HomeMy WebLinkAbout1980 Ordinance No. 013• • • • • ORDINANCE NO . 13 SERIES OF 19 80 BY AUTHORITY COUNCIL BILL NO. 15 INTRODUCED BY COUNCIL MEMBER KEENA AN ORDINANCE APPROVING AN AGREEMENT BETWEEN THE CITY OF ENGLEWOOD, COLORADO, AND THE CITY OF GREENWOOD VILLAGE, COLORADO, RELATING TO THE USE OF THE ANIMAL SHELTER FACILITIES WITHIN THE CITY OF ENGLEWOOD, COLORADO. WHEREAS, the City of Englewood, a municipal corporation, operates and ma i ntai ns an animal shelter and disposal facility within the Ci t y ; and WHERE AS, the City of Greenwood Village desires to partici- pate in the use of said facility; and WHEREAS , i t is mutu~ll y desirable, under the provisions of Title 29, Arti cle 2, CRS '73, as amended, to enter into said Agreement. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ENGLE WOOD, COLORADO, as follows: Section 1. That the City o f Englewood, Colorado, and the City of Greenwood Vi llage , Colorado, shall enter into an Agreement consisting of seven (7) typewritten pages, a copy of which is attached he reto, and which Agreement, among other things, generally provides fo r the City furnishing facilities to receive, house, feed, and otherwise care for an i mals ordered impounded by Greenwood Village: fi::>rcol lection of fees and fines for Greenwood Village; for adoption or other disposal of animals; and imposing fees for the boa r ding or disposal of impounded animals. Section 2. The Mayor is hereby authorized and directed to execute the s ame for and on behalf of City Council of the City of Englewood, Colorado, and the Director of Finance, ex officio City Clerk-Treasurer, i s hereby directed to attest the same and affix the official seal of the City thereto. A G R E E M E N T -.,. ---------- lHIS AGREEMENT, entered into by and between the CITY OF E GLEWOOD, COLORADO, a Municipal corporation, hereinafter referred to as "City" and the CITY OF GREENWOOD VILLAGE, COLORADO, herein- after referred to as Greenwood Village. WITNESSETH: WHEREAS, the City of Englewood, a Municipal corporation, operates and maintains an animal shelter and disposal facilities, hereinafter referred to as "facility":, incident thereto; and WHEREAS, Greenwood Village desires to participate in the use of said faciliti es; and WHEREAS, both City and Greenwood Village find it mutually desirable under the provisions of Title 29, Article 2, C.R.S., 1973, as amended, entitled, "Contracts for Governmental Services", to enter into this Agreement . NOW, THEREFORE, it is agreed by and between the parties • hereto as follows: -1- . . • • I. That the City of Englewood, Colorado, shall provide an animal shelter facility and service incident thereto consisting of the following: 1. A modern, sufficient structure to accomodate sixteen (16) animal run s and sufficient cages for confinement of small animals. 2. Adjacent to the building, there shall be fenced an area a equate to confine larger animals, being horses, donkeys and animals of such larger sizes. 3. A euthanasia chamber of sufficient size to euthanize large, medium and small dogs or other small animals. 4. A gas-fired incinerator sufficient to cremate all dogs and smaller a n i mals. 5 . The entire pound area shall be fenced and parking pro- vided for the public. 6 . The City shall receive, house, feed and otherwise care for those animals ordered impounded by Greenwood Village. -2- .. . . 7. At all times the City Animal Shelter shall be kept • c l e an and all animals received from Greenwood Village shall be pro- p erly fed, cared for and treated humanely. • 8. The City shall accept from the proper officers or ~ardens of Greenwood Village all animals delivered to it for care on a seven (7) day per week basis, (twelve (12) hours on weekdays, and two (2) hours on Saturdays, Sundays and holidays). In the event of n emergency situation, the City agrees to cooperate with Greenwood illage in making the facility available to proper officers or wardens o f Greenwood Village. 9. Th e Shelter shall be open to the public for the claim- ing of animals or other purposes for a minimum of four (4) hours on weekdays and a minimum of two (2) hours on Saturdays, Sundays and holidays. A specific schedule is to be established by the City. 10. The City shall provide telephone facilities and acco- mmodate Greenwood Village by releasing animals, collecting Greenwood Tillage charged fees and fines, and shall remit all such collected f ees or fin s to the proper Greenwpod Village agent monthly. The City shall follow the release procedures as outlined by Greenwood Village. 11. All animals shall be disposed of by the City after the 6th d~y of confinement at the animal pound or on a date specified upon written notice from Greenwood Village. Disposal may be through adop- • tion, transfer to a research agency, or euthanized and cremated. -3- . . Th e Ci ty shall have the right on the 7th day to allow for .;9 the adoption of dogs and charge a fee of not less than $40.00 for the purpose of allowing the new owners to have the dog neutered. The fee • • shall be u s ed b y the City to reimburse veterinarians approved by the City . 12. Necessary impoundment forms and administrative proce- dures shall be established by the City. 13 . Established regulations and procedures covering all impounded Greenwood Village animals shall remain in effect and be amended or modif ied only with the mutual consent of the parties to this Agreement. The City shall cooperate in making, implementing and carrying out said regulations and procedures • II. 1. The City shall set the fees for boarding and disposal of animals on an annual basis, based upon usage and costs associated with maintenance and disposal of animals. For .h 2 year 1980 the fees shall be as follows for dogs and cats: Disposal $15.35 per dog or cat Boarding $ 1.85 per day -4- • • • Th e above fees are subject to annual increases based on antici pa ted i nc r eaaea in cost at the animal shelter. Fee increases ' shall be limi ted to a maximum of 101. per ~ear. The basis for the increase in the above fees shal l be ~he City's operating budget for the pound. The base used shall be the fees refle c ted in this agree- ment . The City s hall notify Greenwood Village by October 1 of each year of any change in fees. Greenwood Village shall notify the City by November 1 i n wr i ting their rejection or acceptance of the fee structure. 2. The City shall charge Greenwood Village for actual costs of dispo sing or boarding larger animals other than dogs or cats. This cost will be reflected separately on the billing by the City~ 3. The City shall have the right to charge a minimum of $40.00 for adop t i on of dogs or cats. The charge for adoption shall be used to offset costs involved in having dogs or cats neutered by a qualified vete rinarian. 4. .Th e City upon wr i tten authority by Greenwood Village shall write animal citations for Greenwood. If the City's animal wardens are requ i red to appear i n court for citation written for Greenwood Village , City shall be reimbursed for actual hours spent in court. The charge for this time shall be based on the animal warden's hourly compensation rate. For purposes of the agreement -5- hourly compe n sat i on rate shall include salary, FICA, workmen's • compensation, i nsurance and pension. If the time spent in court results in overtime, the reimbursement shall be on the basis of 1.5 t i mes the salary and FICA and a minimum of two hours. Charges for time spent in court shall be reflected separately on the City's bill- i n g to Greenwood Vil lage ~ • • 5. Ad ditions to the physical structure of the animal pound shall be agreed upon by Greenwood Village. The costs of con- struction shall be shared by Greenwood Village based upon the last three years u sage. Usage shall be based on do_g days for Greenwood Vi l lage. For e xample, if the pound had a total of 10,000 dog days and Greenwood Vil lage had 1,000 dog days, Greenwood Village's share of construction coats for expansion of the pound would be 101. • 6. Impoundment fees charged by Greenwood Village to dog owners shall b e established by the City. For purposes of this agree- ment the impoun dment fee shall be $12.00 and the daily boarding fee shall be $2.0p . ·The City shall collect these fees for Greenwood Village and the City will reflect the revenue as credit against Greenwood Village charges for the animal pound. This revenue will be reflected s4parately on the City's billing. Any changes i n impoundment fees shall be effective January · 1, of each year . Greenwood Village shall be notified of any charges by Octob~r 1 of each year and shall notify the City by November 1 of each year in writing of Greenwood Village's acceptance or rejection of the fee charge . -6- . . ·;.
