ORDINANCE NO. 33 , SERIES OF 1978
AN ORDINA NCE ANNEXING 2.232 ACRES, MORE OR LESS, AS HEREINAFTER
MO RE PAR TICULARLY DESCRIBED, TO THE CITY OF ENGLEWOOD, COLORADO,
AND IMPO SING TERMS AND CONDITIONS THEREON.
WHEREAS, on August 7 the City Council received a
petition f or the annexation of a certain unincorporated parcel
of land wi thin Arapahoe County as hereinafter described; and
WHEREAS, the City Council finds that not less than one-
sixth of t he perimete r of the area proposed to be annexed is con-
tiguous with the City of Englewood, Colorado; and
WH EREAS, the said petition for annexation is signed by
the owners o f 100 % of the property proposed to be annexed exclus-
ive of streets and alleys; and
WHEREAS, the City Council finds that a community of
interest e x i sts betwe e n the area proposed to be annexed and the
City of Englewood, and that said area is urban and is integrated
with or ca pable of being integrated with the said City of
En glewood; a nd
WHEREAS, the City Council finds that the proposed
anne x ation com~li e s with all of the applicable provisions of
the Colorado Muni c i p al Annexation Act of 1965, as amended; and
WHERE AS, t h e C ity Council finds that it is necessary
and desirable to impo s e ce r t a i n terms and conditions relating to
the dedicatio n of ce rtai n p r operties for street rights-of-way,
NO W T HEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ENGL EWO OD, COLORADO, as follows:
Section 1.
That t h e followi n g de scribed parcel of land located in
nd being p rt of Ar a p hoe Co unty, Sta t e of Colorado, is eligible
for annexat ion u nd er t h e provisions of the Colorado Municipal
Annexation Act of 1965 , a s ame nded, and the same is hereby
annexed and made a p ar t of the City of Englewood, Colorado subject
however to the t erm s and c o n ditions impos e d by Section 2 hereof:

Beginning at the Northeast corner of Plot 3, Bell Isle Gardens,
Arapahoe County, Colorado, which is the point of intersection
of the South line of West Tufts Avenue and the West line of
South Win dermere Street; thence East along the South line of
West Tuft s Avenue 127.3 feet to the true point of beginning;
thence North 10 feet; thence West along a line parallel with
the South l i ne of west Tufts Avenue a distance of 396.13 feet
mo re or le ss to a point on the City of Englewood City Limits
line; then ce South 56°0' East along the City Limits a distance
of 17.88 fe et more or less to the South line of west Tufts
Avenue; the nce South 11°19' West along said City Limits line
a distance of 254.55 feet; thence North 89°47' East and leaving
the City Li mits of Englewood a distance of 304.1 feet to the
West line o f South Windermere Street; thence South . 166.79 feet
to a point on the City of Englewood City Limits; thence East
along a curve to the left having a radius of 45 feet thru 215°
a nd foll o wing the City Limits a distance of 168.7 feet; thence
No rth 35° West 52.1 feet to the East line of South Windermere
Street; the nce North along the City Limits a distance of 100.0 feet;
thence Sout h 89°46' West a distance of 10.0 feet more or less
t o the Ea s t right-of-way line of South Windermere Street; thence
North along said right-of-way line a distance of 250 feet more or
less to a p oint on the South line of West Tufts Avenue; thence
East along s aid South line a distance of 87.3 feet to the true point
of beginning; sa i d p a rcel of l and containing 2.232 acres more or
less.
Section 2.
That as a tenn and condi ti.oo of annexatial, however, under the
aut:rority granted by Sectial 31-12-112, C.R.S. '73 (as ameOOed), the City Council
shall require that the owner and all th:>se having an interest in the real property
proposed to be annexed shall formally dedicate to the public for street rights-
of-way the f o l lowing parcels o f land, to wit:
(a) The North t'Nenty (20) feet of IDts 1, 2 arx1 3, Bell Isle Gardens,
ArapabJe Cotnty, Coloraoo (for West Tufts Avenue).
(b) The East ten (10) feet of Lot 3, Bell Isle Gardens, Arapah:>e
County, Coloraoo (for South windennere Street) •
(c ) Beginning at the Northeast comer of Lot 3, Bell Isle Gardens
Subdivisioo, ArapalK:>e County, Coloracb, thence South ala¥J the F.ast line of Lot 3
20 feet, thence West and parallel to the North line of Lot 4, 10 feet to the point
of beginning; thence CCl'ltinuing West 10 feet; thence on an angle to the left of
135° 14.14 feet to a point 10 feet West of the East line of Lot 3; thence North
10 feet to the point of beginning.
(d) Beginning at the Southeast corner of Lot 3, Bell Isle Gardens,
Arapab:>e County, Colora00, thence West along the South line of Lot 3, 10 feet to
the point of beginning,thence continuin;J West 10 feet; thence on an angle to the
r ight of 135 ° 14.14 feet to a point 10 feet West of the F.ast line of Lot 3;
thence South 1 0 feet to the point of beginning.

Section 3.
This Ordinance shall take effect thirty (30) days after publication
following final passage.
Introduced, read in full and passed on first reading on the 2nd day
of October, 1978.
