HomeMy WebLinkAbout1978 Ordinance No. 031• • • INT RODUCED AS A BILL BY COUNCILMAN WILLIAMS ~~~~~~~~~~~~~~~~- BY AUTHORITY ORDINANCE NO. 31 , SERIES OF 1978 AN ORDINANCE ANNEXING 2.50 ACRES, MORE OR LESS, AS HEREINAFTER MORE PARTICULA RLY DESCRIBED, TO THE CITY OF ENGLEWOOD, COLORADO, AND IMPOSING TERMS AND CONDITIONS THEREON. WH EREAS, on July 11 the City Council received a petition for the annexation of a certain unincorporated parcel of land within Arapaho e County as hereinafter described; and WH EREAS, the City Council finds that not less than one- sixth of the pe rimeter of the area proposed to be annexed is contiguous wit h the City of Englewood, Colorado; and WH EREAS, the said petition for annexation is signed by the owners of 100% of the property proposed to be annexed exclusive of streets and alleys; and WH EREAS, the City Council finds that a conununity of inte r est exis ts between the area proposed to be annexed and the City of Englewood, and that said area is urban and is integrated with or capable of being integrated with the said City of Englewood; and WH EREAS, the City Council finds that the proposed anne xation complies with all of the applicable provisions of the Colorado Mun i c i pal Annexat i on Act of 1965, as amended; and WHE REAS, the City Council finds that it is necessary and desirable to impose certa i n terms and conditions relating to the dedication of certain properties for street rights-of-way, NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ENGLEWOOD, COLORADO, as follows: Section 1. That the f o llowing described parcel of land located in and being part of Arapahoe County, State of Colorado, is eligible for annexation under t h e provisions of the Colorado Municipal Annexation Act of 1 9 65 , as am ended, and the same is hereby annexed and made a part o f the City of Englewood, Colorado subject, however, to the terms and conditions imposed by Section 2 hereof: 1485 W. Tufts -An nexing • . • • • ' • I A tract of land in the West 1/2 of the Southwest 1/4 of the Northe ast 1/4 of Section 9, Township 5 South, Range 68 West of the 6th Principal Meridian, described as follows: Commencing at the Northwest Corner of the Southwest 1/4 of the Northeast 1 /4 of Section 9, Township 5 South, Range 68 West, thence East along the North line of the Southwest 1/4 of the Northe ast 1/4 of Section 9, Township 5 South, Range 68 West, a distance of 330.0 feet more or less to the true point of beginning, said t rue point of beginning also being on the City Limits of En glewood, Colorado; thence continuing East along said City Limits a distance of 165 feet more or less; thence South 0 ° East along the Ci ty Limits of Englewood, Colo rado, a d istance of 660 feet more or less to the centerline of West Tufts Avenue; thence West and leaving the City Limits line of Englewood, Colorado, a distance of 165 feet more or le s s; thence North a distance of 660 feet more or less to the true point of beginning. Said tract of land containing 2.50 acres, more or less. Section 2 . That as a term and condition of annexation, however, under the a uthority granted by Section 31-12-112, C.R.S. '73, a s amended , the City Council requires that the owners and all those having an interest in the real property proposed to be annexed shall formally dedicate to the public for street right- of-way the following parcels of land, to wit: Th e North thirty (30) feet of the parcel of land described in Section 1 of this Ordinance (fo r West Stanford Avenue) and Conmen cing at the northwest corner of the southwest 1/4 of the northeast 1/4 of Section 9, T 5 ~· R 68 W of the 6th P.M., thence east along the nor~h line.of the south- west 1/4 of the northeast 1/4 of said Sect~on 9, a dis- tanc e of 495.0 feet to the east property line of the subj ect property, thence south· along said east property line 620 .0 feet to a point 10 feet no~th of the .no~th line of West Tufts Avenue the true point of beg1nning, thenc e south along said east property line 10.0 feet to th e north right-of-way line of West Tufts Avenue; thenc e west along the north right-of-way line of West Tufts Avenue 10.0 feet; thence northeasterly 14.14 feet to the t r ue point of beg i nn t ng , -2- 4 . . , . .. ..... • • • Section 3. This Ordinance shall take effect thirty (30) days after publication following final passage. Introduced, read in full, and passed on first reading on the 2nd day of October, 1978.
