SERIES OF 198l l!i COUNCIL BILL NO. 82 INTRODUCED BY COUNCIL MEMBER FITZPATRICK AN ORDINANCE AMENDING TITLE IX, CHAPTER 6, SECTION 35, OF THE ENGLEWOOD MUNICIPAL CODE '69, BY ADDING A PROVISION REQUIRING A DEPOSIT FEE FOR A BUSINESS THAT CONDUCTS A "GOING-OUT-OF- BUSINESS SALE." WHEREAS, the City of Englewood deems it necessary to require a depoait from businesses which are defined in Title IX, Chapter 6, Secti on 31, for guaranteed receipt of final sales tax payment which re•ulta from the end-of-business sale; and WHEREAS, the purpose of this deposit is to insure the payment of the Englewood 3' •ales tax required by Title XIII, Chapter 4, Section 2, and Title XIII, Chapter 4, Section 3, of this Code. NOW, THEREFORE, BE IT OR DAINED BY THE CITY COUNCIL OF THE CITY OF ENGLEWOOD, COLORA DO : Section 1. That the fo llowi n g languaq~ be added to Title IX, Chapter 6, Section 35: THE APPLICANT SHALL Al.SO DEP OSIT WITH THE LICENSING OFFICER AN AMOUNT EQUAL TO 3\ OF THE RETAIL VALUE OF THE GOODS TO BE SOLD DURI NG THE FIRST WEEK OF THE SALE. THE LICENSING OFFICER SH ALL ESTABLI SH THE DEPOSIT BASED UPON PRIOR SALES TAX REP ORTS FI LED WITH THE LICENSING OFFICER BY THE APPLICANT. AFTER THE F IRST WEEK OF SALE AND PRIOR TO ANY SUBSEQUENT WE EK OF THE SALE, THE APPLICANT SHALL DEPOSIT WITH THE LICENSIN G OFFICER AN AMOUNT EQUAL TO 3% OF THE RETAIL VALUE OF THE GOODS SOLD IN THE PRIOR WEEK OF THE SALE. THE DEP OSIT MAY BE IN THE FORM OF CASH OR A BOND ACCEPTABLE TO THE LICENSING OFFICER. THE RECORDS AND TRANSACTIONS OF THE APPLICANT SHALL BE SUBJECT TO WEEKLY REVIEW BY TH E LI CENSING OFFICER DURING THE PERIOD OF THE SALE. LICENSEES FAILING TO COMPLY WITH THE SALES TAX FILING AND PAYMENT PROVISIONS OF TITLE XIII OF THIS CODE SHALL FORFEIT THEIR DEPOSIT AND THE LICENSING OFFICER SHALL PURSUE THE PROPER COLLECTION OF ALL AMOUNTS PROPERLY DUE TO THE CITY UNDER TITLE XIII OF THIS CODE.
