Home My WebLink About1980 Ordinance No. 052' , • • • ORDINANCE NO . 52 SERIES OF 1980 BY AUTHORITY COUNCIL BILL NO. 57 INTRODUCED BY COUNCIL MEMBER NEAL AN ORDINANCE APPROVING AN AGREEMENT FOR LIBRARY SERVICES BETWEEN THE CITY OF ENGLEWOOD, COLORADO, AND ARAPAHOE REGIONAL LIBRARY DISTRICT ·FOR 1981. WHERE AS, an Agreement with Arapahoe Regional Library District is presented to City Council annually; and WHERE AS, at the October 14, 1980 meeting, the Library Advisory Board recommended an Agreement to be presented to City Council for approval. NOW , THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ENGLEWOOD, COLORADO. Section 1. That the City of Englewood, Colorado, a municipal corporation, shall enter into an agreement with Arapahoe Regional Library District for the calendar year 1981 for the circulation of any items available for circulation from the City's library facilities and from the Arapahoe Regional library facilities to qualifying cardholders of the other's library facility under the terms and conditions as set out in the attached Agreement for Library Services, which Agreement is incorporated herein by reference. Section 2. That the City Council of the City of Englewood, Colorado, hereby authorizes the Mayor of Englewood to subscribe his name to said Agreement for and in behalf of the City of Englewood and the Director of Finance, ex officio City Clerk- Treasurer, attest the same. Higbee, ex officio City Clerk-Treasurer of the City of Englewood, Colorado, hereby certify that the above and foregoing is a true, accurate and complete copy of the Ordinance passed on fina l reading and published by titled as Ordinance No. 52 , Series of 1980. -2- • AGREEMENT FOR LIBRARY SERVICES THIS AGREEMENT, made and entered into this· · day of ---- ~~~------~~~~- , 1980, by and between the CITY OF ENGLEWOOD, COLO RADO, a municipal corporation, hereinafter sometimes referred to aa •cit y •, and the ARAPAHOE REGIONAL LIBRARY DISTRICT, her~in after sometimes referred to as "District", WITNESSETH WHE REAS, the Arapahoe Regional Library District, being a statutory regional library district organized and existing pursuant to Ti tle 24, Article 90, Colorado Revised Statutes, 1973, a~ amen ded, for the purpose of providing library service to the resident s of the un i ncorporated areas of Arapahoe County • and those muni c i palities within said County not operating their own public libraries: and • WHE REAS, the City of Englewood operates a public library within its co rporate boundaries and desires to cooperate with the District i n providing library service to District residents according to the terms and conditions as hereinafter set forth below and in a ccordance with applicable statutes of the State of Colorado; a nd WHEREAS , the parties have contracted previously for a cooperative approach to provision of said library services and de s i r e to continue providing s a id services between the Ctiy and the Distr i ct. NOW, THEREFORE, for and in consideration of the mutual premises herein, i t is agreed by and between the parti"ea hereto as follows: • • 1. The Diatrict shall circulate to library cardholders ot the City of Enqlewood any item available for circulation from the Diatrict'• library facilities, and the City shall circulate to Arapahoe County residents who qualify for and possess a Diatrict library card any item available for circulation from the City'~ library facilities. Both D1strict and City shall maintain circulation records for said transactions .and shall submit the aame to each other on a quarterly basis. Upon the receipt ~f aaid report~, the City shall .debit the District for each item circulated by the City to District cardholders, and the Diatrict shall debit the City fo~ each item circulated by the Diatrict to the City cardholders at the rate .of Fifty-five Cents ($0.55) per transaction, and payment for the net difference between said transactions shall be made accordinqly by the library with the leaaer circulation fiqures to the library with • the 9reater circulation fiqures at this rate. • 2. The rate per transaction specified in this Aqreement and upon it• aiqnature shall coincide with the rate then currently in use by the Central Colorado Library System in its reciprocal borrowinq proqram. 3. The term of this Aqreement shall be for the year commenci~q January 1, 1981 up to and includinq December 31, 1981. ourinq said term, all qualified cardholders for both the District and the City libraries may enjoy reciprocal borrowinq at both the City and the District facilities respectively, and said cardholder a •hall be aubject to all applicable rules and requla- tiona associated therewith. 4. It i• underatood between the parties here~o that the Diatrict ahall not receive any equity in book stock or in any of the City'• library facilities by virtue of the terms of -2- • • • this Agreement1 and the City shall not receive any equity in • th• book atock or in any of the District's library facilities ' by virtue of this Agreement. 5. The District shall have access to City library record• ~urin9 normal buainess hours for the purpose of verify- inq all ~iqurea supplied to the District by the City and the City ahall have access to District library records for the same purpoae. 6. During the term of this A9reement, City will establish and maintain · a bookmobile stop on a once-a-week ba•i• to the following area: Alice Terry School. 7. During the annual audit of each party to this Agreemen~, an aUdit of one month's library transactions under- taken purauant to the terms of this agr~ement shall be reviewed • The month to be reviewed ahall be randomly •elected by the auditors, and the review •hall be made by verifying microfilm record• of aaid tranaactiona or by other accepted means. The reault of each annual audit of aaid tranaactions occurrinq for the tera of thi• Agreement •hall be forwarded forthwith to the other party for its review but in no event later than June 1, 1982. The Diatrict will aupport cost of said audit to a sum not to exceed Five Hundred Dollars ($500). IN WITNESS WHEREOF, the parties have set their hands and seals the day and year first above written.
