HomeMy WebLinkAbout1979 Ordinance No. 051• ORDINANCE NO . 51 ----SERIES OF 1979 BY AUTHORITY COUNCIL BILL NO. 53 INTRODUCED BY COUNCILMAN SMITH AN ORDINANCE VACATING A PORTION OF WEST QUINCY PLACE CONTAINED WITHIN HAYE S SUBDIVISION IN THE CITY OF ENGLEWOOD, COUNTY OF ARAPAHOE, STATE OF COLORADO. WHEREA S, We st Quincy Place, being a 60-foot right-of-way for street p ur p os e s, was dedic a ted by plat in the Hayes Subdivision in 1955; and WHEREA S, We st Quincy Place extends 125 feet east of the south right-of-way line of South Lipan Street and deadends at the west line of Jason Park; and WHEREAS, on October 16, 1979, the Planning and Zoning Commission o f the City of Englewood found and determined that the entire right -of-way was not needed and that onl ' a 16-foot right- of -way for par k maintenance vehicles and pedestrian access to the east entry t o J ason Park should be retained. • NOW, T HEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE • CITY OF ENGL EWOOD, COLORADO, AS FOLLOWS: S ection 1. The hereinafter described real property located in the City of Englewood, Arapahoe County, Colorado, be and the same i s hereby dec lared vacated pursuant to the provisions of CRS 43-2-301 et s eq . (1973 ), as amended, and title thereof shall vest in the owners of the abutting land as provided in said Article, said vacated land being more particularly described as follows: The northerly 22 feet and the southerly 22 feet o f West Quincy Place adjoining Lots 30 and 31, r espectively, in Hayes Subdivision, City of Englewood, Arapahoe County, Colorado. Section 2. T h e hereinabove described land is located entirely within the City of Englewood and does not constitute a boundary line between the City of Englewood and any other county or other municipality . Section 3 . The vacation of the hereinabove described property will not leav e any adjoining land without an established public road connecting said land with another established public road . • Section 4 . The City of Englewood does hereby expressly reserve the rights-of-way or easements for the continued use of existing sewer , gas, water, or similar type lines and appurtenances, and for ditches or canals and appurtenances, for electric, telephone, and similar lines and appurtenances, if any, now located in the hereinabove described parcel vacated. Introduc ed, read in full, and passed on first reading on the 19th day of November, 1979. Publi shed as a Bill for an Ordinance on the 21st day of ovember, 1979 .
