AN ORDINANCE CREATING PAVING DISTRICT NO. 27 IN THE CITY OF
ENGLEWOOD, COLORADO, ORDERING Tiii CONSTRUCTION AND INSTALLATION
OF STREET PAVING, CURB AND GUTTER AND SIDEWALK IMPROVEMENTS;
PROVIDING FOR THE ~SSUANCE OF BONDS IN PAYMENT FOR SAID IMPROVE-

WHEREAS, the ·City Counc i 1 of Inglewood, Colorado,
pursuant to the Charter and the Municipal Code of the City, and
the Laws ot the State of Colorado, hereby finds and determines
that there exiata a necessity for the creation of Paving District
No. 27, in the City; and the construction and installation therein
of street: paving, curb and gutter and sidewalk improvements on
certain ~treeta and alleys as more particularly described herein;
and
WHEREAS, Notice of a public hearing concerning the
creation 'of th• District and the construction and installation of
the improve .. nta therein has been published once a week for three
consecutive weeks in the Englewood Sentinel, a newspaper of
general circulation in the City, and in addition, a notice has
been mailed, postage prepaid, to each known owner of real property
within the proposed District; and
WHEREAS, a~ the time and place set forth in the notice,
the City Council met in open session and heard and considered all
protests and objections to the proposed district and the construc-
tion and installation of improvement• therein1 and
WHEREAS, the City Council haa overruled all such protests
and objections, except as follows:

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
ENGLE~OD, COLORADO:
Section 1. Creation of the District. That a special
improvement district for the construction, installation or im-
provement of the improvements hereinafter described, is hereby
created and established in accordance with the Charter and the
Municipal Code of the City, and the Laws of the State of Colorado,
and shall be known and designated as •paving District No. 27".
All proceedings heretofore taken and adopted in connection with
the District are hereby ratified, approved and confirmed.
Section 2. Engineering Plans and Specifications. That
the engineer'• reports, together with all of the details, specifi-
cations, estimates, maps and schedules thereto attached or ap-
pended, are hereby approved and adopted.
Section 3. District Boundary. The extent of the
District to be assessed for the cost of the improvements and the
area to be included within the boundary of the District, shall be
all the real property specially benefited, and fronting or abutt-
ing on the streets and alleys between the termini hereafter
described, including the real property within one-half (1/2) block
of such streets and alleys. Adjustments for the assessment of
costs will be ~ade for irregular and odd-shaped lots and parcels
of property.
Section 4. Description of Improvements. The kind
of improverrents and the streets and alleys on which such improve-
ments shall be constructed or installed shall be as follows:

Section 5. Iaproveaenta Authorised. Th• conatruction
or installation of the atreet paving, curb and gutter and sidewalk
i proveaent• in and for th• Diatrict, aa ahown by the plans,
pecif ications and aps thereof, approved by the City Council of
the City, is hereby authorized and ordered, the material to be
used in the construction of said improvements to be in accordance
with such m&pa, plana and apecificationa.
• Se tion 6. Aaaeaiaaent of Coats. The probable total
co t of tne iaprovements to be constructed or installed is
$429,568; it is proposed that the City of Englewood will pay
approxiaately $132,182;· the remainder of the c~st will be assessed
against the property within the district and specially benefited
by the construction and installation of the improvements. The
approximate ahare of the total coat to be assessed per front foot
or square foot against any lot or tract of land fronting or
abutting on said iaprovements will be as ~re particularly set
forth in the reaolution passed and . adopted on March 3, !9PO, and
which i• incorporated herein by apecific reference.
Section 7. Payment of Assessments. The assessments
will be due and payable without demand within thirty (30) days
from and after the final publication of the Ordinance assessing
the whole coat of aaid improvements against the real property
in the District. In the event any owner of real estate shall
fail to pay the whole of such assessment against his or ·her
• property within aaid thirty (30) days, then the whole cost of the

ten (10) equal annual inatall•nta of principal. Th• first of
.such install .. nts of principal shall be due and payable at such
time as will be deterained in the asses~ing ordinance and the

sively on the same day in each year thereafter, until all are paid
in full. The rate of interest to be paid on unpaid and deferred .
installaents will be established by ordinance to be adopted by the
City CO'.lncil at a later date.
Section a. Special Illprovement Bonda. By virtue of and
pursu1tnt:. to aaid law• and the Charter and .the Municipal Code of
the City, local improve .. nt bonds of the City shall be issued for

the purpoae of paying for the local improvements described in this
Ordinanc , in an aJ10unt not to exceed the cost and expenses of
said iaprove•nts, including engineering, legal and incidental
expenses, as provided by law. The bonds shall be issued based
upon estiaates approved by the City Council, and as authorized by
an Ordinance to be passed by the City Council at a later date.
• The maximum rate lf interest on special improvement bonds for
Paving District No. 27, shall not exceed fourteen (14) per cent

per annua. The bonds and the interest thereon shall be payable
out of special assessments to be levied against the real property
included within the District and specially benefited by.the
improvement• to be constructed or installed.
Section 9. Advertisement for Construction Bids. The
City i• authorized to advertise for bide for the construction of
the street paving, curb and gutter and sidewalk improvements, in
accordance with the Charter and Municipal Code of the City.
Section :o. Gen•ral Benefit•. Th• City Council hereby
finds and determines that the . improve•nta propoaed to be -con-
s tructed and installed will confer a special benefit upon the
property within the District and a general benefit upon the
City as a whole:

able or invali d, such judgment shall not affect, impair or
invalidate the remaining provisions of thia Ordinance, it being
the intention t hat the various provision• hereof are aeverable.
Section 12. Hearinq. In accordance with Section 40 of
the City Charter, the city Council shall hold a public hearing
on this r :dinan ce, before final passage, at 7:30 P.M. on Monday,
April 2 1, 1980 .
Section 13. Publication and Effective Date. This Ordinance
after its final passage, shall be numbered and recorded, and the
adoption and p ublication shall be authenticated by the signature
of the Mayor and the Director of Finance, ex officio City Clerk-
Treasurer, and by the Certificate of Publication. This Ordinance
shall become effective thirty (30) days after publication follow-
ing final pass age.

the 7th day of April, 1980.
