A ORDINANCE VACATING A PORTION OF THAT CERTAIN RIGHT-OF-WAY CON-
TAINED IN BL OCK 4, BANK ADDITION, CITY OF ENGLEWOOD, COUNTY OF
ARAPAHOE , COL ORADO, AND RETAINING EASEMENTS THEREIN.
WHER EAS, there presently exists between East Dartmouth
Avenue and Ea s t Eastman Avenue a right-of-way which varies in
width between 8 1 .37 feet and 80.85 feet in the 3100 Block of South
Clarkson; and
WHE REAS, on October 16, 1979, the Planning and Zoning
Commission recommended to City Council that the excess right-of-way
on the west s ide of said 3100 Block of South Clarkson should be
vac a ted and t hat easements be retained to provide access to utility
s e rvice lines .
NO W, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ENGL EWOOD, COLORADO, AS FOLLOWS:
S ec t ion 1 . The hereinafter described property located in the City
of Englewood, Arapahoe County, Colorado, be and the same is hereby
declared vacate d pursuant to the provisions of Part 3, Article 2,
Title 4 3, 19 73 Colorado Revised Statutes, as amended, and title
the r eof sha l l vest in the owners of the abutting land as provided
in s aid Article , said vacated land being more particularly described
as follows:
The land ad j acent to the east side of Lots 25 through
48, Block 4, Bank Addition, beginning at the NE corner
of Lot 48, Bloc k 4, Bank Addition, thence East 12.87
feet ; t he n ce South to a point 14.4 feet East of the
SE c orner of Lot 25, Block 4; thence West to the SE
corne r of s ai d Lot 25; thence North along the East line
of Blo ck 4 to the point of beginning, Arapahoe County,
Colorado , c o n ta i n i n g 8 3 8 5 square feet, more or less.
Section 2. The h e r ei nabove de scribed land is located entirely
within the City o f Englewood and does not constitute a boundary
line between the C ity of Eng l e wood and any other county or other
municipality .

S ection 3 . The vacation of the hereinabove described property
will not leave any adjoining land without an established public
r oad conn e cting said land with another established public road.
S ecti o n 4. The City of Englewood does hereby expressly reserve
the r ights-of-way or easements for the continued use of existing
s e we r, g as, water, or similar type lines and appurtenances, and
for ditc hes or canals and appurtenances, for electric, telephone,
and simi lar lines and appurtenances, if any, now located in the
hereinabove described parcel vacated.

the 19th day of November, 1979.
