that was involved in this effort because I know it was really someth ing . Thank you . There was

(d ) Doug Cohn , an Englewood res ident , said I have just a couple of things to talk about . Chris
expressed my ap preciation , We had a great party . I had a couple of other people that I'd li ke to mention to
add on to his li st. Phil Gill iam recorded the Bo y Scou ts event an d Tom Munds of the Englewood He rald
worked hls m.uvels on the co verage of the event. The Bus iness Improvement District. the sponsors , a perso n
I had not met before and have come to app rec iale ... a couple , Miguel and Ann Drake Ann was our volunteer
coord inato r and she knows ho w to coord inate volunteers . She did a marve lous jo b. And then one othe r
fell ow .. , I don 't f:now if you guys have me t Ken Hodge . He was the guy who had those me chan ical mus ical
things . He wa s. a trouper all the way throug h and really appreci ated all the work that the Chamber did in
work ing together with the comm ittee . I just want to say thank you as well . And then one question for you al l.
Somebod y fr om the Parade of Lights saw our horse car and the y sa id, wouldn 't ii be cool if the Cherrelyn
Horse Ca r could be in :he Denver Parade of Lights ? I have no Idea but he sa id that would be just a marvelous
way of advertis ing the City , I don •·now ... put LED lights on it. I can find the driver I guess it would be
som eth ing to cons ider . I don 't kno,, if or even how it could be done . That was point number two , Now point •
numbe r three , there has been a discuss ion abo ut signs and bus inesses on Broadway . An d I would offer to you
for your cons iderat ion an agreement tha t the merchants association made with the City in 2001 , It is the
slightly loosened set of rules that were de veloped for the sidewal k sale days and the issues that you guys
expre ssed last Monday about safe ty and signa ge and all those kinds of thi ngs have been addressed in tha t

document. Alan or the other guys over in Co mmun ity Development . I think I can get you copies of tha t.
Anyway , I want to say thank you .

(e) Erika Rinnert and Michael Gabriel , Englewood res idents . said good even ing . Mr . Gabriel said
ours is kind of a budget Issue too so I don 't know if we should do it now or wait. It 's up to you guys . Council
Member Moore said let's just put all of the budget issues together . Council Member Penn said th is Is for 2009 .
Council Memher Moore said now , for 2009? Miss Rin,ert and Mr . Gabriel replied yes . Council Member Moore
said please continue then . I'm Erika Rinnert and I am \11chael Gabriel and we are juniors representing
Englewood High School. Miss Rinnert said we hav e come to ask City Council if they would be willing to he lp
us with some of the financial costs of the Homecoming Parade . Mr . Gabriel said Nick Johnson believes that
the total cost would be about S700 .00 . Ms . Rinnert said and we would appreciate any assistance you can
offer. Mr . Gabriel sa id thank you for your time .
Mayor Woodward said can you tell us when this is? Miss Rinnert said yes , we have a ~"er as well with all of the
dates . Mr . Gabriel said and the parade is October 2"'. Miss Rinnert said Homecoming \ •ek starts !'aturday.
September 26~. Mr. Gabriel said and it ends on October 3~. I th ink we have had it for the past 25 years or so .
Mayor Woodward sa id okay and typically we address our guests at the end of the meeting so if you would like to
stay for that , I am sure someone is go ing to be addressing something for th is. Thank you .

(f) Jesse Daniel Montoya, an Englewood resident, said my address is a little iffy because I
sometimes find myself homeless . I've been liv ing In Englewood most of my life . I will make a long story short
because I don't want to bore nobody and make anybody fall asleep or get upset but the homeless situation for
Englewood , I don 't know how bad ii is but I find myself, since t been out of high school. .. I graduated from
Englewood High School in 1981 ... and I've seen a lot of changes in my life . And I would like to let the City of
Englewood know that I am trying to be a better person and learn a little bit more history about Englewood and to
hear some of the good issues that were going on tonight were important. The first issue about the veterans , our
fallen heroes . People all in general in Englewood , you know , we all got to s, with the flow of times . Let's say . if
there is someth ing that can be done about that. I would look forward to be ing a part of the Englewood get
together and here again , eventually ... But before I leave because I am not exactly homele,;s and I am not totally
stupid where I know that I could do someth ing about it but to live in Englewood is 3 privilege and to live in the
State of Colorado is more than a privilege too . But to be a part of a good group with good morals , standards, it
is a positive thing for my life , be cause when you sa id the Pledge of Allegiance , and you had all the good th in gs
to bac k it up , that was outstanding and it made me feel like there is a poss ibility for further growth for Englewood
and a positive role mode l that I see from everybody here . Also , one more thing I've got to mention . Tr,e
calendar that Englewood puts out , please keep those going . Those are the greatest things that insp ire me for
looking forward to another good year with everybody here . May God Bless You . Take care .

Director of Finance and Admin istrative Serv ices Gryglewicz sa id Ma yor and Council ; I just presented the City
Clerk proof of publication from the Englewood Herald of th is pub lic hearing to gather input on the 201 0 budget.
I! was published on September 4th , 11th and 18", and I also prov ided the City Clerk with proof of publicat io n
from the City 's website from August 26 through September 21 ". As I ment ioned th is is a publ ic hear ing to
gather information on the 2010 budget. Council received the ir proposed budget on September 10". The y are
required to have that document by September 15" and also hold a public hearing with :., three wee ks of the
subm iss ion of the proposed budget. I need to ment ion , as everybody knows , staff and Counc il, that putting a
budget togethe r takes a long time . It is a very difficult process , and it is especiall y difficult when you have
revenues that are declining more rapidly than your expenditures . When you 're in a situation where you 're in a
rece ss ion r, lot of times you ·re ... the pressure on providing servi ces to your citizens actually increase wh ile the
revenues are going down . So th is has Leen a vary difficult process but I need to ment ion , right up front , that all
of the employees of the City . from the top down , City Manager down to the parks workers . everyone , sacrificed
to make th is budget work by giv ing up p,.y increases , payoffs on their personal leave and other benefits
incl ud ing their hea lth benefits . Th~y looi:ed at reduci ng that to keep a zero percent increase for 2010 . So it has
been a very difficu lt process and I did w;;nt to acknowledge all of the employe es that have sacrificed to make
this budget work . But j ust a real brief ovErview of the General Fund and I am only go ing to bri e~y touch on it
beca,,se the IJo1>r<al Fund prov ides those services that most of the citizens en joy and probably re ly on the most
and that inclu •Jes Police , Fire , Publ ic Works , Parks and Recreation and the Library . The total sources of funds ,
and I hav~ to sa )' th at you always start your budget by looking at what you have ava il able . I mean , ,, we could
just ~v. we co ul d spen d what , yo u know as much as we 'd like , the budget process would be very easy . Bu t th is
year , we r,av e seen re,enues decli ne and we don't expect to see them pi ck up dramati cally in 2010 . 'light now,
we are look ing at our total sou rces of funds for the General Fund at about 39 .8 million do ll ars . Fo r this yea r, our
orig ina l budge t was, 1.6 million do ll ars more than that , so we are looking at a decl in e in revenues and to offset
that , we are l~oking at total uses of funds at 40 .3 million . So we have a bit of a defic ie nt. We are looking at
uses of th e Long Te rm Asset Reserve of about $64 7,000 at this poin t in time . We do have a hiring freeze in
place , and as I ment ioned , pay is bas ically frozen next year so there has been a lot of sacrifi ces in this budget.
We are look ing at , for this year and next yea r, of having a Fund Balance Reserve of about 1 0 %. Th is Saturda y

hundred people like she sa id. Let me underscore her points : wor ki ng together on many different things , long
into the nigh t. Be lieve me I know. Like I say , my thre e kids were Involved . I was involved . We are still
in vol ved . I don 't thi nk we have mis sed a ye ar of doing props or prov iding that kind of thing . In fact , I have ... you
wouldn 't bel ieve .. Wells Fargo wagons , surrey with the fr inge on top , pum ps that actually work , windmills ... you
name it and I've got it in the basement or yard , okay . I mean I'v e got props . And you know , every year the re is
something . lt is reall y a program ... ! mean , where can you get a prog ram whe re you can involve the parents and

th e kids in the same program? You know , this is not like the parents standing on the sideline and cheering for
the ir soccer players but , yo u kn ow, they work together. They are on the stage together. There were , I don 't
know , several times , when I wa s on the stage with all three of my kids ... Wendy back here , you know. A big
community bu ilder . The progra m ... it ranks in there with college productions . It is good . I know because , you
know , I've seen a few college productions . My oldest kid was involved with It , he worked for it, he went on to DU
to theatre teach . He is now a 5~ grade teacher and my daughter. who went through it , is a 3~ grade and she
uses her theatre , community worki ng with kids th ings . They use it all the time . I mean , you just can 't beat it.
How many of you have been to one of our Summer productions? There was a show of hands . He said shame
on the rest of you . There was laughte r. You are miss in g a good program , really . So , you know , any questions ,
I'm willing . Like f say, I've been in it for 35 years . I started a group at one point ca lled The Supporting Cast. if
you get the play on words there , of parents , people that went on for many years to help make the program work .
And it is just a thing where the pa re nts and the kids can work together, you know . rig ht there in the same
program , on stage . We had it this summer, you know. Mothers up there with the ir daughters , doing their th in g.
You can 't beat it. Quit looking so solemn and kick loose with your bucks , okay? Any question s? I'm ready ..

(b) Wendy Mahr sa id I do not live in Englewood any more . I graduated from Englewood High

School In 1987 . I came to Englewood solely to go to a high school that was good in the arts from another state .
My father located here solely so that I could experience Dr. Gerard i, Bill Ambron and Rhonda Fausom . So , I am
now a teacher In Greenwood Village and I direct the program with Bill ... Mr . Brickley . I wasn 't planning on talking
but I decided I should say something about a very &motional program to me . And when I found out about the
proposed cuts , you know . I know reality and the arts . I g~t it. But this is something so unique , I can 't think of
anyth ing ... one th in g I love about it is the senior citizens com,, and they are working with these little kids . Senior
citiz ens who are doing something that they had never done in the ir whole lives ... that is so insp iri ng . Our oldest
cast member is 72 and two summers ago is his first time eve, on stage . This is such a cool program . Fo r the •
children. it is $35.00 for 8 weeks . The average Denver metro orogram for theatre is $175 .00 per week . I
brought kids In last summer. When it started 4 years ago , the ~rogram was pretty small . I think we had 9 kids .
Last year we had 45 . Many of them choosing to come to Engle,vood instead of going down town to the Denver
Centar ... their moms stopping off and having Starbucks and every~ody is eating at Frank 's Pizza and you are
bring in J 100 people in roughly a day for 8 weeks . It is a pretty gooci deal. I love the program and I don 't th ink
there is any other place where you can safely ha ve a whole family t~gether where the re is no conflict , there is
no pressure to everyone has to have an agent who is the best or only rich kids can do it. We attract all kinds .
So it is such a special program , I would be sorry to see It go and they can't overstate the family connection .
Everyone there is willing to work . They are almost willing to work for nothing and many of them are free . They
just help year after year after year and I, like Stacy , we were in shows in high school and here we are bacr.. We
want to come back . I don 't live in the City any more but I come back all summer to be here and my little
daughters th ink they are going to go to Eng lswo od High School because we are there every summer . Thanks
for the program and I hope we keep it go in g.

(c) Dan Carlson , a Centennial resident , said I am one of the people that Sta cy menti on ed earlier
that has never been an Englewood resident and frankly ma1• never have had anything to do wilh the City of
Eng lewood if it weren 't for my step-mother saying , 'why don 't you go try out for th is program'. I ha ve now done
9 of them . My wife will attest th at it has become probabl y way too much a part of my life and I'm okay with th at.
I am proud of what I have done . It has driven me crazy at times . It has given me sheer joy and passion at
times and I would like to present to the City Council packets that Includes what Stacy said earlier as well as 16
other testimonials to how much th is program means to us and how we want to make sure it continues no
matter what we have to do .

soon , we might have two or lhree more days of it. What would be the reason as to why we take programs awa y
from you and our kids? We can 't do any other budget cuts for adults , like freeze the Rec Center a little bit ?
More money to help us out , because the kids are there for hours . They pretty soon will be mayors or lhe
President of the Un ited States of America . You know what? If we cut thi s program , where are the kids going to
be at ? I think they will be on the streets doing crimes and stuff . And I just think we need to be there for the kids .
Our kids are going lo be our people of the future . The other reason why I lhlnk of kids? I volunteered al
Maddox Grade School and I am sad that they closed that down though . The thing is , where Is the kids going to
play in the summer time or are we going to start cutting everything now for our kids ... like our Chris tmas stuff for
the kids? Because If we start cutting one , we are go ing to cut them all because they don 't have anything to say
because they a•e not tax payers . Oh , you are th inking that you are losing money cause there are actually tax
payers who pay the Council budge t a little bit to be on the Council . I think Council should do a pay cut to help
budget the budget. Thank you .

(e) Deene Mowrey , an Englewood resident. sa id I have lived in Englewood the majority of my life . I
graduated from Englewood High School and I put 4 1/2 children through Englewood High School. My daughter
is the one that is involved with the Summer Drama program . She is a junior th is year and she has done three
plays . She absolutely loved it. it is her niche in life . She is in the theatre ... drama , singing , all of the above . My
oldest son did it for a couple years as well. I also had two boys that did the technical , for many years . One of
them fell in love with the technical part of the whole drama program and is now in the United States Air Force
with that background helping him lhrough that. My other one also did the lechnical and he was in the STA
through the High School , the Student Technology Association . He also found the niche in his life and that is
what he does for his living now too, with the technical part of it. Not only does the drama , the acting , the
singing , but it also gives those kids who work in the technical department a chance to find their niche in life as
well. I think this is one of the better programs through the City support and I think if this is cut , we 're going to be
seeing a lot of disappointment in a lot of children . Thanl : you very much .

(n Matthew Crabtree , an Englewood resident , said good evening . I have to be honest. When I
was in high school , I was part of the theatre program and part of the theatre program even in mid dle school . II is
a really good program . You know, I wasn 't in th is theatre program but 111 a different school district but I was in
every single production for four years at the high school I went to . It kept a lot of people out of trouble . I can
attest to that. What I'm looking ... the time that I've spent here attending these City Council meet ings for the lasl
two years and I see how the money has been spent, I have to ask the aud ience a question at th is point. What
would $70 ,000.00 do for this program right now? You look at the money that Community Development
spent...$48 ,269 .00 to go to Las Vegas to advertise property that isn 't even located in the City of Englewood .
That is a lot of money . $20 ,000 .00 for a trip to Wa.hi ngton , D.C. for most of the members of Council. Tha t is a
lot of money . I just hop,, that when you make your bu dget considerations for 2010 that you exclude the
Washington , D.C. trip and you exclude so,11e of the se ot her unnecessary trips that don 't affect the people of
Englewood directly . Another th ing that I will ask, please consider looking at a line item budget. I don't know . I
just find it very hard to be'ie ve that without a lin e ite m budget , yo u actually know how the money is beir,g spent.
You are looking at cutti ng t ,e low hanging fruit here . th in gs that are a couple thousand dollars he re and a few
thousand dolla rs there , th ings that really impact our commun ity . Arts is somethin , •~at always gets cu t first and
that is not fair . When you don 't know what is actually being spent !n this City by not .-eferencing a line item
budget. That is a concern . I thank you for your time .

Englewood Summer Drama Program . I have been a participant of the program for over three years , the mos t
recently for two consecutive years , and I was also a parti ci pant in 1999 . I've got to say that apart from a name , I
wo uldn 't really know that Eoglewood existed if it weren 't for this program . This is the program ... participating in
th is program made me real ize that Englewood , what Englewood is , that Englewood exists , and that Englewood
is a city . And I think that that has got to be true for other people too . That th is program is someth ing that

broadcasts the name of Englewood beyond ::,e borders of En glewood . It is something 11,a, gets attent ion to

people and th is is something that makes Englewood ,eal. .. th is program ... beca use it brln~; people in that
wouldn 't know that Englewood ex isted if it weren 't for this program . And it it ver y positive . It brings a lot of
positive energy for people who are part icipating in the program and people who are associated with the
program . And to get rid of it would be a tremendous loss to Englewood . Maybe •. ,·Jlet h'ng that you don 't

might be a budg et thing . I tried to volunteer to make it poss ible to see where the y could use the help . Mayb e ,f I
was to find out if I could get a job working w:th the shelter, it migat help , and maybe it won't. Okay . that is ow,,
choice that I made . Also another th ing Is when King Soopers use~ to h~v,, a parking lot , it used to be on top of
the pa rkin g lot that is there now. The parking lot that Is going to be extended out by the Dartmouth and the light
rail system , I happened to go across that today. and I was talking to a la nd surveyor. surveying the property . Is
there another way that somehow they could get some better opin io ns on having come up with this park ing lot or
are they going to actually want to extend that because if they could ... l remember a long time ago as a little kid , •
I'd been in Boy Scouts in Englewood . I've bee n i11 elementary since I was a toddler , okay , so I remember
Cinderella City used to be here . But one time I remembe• Ringling Brothers , Barnum , Bailey Circus used to be
in a parking lot over there . Now , is there any way that they could . maybe it is beyond me to stop , but maybe
could they cons ider mak ing a little extra park ing lot up on top like they used to have at King Soopers . so they
don 't have to take out that little part of the time tunne l that runs up around that whole park ? It is part of a bike
trail. And if that is not possible . then who knows what they are go ing to lose . That is part of Englewood history
right there . I remember the bridges that used to be there befo re the light rail was even running in there . Thal
used to be my short cut to school from over on Goat Hill , which would have been by the 7-Up Company .
head ing to Flood Junior High School or Englewood High School. That was a long trip for me at that age ,
espec ially when I had to walk and I was runn ing late tu school . But hey, I made it through school and I r.ouldn 'I
have done it without a good group of people like yo u. And if I ever have anything important to say , I hope to say
it with the respect that you have given me to gel throu gh high schoo l. And with all that said . I need to leav e
because I've got to get going and who 's to say if it is go ing to snow tonight... ho pefuliy no t. Hope eve rybod y has

He sa id well I would like to start and I would like to address Stacy and Don . Stacy , I go! you r message . Don , I
got your message and the rest of the drama program people , I got your message . Do ·, • !~1 ink i•ou may be
wrong on one thing . I think there may be grandparents , parents , and the parents ' child :e1, 'nc·o•ved in this . This
year 's presentation was Annie . Living a half a block away from Englewood High School , i1 a .',ng had a son
involved with drama , I can 't remember if he did the Summer Drama Program ... I'm pretty sure he did as a tech
guy ... and seeing the cars there every single night during the summer , during June , during July, going to the
produc ions at the end of July or real early August and see ing kids from very young kids to older kids and
knowing that those practices go late into the even ing ... not evening , they go into the night, they go sometimes
close to the next morning if not the next morn ing ... and the dedication of everybody in the perfonmances that I
have seen are truly community theatre . And this year it was Annie . Two years ago BIii t,mbron , it was , I
be!:eve , it was his 100'" production ... not this summer theatre but his 100'" production of doing theatre . And I
brought this up in Study Session and it is something that we are going to be look ing at , at our workshop . I know
it is someth ing that I strongly support and I apprec iate all of you people c~mlng here tonight and stat ing your
support for a progra 'll that has gone on so long and really , in my op inion , means something to the City of
Englewood , to youn ~ ~eople , to middle aged people , seniors and I am just really impressed . And like J,,hn said ,
I think this is the most that have ever been to a Public Hearing on the budget...and it is you folks .

unbelievable . I mean , they were just unbelievable . So , I think I'm vith Jim and the rest of thP Council to see
what we can do to cont inue this great program for the City of Englewood . And Don , thank you for your years of
service and you are still serving , you know . our community by working at my wife 's school . I appreciate
everyone who has kind of helped in giving back to the commc aity . I really appreciate that. Thank you so much .

Serv i~= we also do the miscellaneous licensing fo r the City . As you mentioned , th is Is a bill for an ordinance
adding C.h,•pter 22 . Med ical Marijuana Primary Care-Giv ers to Title 5 of the Englewood Mun icipal Code . Bac k
in 2000 1ne Colorado voters approved med ical use of marijuana but until recen tly there really hasn 't been a lot of

September 14'" and Council gave direc tion to staff to draft th is bill for an ord inance . Bas ical ly the license mirrors
the Colorado Constitution , what the voters voted on , oth er than just a few ite ms that the City and Cl'y staff
bel ieve lhal we needed and just briefly . that the lice nse will not be transferable . A background investig at ion will
be conducted and anyone with a felony , the ir license would not be approved ... actually the ir application would b,
rejected ... and an y actions or if they were no lo nger allowed to be reg istered as a care-g iver , the ir license would
be revok ed or suspended or not renewed and also their record keeping requirements , just to make sure that lh•,
inv entory and th e sales are only mad e to those persons that are reg istered by the Slate . And I should mention
lhPt the fee for th is will be set by resoluti on and I believe tha t will be before Counc il on October 5'".

before delive ri es and whatnot and so I am just wondering If we need a litt: , clarify ing language . I guess the •
example I threw out in there is that somebody has go t a grow operation in south Denver and a retail location in
Littleton and they are comin g through wi th their supplies and do the y need a licen se to do that?
City Attorney Brotzman said and the answer , if you are actually delivering in Englewood , the answer is yes you
would , but in terstate transport if yo u drove through , the answer is you would nol.

City Allorne y Brotzman sa id th at is correct. And one of the benefits to a lic ense holder is if you gel pulled over
by a pol ice officer, you aclu2lly have a license expla ini ng what you are doing . It would be a really nice defense
and would help your explanation a lot of the way .
Council Membe r Jefferson said okay . So for example , somebody like I said in the example that I gave you guys ,
with a grow operation in south Denve r and a retail operation in Littleton , doesn 't service an y m~mbers of our
community with a delivery service or anything like lhal, transpo rting through , gets pulled over by a police officer,

actually document ii. City Attorney Brotzman said it would be a lot to ugher . II actually would be a lot tougher to
do without having a license . Council Member Jefferson sa id without hav ing a sales license , I'm sorry , without
having a ... City Attorney Brotzman said without having ... Council Member Jefferson said without having this
lic ense tha t we are disc ussing here . City Attorney Brotzman sa id yes . You are going to hav11 to show them a lot
more paper work to document that th an th ey slmpl)' would have with our Finance Department.
Council Member Jefferson said I see . So ,ike I sa id, so for the person who is not doing business in Englewood
but is transporting through , it seems like a very heavy burden on them to ... so what exactly would they need to
prov ide? They will need to prov ide a list of their pat ients? City Attorney Brotzman said yes and they would
actually have to show , which would happen if this, if there was no license , you would be under the same
scenario is that you would have to be showing that you would still have that many patients since our language
mirrors the Constitution . You would actuall y have to show the same thing . You would actuall y have to show
that you have that many patients . You have the right uncJer the constitution to ha ve that many plants . The
problem is it is disorgan ized . You are going to have a mess and it is going to be time consum in g both for the
care-giver and for the police department to do th is . One of the nice th ings that th is license does is ii narrows
that down because you have a license . II is a requirement that you are keeping track of all these transactions .
II is very easy to present to either an audito r, somebody from the State or somebody from the police
department. II Is a nice organizational piece that our license provides the care-giver.
Council Member Jefferson sa id and I can S! a that, you know, certainl y for the people who , you know, who either
have a retail or grow operation or anything like that in the City , I am env isioning all of them be ing licensed . I
guess l ... okay , I appreciate the clarification on the folks who don 't do bus iness in Englewood , exactly what they
would be subject to . Just getting back to what exactly , I see this section under 5-22-5 .E suggesting that all
pri mary care-givers mu st possess a copy of the valid medica l marijuana patient reg istry card, correct? Mr .
Brotzman sa id correct. Council Member Jefferson sa id and so that is the ir patient's card, correct , so that they
have a copy of whoever the ir patient is . City Attorney Brot;.man said correct. Again so you would know how
many patients there are and then you could correlate that to how much marij uana they have . Council Member
Jefferson sa id correct and so they would need a license, or they would need a copy of each of their patient's
registry card in order to have the amount... in order, if they were transporting a large amount. City Attorney
Brotzman sa id correct.

th is issue , is there any interest In chang ing what the ... what word do I want to use here ... th is starting po int , I
suppose . You know , I think we heard from some of the Griego 's and whatnot that the winter hours would be
acceptable to the all off-leash all the time . I am just wondering if, you know , we might want to move to the point
of where we are beginning from or if everyone is opposed to that idea , I would propose to move it to the winter
period be ing off-leash all of the time as the beg inn ing point for the Publ ic Hearing .
Mayor Woodward said I th ink because we will be mak ing a dec ision , based upon the input of the Public Hearing
that , that would be the appropriate time to make those change s. And I would leave ii up to other peopl e, but I
wou ld th ink we would want lo have the ir Inpu t.

rule that we do not vote the same night as the Public Hearing?
City Attorney Brotzman said and actually you would not vo te on it that night. You would wa it one more meetin g,
Mayor Woodward said okay . So I just want to add to that then , that we will be , after the Public Hearing in an ex
parte co mmunication , and when it comes up at that follow ing meeting , comments regarding that are to be

Hearing a little bit more broad based rather than comment ing specificall y on these particular hours that are in

Council Member Jefferson said I don 't know that I, I guess , I wouldn 't encourage the Coun cil to totally disregard
any committee 's recommendation ; however , you know ultimat.!l y, I th ink wh at we discussed at the Study
Sess ion , in my mind , doesn 't make a reasonable sol uti on for u,; and you know, aga in that is just my pers onal
view at the moment. After speak ing with many of my constituents , I bel ieve that the majority is oat in favor of
what we disc ussed at the Council Sess ion . So that is why . I am mak ing this pos itional stetement now and
ultimately, I just think that , you know , when solut ions are put in these type of frameworks , it really frames the
Iss ue go ing forward and I j ust, you know . I would like to keep It as open as poss ible as we coll ect public

Hea ri ng and aboul the Summer Drama Program . I just want to re iterate aga in, I feel like , it sounds like a
won erful program . I'll be look ing for solutions to keep it anoal. There may have to be some , either digg ing
cteor f'/O m the City or perhaps some increases in the fees lh at participants pay , but I am hopeful that we ca n al l
be re~sonable about that and find a solution to keep ii afloat going forward .
2. He said to Jerry , I would generally agre e with you . You know , if we can find a way lo provide some
information ab out our fallen serv ice people , both mili tary and pol ice and fire type of service men . They do need
to be honored by our community and remembered . I'm wondering if we can do that giving our budg el

(iii ) Council Member Penn :
1. He sa id to jump onto Joe 's little comment : maybe we can '"rm a citizen comm ittee for the fallen soldiers '
type thing . Maybe , Gary , you could maybe advertise that ? I do th ink it is something that pro bably needs lo be
brought about. I don 't know in what fonm or to what degree that we go with that so I th ink that 's kind of nea t.
2. He sa id thanks to everybody from the Englewood Summer Drama . I know I talked to Mr. Ambron today
and whoever said that there were no confl icts at the summer program hasn 't dealt with Mr. Ambron very much .
There was laughter. They know what I am talking about. Just go out for the pl i y next year and you will
understand . We went to the production of the "Wizard of Oz " in 1966 so you are wa•,. way too late Don . We will
just outdo you , and of course , Bob and I knew Jack Fisher personally and I had him for in-class a couple of
times and I was in his class a couple of times . It was kind of fun to do that.
3. He said the notion of the Para de of Lights activity , I think we should go on wi th that and see if we can
put our trolley car in that and possibly see if there Is a way that we could represent the City of Englewood but
also maybe decorate that up . I know Doug would do a great job dri,ln~ that trolle y car and I know that he
doesn't have anything else to do .
4. He said I know we mentioned it last time , about Englewood Days . The committee was just excellent to
work with . We put on a great show and I thank them all again for be ing there and do ing all of that good work .
5. He said the parade . Thank you Joe for doing tha t. Thanks for bring ing that up and gett ing the parade
for homecoming done . I know some of us have been through many , many of those parades and unfortunate ly I
will not be part of it this year so ... but that's alright. I'll get back to Englewood one of these days and hopefully
we'll get goin g. I won't mention the score from last week . Mayor Woodward asked you did get to b< part of the
football game last Friday night , didn't you . Council Member Penn said yes I did get to be part of the football
game . It was just different be in g on th e wrong side .
6. He said I think one of the things that was talked about and I don 't know if there is anyway that we could
hook up Jesse with the dog shelter as a volunteer. I don 't know what process we could do with that. City
Manager Sears sa id we could make an effort to talk to them and see if they are available . Council Member
Penn sa id and I don 't know the criteria on that and everything so I'm sure we will have to look at tha t. City
Manager Se.~rs sa id sure .
7. He said we do have a sign code meeting tomorrow night , here in th e Community Center al 6:30 , is that
correct? 6:30 so please be involved , you people , that came down today . The sign code is tomorrow . You
might as well stay in the business , and stay in government and keep go ing with thal. That 's it. That 's all .

5. He said I went to the hosp it al yesterday , at Swedish , and had a nice vi sit with Vickie Burton , the wife of
Ric hard Burton, who was struck by lightening . Its tough when you have a resident of Englewood go through a
trag ic situation . But I think that family is very strong and I appreciate their support and I offered whatever I could
do to he:p them ... ! think he is on a good road to recovery and it sounds like it is going to be a long one but!
think ne has a lot of support . I met his daughters and so I wis h him luck . That's all I have .

(i) Mayor Woodward said I want to reiterate some of the things that were said , Jerry , the

id ea of memorializing fallen veterans , police and fire and I don 't know , regarding police and fire , but I think that
is a great ide a I think it is something that Jerry could be involved with . I'm sure that there is the information in
the library . There is certainly plenty of history there . I thi nK that is someth in g that I would support . It is going to •
be hard to put that together, certainly in 2010 , b11t ove r time it is something that could be put together and
recognize our Eng lewood residents .
(ii) Mayor Woodward sa ij Chris Duis and all of the Englewood Days people , aga in, thank
you for a wonderful product ion . Randy and the Grea ter Englewood Chamber, all of the work that was done ,
the ashuols , 1I,e City and everybody .
(iii) Mayor Woodward sa id Doug , 1:,e Parade of Lights idea is a very , very interesting idea .
Again , I would like to second the idea an d let's see if we can do something there ,
(iv ) Mayor Woodward sa id in regard to the sign code stuff, I th ink the sign code meeting
tomorrow nig ht... I understand that th e facilitator has talked to some people ; some of the bus inesses and is
moving fon ·:ard on that. Aga in, I just want to voice that these have to J 0 with community standar~s also ,
Co min g frr ,m the business world , that was my car,,er, that was what I did, was market ing and stuI i , there were
com munity standards . We have been provided in our Council newsletter , I believe it was , coming out vf
Co mmunity Development and the City Attorney 's Office , the tim etable and the process of going through and
getting th is done . Again , I tn,11•· we are fast track ing it. I think there has been some th,rgs that have been said
that I dis agree with , with re garo !o our response to the business community and things ; and we have , j ust in the
last year, done the 50 foot 111 ;1 c R-2 districts and we got :hat changed , whi ch had been talked about for some
time . We worked with the Bl . on the flags mutually , I think this Council had someth ing and some good ideas
to add that promoted that and ma de it even bette r. And also the right-of-way seating that basically deals with
some of th is si~n code issue . Without that , this sign code issue probably wouldn't be coming up tonight or if It
was such a co,cern ,n th e bu t,.eo ss commu nity, tt probably should have come up four years ago , after the
UDC . I think somethi ng w1 il be worke d out. I feel confident something will be worked out. Again , it's the
proces s and we have to go through the Code an d we will go through the process and get it done .
(v) May or Woodward said Erika and Michael have left and I look forward to homeco ming ,

(vi ) Mayor Woodward sa id again I want to thank Al an White and Nan cy Reid for the
informat ion that the y provid ed us on the Code with regard to cha nges in tha t sign code and the pro ces s that we
will have to go through .
(vii) Mayor Woodward sa id Matthew , I appreciate yo ur comments on the drama program
and your experience there . Jus t to go ba ck, the $46 ,000 .00 that you had mentioned was not for the trip to
Vegas . It is for much more than that. It is for the marl<eti ng mattria :s, the filming or the disk that was made , the
handouts , of whicr, we still have . That actual trip , for I believe was for fo ur members, cost about $4 ,000 .00 . But
that is not a cheap ... you have to pay for a place to stay .,, a booth type of th ing . This was brough t forward :o
ACE . ACE was ... Joe was there ... it was unanimous . A letter came to City Council support ing it an d
complimenting us on the foresight of send ing these peop le for th is and to continue do ing th at. Ultimately , th is is
about the property , wh ic h is referred to as the Mclellan property . It is property that is north and south of C-4 70
in Highlancis Ranch and also east and west of Lu cent Boulevard that the City of Englewood owns , tha t we have
no intention of selling , but we have the intention of leas ing . What it means is that we could expe ri ence from
$2.5 r.i illio n to $4 million of today 's dollars , pe .-year , with osca lat ion bu ilt in forward . I'd like to say forever but
forever is a long ti me and I won't be here fo r th at. It's r.ot tax dollars . It's revenue . My hat's off to the people ,
the Council that in 1953 bought all of that property . As Doug was pointing out a couple of nights ago to me ,
Mayo r Mclellan . That does not include the sale of our water and our reservoir . That does not get touched .
(vii i) Mayor Woodward sa id Jesse , I want to thank you for com ing forw ard a couple of times
and sharing with us some things that were diffic ult I've noticed you in Study Sess ions in the past and aga in, I
would lik e to see what we can do for him wit h the shelter and see if there is someth ing he could do over there .
The RTD parl<ing lot expans ion is what he was talking about out here , In the Fas Tracks project, we are ... the
City of Englewood was , as part of Fas Tracks , entitled to 440 odditional parking spaces . Th is is roughly 225 no w
and nothing Is final ized . It is going through ... there are a lot of processes that it has to go through so one of the
th ings about doing more than one level and going up two decks , Is that the cost of that triples or quadruples the
price , so it is something that is very difficult to evaluate and find the mone y for . So that is all I have .
