Call to Order ENGLEWOOD CITY COUNCIL EtlGLEWOOD, ARA 0 4HOE COUNTY, COLORADO Spacial Moating April 28 , 2003 The special mealing of the Englewood City Council was called lo order by Mayor Woodward at 6:21 p.m. 2. Roll Call Present Absent A quorum was present. Ordinances, Resolution and Motions (a) Approval of Ordinances on First Reading (I) City Altom ay Brotzman presenled a recommenda:ion lo adopt a bill for an emerg ency ordinance aulhorizing a moralorium on boarding houses In Englewood . He sa id you now have a correcled version of Council Bill No . 24 in front of you . The corrections from the original vers ion is that we added emergency in the title and the emergen cy provision is added lo Section 1. So , this becomes an emergency ord in ance lhal will take effect immeoialely upon final passage, after second reading on Mays~. Generally , lhis ord inance is addressing boarding and rooming houses . There currently is a problem in Iha! there is no defin ition or board ing and rooming houses , which we fou r· out through a mun ici pal court case . This puts lhe topic on hold so the Planning and Zoning Commission c , forward recommendations lo you and then yo ·,, can take a look al those new prov isions that will be prov ldeo "" boarding and room ing houses . Council Membe r Moore said my understanding is \hat essentially no board in g house is in ex islence as of today , April 28 , 2008 . Th is would prevent them from going in , unless they are ullimalely permitted after the moratorium is up . So Dan , even though we don 't pass lhls until second reading , we can use the April 28 , 2008 date , correcl? Cily Attorney Brotzman sa id they should actually be aware ton ig hl , upon your passage of first reading , nol to rely upon the provis ions of the Code where there is no defin llion . Council Member Moore said , relaled to this , as we enter the moratorium , I would like lo ask staff to figure oul how lo access how many boarding houses may exist My impress ion is thal we aren 'I aware of any current boarding houses out there . So , as we figure out what we need to do , as we come oul of the moratorium , we need lo understand , if there are any uses . So , I would lik e slaff to pursue how to do that. I'm assum ing thal !here may be some need , if there are any boarding houses , for them to self-ldenl ify . And on a relaled nole , I would like to und m:land If a board ing house would be a commercial property, what bu ilding codes tecome particularly rel!"/~' 1 10 a commerc ia l property such as Iha!, as opposed to if it's just a res ldenilal use? Englewood City Council April 28 , 2008 Page 2 COUNCIL MEMBER MOORE MOVED, AND COUNCIL MEMBER PENN SECONDED, TO APPROVE AGENDA ITEM 3 (a) (I) • COUNCIL BILL NO . 24 . COUNCIL BILL NO . 24 , INTRODUCED BY COUNCIL MEMBER MOORE A BILL FOR AN EMERGENCY ORDINANCE ESTABLISHING A TEMPORARY SUSPENSION OR MORATORIUM ON THE ESTABLISHMENT OF NEW "ROOMING OR BOARDING HOUSE " USES FOR A PERIOD OF SIX MONTHS . Mayor Woodward sa id so we have a motion to approve Counc il Btll No . 24 with two conditions ... that is for staff to determine how many current board ing houses exist as of today and any other codes, building codes , etcetera , that may be related to board ing houses . Council Member Moore clarified tha t it is not a condition on the motion, it 's just a request for additional information . Mayor Woodward asked if there was any discuss ion . There was nan o. Vote results: Motion carried . Ayes : Council Members Penn , Mccaslin, Moore, Woodward, Jefferson , Wilson, Oakley Nays : None 4. Adjournment MAYOR WOODWARD MOVED TO ADJOURN .
