AN ORDINANCE APPROVING AN AGREEMENT BETWEEN THE CITY OF ENGLEWOOD
AND MISSION VIEJO WAT ER AND SANITATION DISTRICT GRANTING EASEMENTS
ACROSS THE CITY OF EN GLEWOOD REAL PROPERTY LOCATED IN DOUGLAS
COUNTY, STATE OF COLO RA DO.
WHEREAS, Missi o n Viejo Water and Sanitation District, a
quasi-municipal corpo r ation organized und e r the laws of the State -
of Colorado, operates water and sani t ation facilities; and
WHEREA S, the City of Englewood has e ntered into an agree-
ment to sell to Missi o n Viej o Water an d Sanitation District raw
water; and
WHEREAS, ac c ording to said agreement , it is necessary to
const ruct water lines for the physical transfer of raw water
from the City of Englewood property to th e property serviced by
Missi on Viejo Water and Sanitation District.
NOW, THEREFORE, BE I'I' ORDAI NED BY 'I'HE CITY COUNCIL OF 'I'HE
CITY OF ENGLEWOOD, COLORADO:
Section 1. The City of Englewood shall grant to Mission Viejo
Water and Sanitation District, a quasi-municipal corporation
organized under the l a ws of the State of Colorado, an easement
over, across and l_hrough re d l prope r t y l e ga lly described as foll ows ,
to wit:

Section 2. That the Gra nt of Water Line Easement is an agreement
consisting of three type written pages plus Exhibit A, consisting of
one page, and Exhib i t A-1 , c on sl sting of one page, as attached hereto
and inco rporated h e r e in by r efe r e nce . The agreement generally pro-
vides f or an easement ove r that property previously described and
a temp orary e aseme nt for p u r pos e s of construction, repair and
mainte nanc e . The easement a llows the nonexclusive use for the
purpos e s of water lines a nd appurtenant equipment. Access to the
easeme nt is granted and Mission Viejo Water and Sanitation District
is req uired to restore the easement property and temporary easement
property to the condition it was in immediately prior to construction,
repair or maintenance as ne arly as is practicable. The City shall
not construct improvements in the nature of structures or buildin gs
on the easement property. There is no such restriction with respect
t o c o nstru ction on t h e t e mpora ry easemen t . In the event of the
abandonment of the line by Mi ssion Viejo Water and Sanitation
District, the City may requ ire the District to remove or neutralize
any improvements constructe d in the easement.
Section 3. That the Grant of Water Line and Pump Station Easement
-nt consi stJ n g of t h ree t yp e wr it ten pages plus Exhibi t "A",
of three t y p e wr i lten pa ges, and Exhibit A-1, consisting
of one page , as attached hereto and incorporated herein by reference.
The agreement generally provides for an easement over that property
previously described and a temporary easement for purposes of
construc tion, repair and ma i n tenance. The easement allows non-
e xclus i ve use for the pur po s e of water lines and appurtenant equip-
ment. Access to the easeme nt i s granted and Mission Viejo Water
and S an itation District i s required to restore the easement property
and temporary e asemen t prope r t y to the condition it was in immediately . .

Water Line and Pump Sta tion Easement and Grant of Water L ine Easement
and hereby authorizes t he Mayor of the C ity of Englewood to affix
his signature thereto f or and in behalf o f City Council o f the City
of Englewood and autho rizes the Direc t o r o f Finance ex officio Ci t y
Clerk-Treasurer to atte st the same .
Section 5 . This ord inan ce shall not be e ffective until the Gr ant
of Water Line Easemen t and Grant of Wa t er Line and Pump Station
Easement are approved by Mission Viejo Water and Sanitation District,
the Mayor of the City of En g l e wo o d and the Director of Finance ex
offic io Ci ty Clerk-Treas urer •
