SERIES OF 198~1~~ BY AUTHORITY COUNCIL BILL NO. 1 INTRODUCED BY COUNCIL MEMBER KEENA AN ORDINANCE AMENDING CHAPTER 3, TITLE XII, OF ENGLEWOOD MUNICIPAL CODE OF 1969, PROVIDING FOR PEDESTRIAN AND BICYCLE TRAILS IN SUBDIVISION REGULATION ORDINANCE. WHEREAS, by Resolution 17, Series of 1979, the Englewood City Council committed to support the Denver Region Element of the Air Quality Implementation Plan; and WHEREAS, the Englewood Planning and Zoning Commission has conducted a public hearing to consider inclusion of pedestrian and bicycle trail requirements in the Subdivision Regulations for the City of Englewood, favorably recommending the same. OW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ENGLEWOOD, COLORADO: Section 1. That Chapter 3, Title XII, of the '69 E.M.C.,be amended as follows: 12-3-4: DEFINITIONS For the purpose of this Chapter words and phrases used herein are defined as follows: (a) "Alley". shall mean a passage of way open to public travel which af forda generally a secondary means of vehicular access to lots abutting upon it and which is not intended for general traffic circulation. (b) "BICYCLE LANE" SHALL MEAN A PORTION OF A STREET RIGHT-OF-WAY DESIG ATED FOR THE USE OF BICYCLE TRAF IC. (c) "BICYCLE TRAIL" SHALL MEAN A PAVED OR OTHERWISE SURFACED OFF- STREET LANE DESIGNATED FOR BICYCLE TRAFFIC. (d) "Block" shall mean an area of land within a subdivision which is entirely bounded by streets, except alleys or the exterior boundary or boundaries of the subdivision. · (e) "Cul-de-sac" shall mean a short street having one end open to traffic and being terminated at the other end by a vehicular turnaround. (j ) "Ma ter plan" shall mean the comprehensive plan developed by the Planning and Zoning Coaunission and adopted by the Council for the physical development of the City, which includes any unit or part of such plan separately adopted and any amendment to such plan or parts thereof. (k) "Master street plan .. shall mean part of the City master plan showing location and classification of principal trafficways. (1) .. Parking" shall mean city-owned property which lies between the front lot line and the traveled surface of the street, usually designated by the curb. (m) "PEDESTRI AN TRA IL" SHALL MEAN A PAVED OR OTHERWISE SURFACED OFF- STRE ET LANE DES IGNATED FOR PEDESTRIAN TRAFF IC. (n) "Planning Commission" or "Commission" shall mean Planning and Zon i ng Commi ssion of the City of Englewo od. (o ) "Roadway" shall mean portion of a street right-of-way designated f or vehicul ar traffic ; where curbs are in place, the portion between curbs. (p ) "Sidewalk" shall mean portion of a street right-of-way, paved or otherwise surfaced, intended for pedestrian use only. {q ) traffic. "Street" shall mean a pub lic right-of-way for vehicular or pedestrian Streets are classified as follows: (1) Freeway --provides for expeditious movement of large volumes of through traffic and generally not intended to provide land- access service except by use of grade separation which may be combined with parallel frontage roads • -2- • • • (2) Arterial --provides for "through" traffic movement connecting major land use elements within the City, and connecting the City and adjacent communities with one another. Direct access is ordinarily provided to abutting property; however, considera- tion must be given to the control of entrances, exits, and curb use in order that the traffic movement can be relatively unimpeded throughout the City. (3) Collector Street --provides for traffic movement between arterials and local streets with direct access to abutting property. (4) Local Street provides for direct access to abutting land, and for local traffic movement primarily in reaidential areas. (5) Industrial and Commercial Street --theae are generally re- lated to the physic al use characteriatics of abutting land and to the type of vehicular traffic generated by these uses. The street may be either arterial, collector, or local in designation. (r) "S ubdivider" shall mean any person, or other entity, or any agent the r eof , dividing or proposing to divide realty • Section 2. That Chapter 3, Title XII, Section 22(2) (F) and (K), of 1 69 E.M.C ., are amended to read as follows: 12-3-22: CONTENTS OF PRELIMINARY DESIGN (2) (F) Location, widths and, where appropriate, names of all existing and proposed rights-of-way for streets, alleys, BICYCLE TRAILS, or other public ways and all existing and proposed easements, either public or private, for utilities, drainage, or other purposes, within the area proposed for subdivision and at least 100 feet inunediately adjacent thereto. (K) Typical cross sections of proposed streets show the widths of roadways and the location and dimensions of BICYCLE LANES, sidewalks, curbs, gutters, and other structures to be located within the right- of-way. Section 3 . That Chapter 3, Title XII, Section 23, of the '69 E .M.C . b e amended by adding a new subsection (e) as follows: -3- . . • • • 12-3-23: VICINITY SKETCH (e) DESIGNATED BICYCLE AND PEDESTRIAN TRAILS WHICH HAVE BEEN ADOPTED BY THE CITY OF ENGLEWOOD OR INCLUDED IN THE REGIONAL BICYCLE TRANSPORTATION PLAN, IF WITHIN 1300 FEET OF EACH BOUNDARY OF THE AREA. Section 4. That Chapter 3, Title XII, Section 25(c), of the '69 E.M.C., be amended to read as follows: 12-3-25: REVIEW OF DESIGN (c) The Commission shall review and consider the Preliminary Design and Vicinity Sketch with particular attention to the following matters: (1) (2) (3) (4) (S) (6) (7) The zoning of the property proposed for subdivision, to- gether with the zoning of the areas immediately adjacent thereto; The proposed layout of lots and blocks, and the proposed dimensions thereof to demonstrate compliance with applicable yard area requirements; The availability of all utilities, and the proximity thereof to the area proposed for subdivision; Topography and natural features of the land with special reference to flood plains; The continuity of streets and alleys within the area proposed for subdivision, and the design and location of such streets and alleys, with relation to existing streets and alleys, both within and without the area proposed for subdivision, and the Master S.treet Plan; ALL RIGHTS-OF-WAY TO BE DESIGNED AND LOCATED TO FACILITATE THE SAFE MOVEMENT OF PEDESTRIANS AND BICYCLISTS, AND AVOID OR ELIMINATE EXIS TING OR POTENTIAL NATURAL OR MAN-MADE BARRIERS AND HAZARDS TO SUCH MOVEMENT. ALL BICYCLE AND PEDESTRIAN FACILITIES SHALL BE SELECTED, LOCATED AND DESIGNED IN ACCORDANCE WITH CURRENT CI ·ty STANDARDS· HOWEVE~, BICYCL E LANES AND BICYCLE TRAILS SHALL NOT BE REQU IRED FOR SUBDIVISIO?TS ENCOMPASSING LESS 'JllHAN FiVE ACRES. -4- .. 1' .. • • • (8) The location of utility and other easements; (9) The locat i on of, and provision for, pu blic areas, including land re se rved for parks, s chools and other public uses; (10) The met hod of collection and disposal of drainage and sur- face wa ter; (11) Any othe r ma tters which th e Commission deems important to .be consid e r e d i n o rder to ac c omplish the purposes set forth herein .
