ORDINAll CE NO . 10 SERIES OF 1978
A BILL FOR
AN ORD INANCE APPROVING THE WHOLE COST OF THE
IMPROVEMENTS MADE IN PAVING DISTRICT NO. 24,
IN 'fHE CITY OF ENG LEWOOD, COLORADO; APPROVING
AND CONFIR MING THE APPORTIONMENT OF SAID COST
TO EACH LOT OR TR AC T OF LAND IN SAID DISTRICTJ
ASSESSING A SHARE OF SAID COST AGAINST EACH
LOT OR TRACT OF LA ND IN THE DISTRICT; PRESCRIB-
ING THE MANNER FOR THE COLLECTION AND PAYMENT OF
SAID ASSESSMENTS; AND DECLARING AN EMERGENCY.
WHERE AS, by Ordinance No. 6, Series of 1977, finally
passed and dopted on April 4, 1977, the City Council has created
P vi ng District No. 24, within the City of Englewood, for the
pu rpose of co n stru cting and installing street paving, curb and
gutter and side walk improvements, together with necessary in-
cid entals, on th e south one-half of West Evans Avenue, from the
center line of South Zuni Str eet to the center line of South
Rari tan Street; and
WHERE AS, the improv ements authorized by said Ordinance
have been completed and accepted l>y t.he Ci ty and the whole cost of ,
s uch improvements has been d e termined; and
WHER EAS, an assessme nt roll has been prepared and a
st a e m nt show 1ng th tota l cos t of the improvements has been duly
file d with the Ci ty Council; and
WHERE AS , from the sta tement made and filed with the City
Counc il , it pp ar s that t he wh ole cos~ of said improvements is
the a mount of $69,273.25, of which amount the City of Engle-
wood will pay $2 2,018.59 leaving $47,254.66 to be assessed against
the real proper ty in the District, said amount including costs of
inspection , co llection and other incidentals and also including
inter e st as l lowed by law; and
HERE AS, from said statement it also appears that the
City Council has appo rtioned a share of the whole cost to each lot
or tract of land in the Dist rict, in accordance with the benefits
o be derived by said property and in the proportions and amounts
seve rally s et forth in Ex hi bit A attached to this Ordinance;
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
ENGLE 000 , COLORADO :
Sec t ion 1. Confirmation of Assessment Roll. That the
whole cos t and apportionment of the same is hereby approved and
co nfi rme d, and s aid apportionm ent is hereby declared to be in
cco rd nc wi h he speci al benefi ts which the property in the
Dis tr ic t will r cei ve by reason of the construction of said
i :n provcmen ts, and a share of said cost is hereby assessed to and
u po n eac h lot or tract of land within the District in the pro-
por tions and amo u nts as set forth in the assessment roll, attached
r to s Exhibi A.

rovidcJ. Failure to p y the whole assessment within said period
of thirty da s shdl l be concl usively considered and held an
elec tion on the part of all pe rsons interested, whether under
dis bility or othe rwise, to pay in said installments.
Such election shall be conclusively held and
considered as a waiver o f any right to question the power or
Jurisdic tion of the City of Engle wood to construct the improve-
men t s , the quality of the work, the regularity or sufficiency of
the proceedings, or the validit y or the correctness of the as-
sessmen ts, or the v.:ilidity of the lien thereof.
In the event of such election to pay in install-
me Ats, the assessments 3hall be payable at the office of the
County Treasurer of Arapahoe Cou nty, Colorado in ten (10) equal
nnu.:i l installments of principal, the first of which installments
o( principal sh 11 be due and payab le on or before the lst day of
J an u ary, 1979, and the remainder of said inscallments shall be due
and payab le success ively on or bef0 re the 1st day of January,
in each year th reafter until paid in full, with interest on the
unpaid pr incipal amount at the rate of 5.50' per annum, commencing
on January 1, 1979 and pay able each year at the time of
paying install ments of assessm en ts.
Section 3. Penalt for D fault or Non-Payment. Failure
to pay .:iny installment , wh ether of principa l or interest, when due
shall cause the whole of the un aid principal to become due and
payable immeJi3tely , and the whole amount of the unpaid principal
and accrued interest shall th ereafte r draw interest at the rate of
one ) r en u:n ( l ) per mon h, or fr act i on of a month, until the
d e of x S.JlC , s provided by law. At any time prior to the
d ot he .ix .., l , he o wnc m y pay the amount of all unpaid
in tall en ts with interest at one pe r cent um (H) per month, or
fraction of a mo nth, and all pena lties accrued and shall thereupon
be restored to the right thereafte r to pay in installments in
the same ma nner as if default had not been suffered. The owner of
any property not in default as to any installment or paym ent may,
at any t ime , p y the i.·hole of the unpaid p rin cipa l with accrued
in r s o the d t of the n x t ssessme nt installment payment
date.
Sec ion 4. Disc ount on Payment of Asses s me nt~. Pay-

Sect ion 5. Assessme nt Lien. All assessments levied
9 inst the real prope r ty in Pavi ng District No. 24, together with
11 interest thereon and p na lties for default in payment thereof,
and all cos ts in collecting the same, shall co nst itute, from
the date of t he final publication of this ordinance, a perpetual
lien in the sev ral am ounts assessed against each lo t or tract of
land. S ch li n sh 11 have priori ty over all other liens except
gene ral tax liens, and sh al l be enforced in accordance with the
la~s of the S of Colcr ad o •
If an y tract of real property included within
Paving District No. 24 is hereaf ter divided or subdividied into
two or mo r e uch tracts or parcels , the Director of Finance, with
the assistance of the Director of Public Works, is hereby auth-
orized and di rect d to divide the assessment against such tract in
the same p r opo rtion tha h t c t itself is subdivided into two •
or ore such parce s, and to certify the revised assessments
to the County Tre sur r o Ar pahoe Count y, Colorado.
Section 6. Payment of Special Assessment Bonda. The
mou nt of ass ssments herein levied against the property specially
benefited, in the tot 1 amount of $47,254.66, together with the
appro xi mate moun t of $7,745.3 4 on hand from the proceeds of the
bond issu an not need d for the constru cti on of the improve-
nts, il l in an amoun suf ficient for the payment of the
outs anding bonds previously issued for Paving District No.
24.
S c ion 7 • §.~!?.J:. l i !:i. . That if any one or more
sec ions or p rts of this Ordi nance shall be adjudged unenforce-
able or i v 1 i , such judgme nt shall not affect, impair or in-
validate th e r maining provisions of this Ordinance, it being the
in ention he various p rovisions hereof are severable.
Section 8. Emergency Provision. By reason of the fact
that bonds of Paving District No . 24 are now outstanding and that
in e r es h reon wil 1 shortly become d u e and payable, funds must
b .ade va ·1 bl c o assessme nts at the earliest possible
d te or paym en o f s c h inte rest, and for the immediate pre-
servation of he publ ic proper y , health, peace and safety, it is
her by decl r e hJ n in c ency exists and that this .. ordinance
sh 11 f c pon its fin l passage .

• Section 9. Repealer. All ordinances, or parts thereof,
in con flict herewith are hereby repealed.
Sect ion 10. !!!!!.!!!i. In accordance with the City
Ch arter and the Municipal Code of the City, the City Council shall
hol d a pu b lic hearing on this ordinance, before final passage at
7: JO P.M. on Tuesday, May 2, 197 8.
Section 11. This
Ord i nance, after its final passage, shall be numbered and record-
ed , and the adoption and publication shall be authenticated by the
signatu re of the Mayor and the Director of Finance, ex-officio
City Clerk-Treasurer, and by the Certificate of Publication. Thia
or d i na nc e shall take effect immediately upon final passage and
sh a l l be published within seven days thereof.
