WHEREAS, the city Council of Inglewood, Colorado, pursuant to the Charter and the ~unicipal Code of the City, and the Laws of the State of Colorado, hereby finds and determines that there exists a necessity for the creation of Paving District No. 25, in the City, and the construction and installation therein of street and alley paving, curb and gutter and sidewalk im- provement• as described hereinJ and WHEREAS, as ordered by the City council, the Director of Public works has prepared and filed plans, epecifications, aps and estimates of coat for the propoeed improvements1 and WHEREAS, Notice of a public hearing concerning the creation of the District and the construction and installation of the improvements therein has been published once a week for three consecutive weeks in the Englewood Herald-Sentinel, a newspaper of general circulation in the City, and in addition, a notice has been mailed, postage prepaid, to each kn.own owner . of real property within the proposed DistrictJ and WHERBASr at the time and place aet· forth in the notice, the City Council met in open .session for the purpose of hearing any objections or protest~ that might be made ag~inat the proposed district or the improvements to be constructed or installed; and . ., . . . .. · • • WHEREAS, the City Council has determined that the following streets should be deleted fro11 the list of streets to be improved: ON East Aah•r•t Place Alley z. of 3700 Blk. Creation of the District~ That · a special improvement district for the construction, installation or im- provement of the improvements hereinafter described, is herebf created 'and established · in accordance with the Charter and the, Municipal Code of the City, and the Laws of the State of Colorado, and shall be known and designated as •Paving Diatr ict No. 2s•. All proceedings heretofore taken and adopted in connection with the District are hereby ratified, approved and confirmed~ Section 2. Engineering Plana and Specifications. That the engineer's reports, together with all of the details, specifi- cations, estimates, maps and schedules thereto attached, as amended, are hereby approved and adopted. Sect ion .3. The extent of the District to be assessed for the cost of the improvements and the area to be included within the boundary of the District, shall be • all the real property specially benefited, and fronting or abutt- ing on the streets and alleys between the termini hereafter described, including .the reai property within one-half (1/2) block of such Avenue. , . . . . . . • Section :4. Improvements Authorized. The construction or installation of the street paving, curb and gutter and sidewalk iaprovements in and for the District, as shown by the plans, specifications and aapa thereof, approved by the City Council of the City, is hereby authorized and ordered, the material to be used in the construction of said improvements to be in accordance with such maps, plana and apecif icationa. Section 6. Assessment of Costa.· The revised·probable total coat of the improvement• to be constructed or installed is $.u2,.S.QA.f it is proposed that the City of Englewood will pay approximately $_}.is.i-t_OO ~he remainder of the cost will be assessed . . against the property within the district and specially benefited by the construction and installation of the improvements. The approximate share of the total coat to be assessed per front foot against any lot or tract of land .fronting or abutting on said improvements will be as m~re particularly set forth in the resolu- tion passed and adopted on January 3, 1978, and which is incor- porated herein by specific reference. -s- ,. ·• . . . •. Section 7. . Payment of Aaaeaament•. The assessment• • will be due and payable without demand within thirty (30) days from and after the final publication of the Ordinance assessing the whole coat of said improvements against the real property in the District. In the even~ any owner of . real. estate shall . . fail to pay the whole of sue~ a~seasment against his or her I property within said thirty (30) .days, then the whole cost of the . '. • • I ' improvements so assessed against:' auch property shall be payable in ten (10) equal annual installment• of principal. The first of . such installments of principal •hall be due and pay ale at such time as will be deteralned ln the aaaeaaing ordinance ·and the remainder of said installment• shall be due and .payable suc- cessively on the same day in each year thereafter, until all are paid in full. The rate of intereat to be paid on unpaid and deferred installment• will be eatabliahed by .ordinance to be adopted by the City Council at • later date. Section 8. Special Improvement Bonda. By virtu• of ·and • pursuant to said laws and the Charter and the Municipal Code of the City, local improvement bonds of the City shall be issued for • the purpose of paying for the local improvements described in this Ordinance, in an amount not to exceed the cost and expenses of said i provements, including engineering, · legal and inciCfental expenses, as provided by . law. The bonds . shall be issued based upon estimates approved by the City Council, and as authorized by an Ordinance to be passed by the City Council at a later date. The maximum rate of interest on special improvement bonds for Paving District No~ 25, shall not exce~d nine (9) per cent per annum. The bonds and the interest thereon shall be payable out of special assessments to be levied against the real property ln- c luded within the District and specially benefited by 'the la-.. provements to be constructed or installed. Section 9. Notice to Construction Bidders. · The Mayor and the Director of ·Finance are hereby authorized to advertise for bids to construct such improvements in the time and manner required by the Charter of the City and by the Municipal Code, which advertiaeaent . -y run concurrently with the publication of this Ordinance. . · · · . ,. • • • ... , . Section 10. General Benefits. The City Councll hereby find• and determine• that the improvement• proposed to be con- • tructed and installed will confer a special benefit upon the property within th• District and a general benefit upon the City as a whole. Section 11.· ~verabill°tt. That .if any one ·or more section• or parts of this Ordinance shall be adjudged unenforce- able or i nvalid, such judgment shall not affect, impair or· inval- idate the remaining provision• of · this Ordinance, it being the intention that the .various provisions hereof are severable.
