ORDINANCE NO. 30 , SERIES OF 1978
AN ORDINANCE ZONING CERTAIN REAL PROPERTY ANNEXED TO THE CITY OF
ENGLEWOOD , I-1, LIGHT INDUSTRIAL DISTRICT, RECITING A WAIVER AND
IMPO SING CONDITIONS THEREON: AMENDING THE ZONING MAP IN ACCORDANCE
THEREWIT H: AND PROVIDING FOR THE RECORDING OF THIS ORDINANCE.
WHEREAS, pursuant to Section 22.3 of the Comprehensive
Zoning Ord in a n ce , public h e arings were held before the City
Planning a nd Zo ning Commis s ion on July 5, 1978, September 6, 1978,
to zone a ce r t ain pa r ce l o f land annexed by Ordinance No. 29 to
t he City of Engl e wood, I-1, Light Industrial District; and
WHEREAS, on october 2, 1978 , said Planning and Zoning
Commission submitte i t s Find ings of Fact, Conclusions an<l recom-
men d e d that I -1 Ind u strial Zo ning be imposed with conditions; and
WHEREAS, the C ity Council directed that a public hearing
b e held b e fore it on Octobe r 30, 1978 with regard to said zoning
application; a nd
WHEREAS, a t said h ea ring on said date the Council shall
r eceive al l re p orts, maps , drawings, memoranda, minutes, findings
and all eviden ce and o the r ma tters theretofore previously con-
s idered by th e Ci ty Pl an n ing a nd Zoning Commission, and in add-
ition rec e ive f ur the r t e stimon y from the owner and applicant as
well as othe r i n te r e sted partie s; and
WHEREA S, the City Co u n cil hereby adopts and incorporates
herein parag r aphs No . 1 to 13 i nclusive of the findings of fact and
a . through g ., inclusiv e , o f the recommendation of the City
Planning and Zoni n g Commiss i on adopted September 19, 1978, a copy
of said fin d ing s and rec omm e ndation i s attached hereto and made
a part hereof by this r eference .
WHE REAS , City Co unci l finds and determines that the
public nece s sity , conve n ience , health, safety and good zoning
practice j ustify the p r opo sed amendment, subject, however, to
a certain waive r and Conditio ns hereinafter contained .

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL,
CITY OF ENGLE WOO D, COLORADO as follows:
Section 1 . Zone Classification.
Tha t the following described real property shall be zoned
I-1 Light Industrial District:
Beginni n g at th Northeast corner of Tract 11, Bell
I 1 Gard ns Subdivision, Arapahoe County, Colorado, also

taining 1 .05 acres mor e or less.
Se ction 2 . Conditions.
The conditions establi shed and approved by the City
Council and impo s ed upon the above described real property
classified as I -1 , Industria l District, shall be as follows:
a. No Bu 'lding Permit shall be issued for the construction
or installa ion of any b u ilding or structure on the
subject property or any portion thereof except in con-
formance wi th a Development Plan which has be~n approved
and r ecorde in compli ance with §22.4A of the Comprehen-
sive Zoning Ordinance .
b. The maximum height of any structure or building shall
not exce d 25 feet above the natural grade of the site.
c . There shall be minimum s etback of 25 feet from the
west pro pe rty line of Lot 12, Bell Isle Gardens Sub-
division , Arapahoe County, Colorado, which lot is
identified by street address as 1460 West Tufts Avenue .
d. The east boundary of the subject property shall be
screened as approved by a recorded Development Plan.

e . Lighting facilities on the property or on any building
or structu re located on the subject property, shall be
so arra n ged tha t the y will neither shine nor be reflected
on the adjacen t resi dential prope r ties.
f . No entrance , exit or l oading dock shall be permitted on
the east sid e of any bu i lidng wh i ch is constructed on
the subject property ; nor shall a ny parking, storage of
e qui p me nt, materi a ls o r tra sh, or acc e ss, other than
f or emergency vehicl es, b e permitted in the area east
of said buil di ngs .
g . All outside storage on the subject property shall be
e nclose d by a solid fe nc e or wall not less than six (6)
nor more than ei g ht (8) fe e t in he i ght, all t rash coll-
e ction ce n t e rs shall b e o f a covered type and no -outside
storage s hall create litte r, be a fire or h e alth hazard
or create any other for m of public nuisance.

T h e o ff i c i a l zonin g ma p o f the City shall be and is here-
b y amended to conform t o the provis i ons of Sectionsl arrl 2 of this
Ord i nan c e .

Administrators , Executors, Successors
And Assign s .
That the foreg o i n g c hange i n z o ning classification is
bas ed upon the Find i ngs of Fact as h e rein adopted and upon the
repre sentation by the ow ner a nd applicant for annexation that he
wil l wai ve those certain right s which may be available to him
an d in l ieu thereo f agrees to t h e Waiver and Conditions set forth
herein , which said Wa i v e r a nd Conditions s h all be bind i ng upon the
o wner , h is h e irs, admi n istrators, e xecutors, successors and assigns.

That th is Ord i n ance shall be recorde d by the Department
of Communi t y De v elopmen t with the off i ce o f t he Clerk and Recorder
of Arapahoe Coun ty , Co l ora do .
