AN ORDINANC E APPROVING AGREEMENT BETWEEN THE CITY OF ENGLEWOOD,
COLORADO, AND THE CITY OF SHERIDAN, COLORADO, WHEREBY ENGLEWOOD
SHALL PROVIDE COMMUNICATION SERVICES FOR FIRE CALLS AND SERVICE
INCIDENT THER ETO TO THE CITY OF SHERIDAN, COLORADO.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ENGLEWOOD,
COLORADO:
Section 1.
The f ollowi ng agreement between the City of Englewood,
Colorado, and t he City of Sheridan, Colorado, be and the same is

THIS AG REEMENT, entered into this day of
1979, by and between the CITY OF ENGLEWOOD, COLORAOO-,~a~m-u-n~i~c-i-·p-a_..l~~
co r poration , here i nafter referred to as "Englewood", and the CITY
OF SHERIDAN, COLORADO, a municipal corporation, hereinafter referred
to as "Sheridan",
WITNESSETH:
WHE REAS, the City of Englewood, a municipal corporation,
operates and ma intains a Communication Center, hereinafter referred
to as "facili t y", inc i dent the re to; and
WHEREAS , both Englewood and Sheridan find it mutually
desirable,unde r t he provisions of Title 29, Article 2, C.R.S; 1973,
as amended, entit led "Contracts f or Gove rnmental Services", to
enter into thi s ag reement.
NOW, THEREF ORE, it i s a g r eed by and b e twe en the parties
hereto as foll ows:

I.
That En g lewood shall provide a Conununication Center for
fi r e calls and service incident thereto consisting of the
following :
1) An adequate Communication Center to handle calls
for Englewood and Sheridan fire services.
2) Adequate staff to handle calls for both Englewood
and Sheridan fire services, level of staffing to
be determined by Chief of Englewood Police Department.
3) The Communication Center shall be appropriately
staffed for a twenty-four (24) hour, seven (7) day
week operation. ·
4) The Conununication Center shall be defined as not
only two-way radio communications but also telephone
services for Sheridan Fire Department calls.
5 ) The Chief of the Englewood Police Department shall
establish such operating procedures for the use of
Englewood Fire Department radio equipment and such
additional procedures as he deems necessary for
keeping records on the number of calls handled by
the facility.
6) A call shall be defined as either a two-way radio
transmission or telephone call.
7) Priority of calls for Sheridan shall be established
by the Chief of the Englewood Police Department.
8 ) Englewood shall maintain and be responsible only
for equipment purchased and used a t the facility
located at 3615 South Elati Street in the City of
Englewood. •
II.
1. En glewood shall set the fees for providing communication
services ba s ed upon usage and operating costs associated with
m intaining a nd operating the fa c ility.
2. Englewood has established that the current cost to
Sheridan is 1.5% o f t he cost of o perating the facility.
3 . Th e f e e for 1979 shall be $2,400.

4. Said fee shall be subject to annual increases based
upon anticipated increases in cost at the facility. Fee increases
shall be limited to a maximum of 10\ per year. The basis for the
increase in the above fee shall be Englewood's operating budget
for the facility. The base fee shall be the fee in paragraph 3
above. Englewood shall notify Sheridan by July l of each year of
any change in fees. Sheridan shall notify Englewood, in writing,
by October 1 of their rejection or acceptance of the new annual
fee for the facility.
5. Englewood shall, upon request, verify usage of the
facility upon written notice from Sheridan. The notice shall be
received no later than October 1 of each year. Englewood .shall
then take a sample of the calls for the following year consisting
of one week of calls as follows:
October -December -1 week -Sunday through Saturday
Janua ry -March -1 week -Sunday through Saturday
April -June -1 week -Sunday through Saturday
July -September -1 week -Sunday through Saturday
The percentage derived from this sampling shall be the basis for
charging for the use of the facility for the following year. The
sampling of calls will occur only once every three years unless
Englewood determines that more frequent intervals are necessary.
6. Sheridan shall save and hQld Englewood harmless from
any and all liability resulting from the use of the facility or
any incident related thereto.
III.
The terms and conditions of this agreement shall be in full
force and effect commencing January 1, 1979 and shall be renewed
each year unless either par~y hereto, by the 1st day of December
of each year this agreement is in existence, gives written notice
to the other party by certified mail, return receipt requested,
that this agreement shall not be automatically renewed.
