BY AUTHORITY ORDINANCE NO. 20 SERIES OF 1980 COUNCIL BILL NO. 20 INTRODUCED BY COUNCIL MEMBER FITZPATRICK AN ORDINANCE APPROVING A CONTRACT BETWEEN THE CITY OF ENGLEWOOD, COLORADO AND THE STATE DEPARTMENT OF HIGHWAYS, DIVISION OF HIGHWAYS, CONCERNING CONSTRUCTION OF LITTLE DRY CREEK BRIDGE AT SOUTH PLATTE RIVER DRIVE IN THE CITY OF ENGLEWOOD. WHEREAS, the City of Englewood, Colorado, is desirous of entering into a contract with the State Department of Highways, Division of Highways, concerning the construction of a bridge on Little Dry Creek at South Platte River Drive; and WHEREAS, pursuant to Section 135 of the Federal-aid Highway Act of 1976, 23 u.s.c. Section 219, as amended, certain Federal funds have been allocated for the · improvement of public roads. and streets which are not on any Federal-Aid Highway System, such program referred to as Safer Off-System Roads Program {SOS Program}; and WHEREAS, the Federal Highway Administration has issued guidelines for implementation of the SOS Program in Vol. 8, Chapter 2, Section 2, of the Federal Highway Program Manual; and WHEREAS, in accordance with the procedures established in the SOS Plan, the Special Highway Committee of Colorado Counties, Inc. and the Colorado Municipal League has selected SOS Program, identified as SOS 0010(5), for preliminary engineering and construction on Little Dry Creek Bridge in Englewood, Colorado; and WHEREAS, the ratio for Federal-aid project is 78% Federal- aid funds to 22% Local Agency funds, or an estimated $131,591 Federal funds to $37,115 of local funds to be split between Urban Drainage Flood Control District and the City of Englewood, making the City's share approximately $18,557.50. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ENGLEWOOD, COLORADO: Section 1. That the City of Englewood, Colorado, and The State Department of Highways, Division of Highways, shall enter into a contract for the preliminary engineering and construction of Little Dry Creek Bridge at South Platte River Driver in Englewood, Colorado, with Federal funds allocated pursuant to Section 135 of the Federal-aid Highway Act of 1976, 23 U.S.C. Section 219, as amended. A copy of said contract, consisting of · sixteen (16) • • : • • typewritten pages, is attached hereto and incorporated herein by reference and provides generally as follows: The City will arrange for preliminary engineering, design services and preparation of construction plans, and construction, acqui~ing necessary rights of way for completion of the project, including any necessary construction easements, execution any and all agreements necessary with the railroads and/or public utilities, to complete said improvements: that said project is under State administration of the SOS Program at a total estimated cost of $168,706, of which $131,591 will be in federal funding, and $37,115 in loca l funding to be split evenly beteen Urban Drainage Flood Control District and the City of Englewood, making the City's share approximately $18,557.50, all as is more fully set forth in said Contract. Section 2. The City Council of the City of Englewood, Colorado, hereby authorizes the Mayor of the City of Englewood, Colorado, to subscribe his name to said Contract for and in behalf of the City Council and the City, and the Director of Finance, ex officio City Clerk-Treasurer , to attest the same • Introduced, read in full, and passed on first reading the 7th day of July , 1980. GENERAL PROVISIONS The State will administer the SOS Program in accordance wit6 the SOS Plan and require from cbe Local Agency only necessary plans, speci- fications and estimates. The Local Agency will arrange for preliminary engineering, design services and preparation of construction plans, special provisions and esti- mates in accordance with the requirem.ents of the· SOS Plan. Construction plans will be prepared in accordance with the requi.rements of the State's plan pre- paration procedure. The Loe l Agency will comply with the applicable provisions of the State's Action Plan and SOS Plan, includir.g all Federal directives contained therein by reference, and will in addition take appropriate actions relative to the following section• of the Federal-Aid Highway Program Manual (FHPM): 1. 2. 3. Prior to this project being advertised for bids, the Local Agency will certify in writing to the State that all such clearances have been obtained. I. In the event the project involves modification of a railroad company's facilities at a railroad ~ade crossing with the work being accomplished by rail- road company forces, the Local Agency shall make application to the Public Utilities Commission re- questing its order providing for the ~1tallation of the proposed improvements. It may be agreed to participate in the work baaed on actual costs of labor, equipment rental, materials supplies and supervision necessary to comp l ete the work. Where actual costs are used, eligi bility of cost items shall be evaluated for compliance with Federal Procurement Regulations Part 1-15. · Rental rates for publicly owned equip- ment w~ll be the second shift rental rate per hour as e stablished in the State's Construction Equipment Rental Rate Schedule dated May lr· 1979 . or subsequent revisions thereof. The Local Agency shall, dur i ng all phases of the work, permit duly authorized . agents and e~ployees of the State and the FHWA to inspect the project · and to inspect, review and· audit the project records . M. The Local Agency shall maintain all books, documents, papers, accounting records and other evidence per· taiping to coats incurred and to make such material.a available for inspection at all reasonable times during the contract period and for 3 years from'the date of final payment to the Local Agency. Copies of auch records shall be furnished by the Local Agency if requested. M. The Local Agency will maintain and operate the im- provements constructed under this contract, at its own coat and expense during their useful life, in a manner satisfactory to the State and FHWA, and will m.3ke ample provision for such maintenance 'each year. Such maintenance and operations shall be in accordance with all applicable statutes and ordinances, and regulations promulgated thereunde~, which define the Local Agency's obligation to maintain streets and street fixtures. The State and FHWA will make periodic inspectio~s of the project to verify that such improvements are being adequately maintained.. 0 . The State will administer the Local Agency and Federal -aid funds for this project in accordance with the following provisions: 1 . Charr,es incurr~d by the Local Agency prior .to the date of FHWA authorization for the project will not be charged to the project. 2, Costs incurred by the $tate ' The State will prepare monthly estimates of construction coats and/or other costs incurred by the State for work performed relative to the project. Tbo State will prepare said estimates in accordance with the State's standard policies and pro- cedures. As funds are expended during the cwr•e · of the work, the State will . bill the Local Agency monthly for the Local Agency .share of such expenditures. Upon completion of the work to be per- formed under this contr~ct and acceptance thereof by the State, FHWA, and the Local Agency, the State will submit a final recapitulation of project costs to the Local Agency and a final billing ~or the balance due of its share of participating I costs plus all non-participating costs. Upon receipt of each bill from the State, the Local Agency will remit to the State the amount as billed.
