HomeMy WebLinkAbout1981 Ordinance No. 003• • • ORDINANCE O. 3 ---SERIES OF 198 1 BY AUT HORITY COUNCIL BILL NO. 3 I NTRODUCED BY COUNCIL MEMBER KEENA AN ORDINANCE SUBMITTING TO A VOTE OF THE QUALIFIED ELECTORS OF THE CITY OF ENGLEWOOD, COLORADO, AT A SPECIAL ELECTION TO BE HELD MARCH 24, 1981, PROPOSED AMENDMENT TO THE CHARTER OF THE CITY OF ENG LEWOOD AS FOLLOWS: BY ALLOW'ING THE IDENTIFICATION OF CITY VEHICL ES IN A NONCONSPICUOUS MANNER BY ANNUAL NOTIFICATION TO CITY COU NCIL, AMENDING SECTION 115 OF ARTICLE X OF THE HOME RULE CHARTER . BE IT ORDAI NED BY THE CITY COUNCIL OF THE CITY OF ENGLEWOOD, COLORADO: Section 1. There is hereby submitted to the qualified electors ol the city of Englewood at a special election to be held on March 24, 1 981 proposed amendment to the Charter of the City of Englewood, as follows: That e ffective immediately upon approval of the qua!ified electors of the City of Englewood and the certification thereof to the office of the Secretary of State of Colorado, pursuant to Section 9, Article xx, of the Colorado Constitution, the Ch a rter of the City of Englewood, and Section 31-2-210, Colorado Revised Statutes of 1973, as a mended, Article X, Section 115, of the Home Rule Charter of the City of Enqlewood is hereby amended to read as follows: 115: PROPERTY IDENTIFICATION The purchasing officer shall require all nonexpendable City p roperty to be marked with identification or number to pre vent misuse thereof and shall cause all automobiles, trucks and movable road and street machinery to be marked by EITHER A conspicuous OR NONCONSPICUOUS MARKING means with t he term "City of Englewood". FOR IDENTIFICATION PURPO SES, A SMALL PLATE WITH THE CITY'S VEHICLE UNIT NUMBER WILL BE INSTALLED ON THE DOOR JAMB OF ALL INCON- SPICUOU S VEHICLES. TH E CITY MANAGER SHALL ANNUALLY INFORM THE COUNCIL AS TO WHICH VEHICLES HAVE BEEN IDENTI- FIED IN AN INCONSPICUOUS MANNER. It shall be unlawful for any unauthorized p erson to have City property in his posses sion at any time; the use of City property for unauthori z ed pr i vate p urposes is hereby prohibited • • • • Section 2 . The voting mach i nes and paper ballots for said election shall carry the following designation which shall be the submission clause: FOR AMENDMENT NO. 7 AGAINST Shall the Home Rule Charter for the City of Englewood be ame nded to allow the nonconspicuous identification of City vehicles with annual notification to City Counci l of such identification amending Section 115 of Article X? And each elector voting at said election and desirous of voting f o r or against said amendment shall indicate his choice by depressing t he appropriate counter of the voting machine which indicates t he word "For" or "Against" or by the appropriate marking upon paper ballots, where used. Section 3 . A special election is called to consider the fore- going amen dment to the Charter of the City of Englewood along with other p roposed Charter amendments for the 24th day of March, 1981 . It is expressly understood that only one special election is called to consider multiple questions • Section 4. The proper officials of the City of Englewood shall give notice of said general municipal election, which notice s hall be p ublished in the manner and for the length of time required by law, and the ballots cast at such election shall be canvassed and the result ascertained, determined, and certified as required by law.
