ANC E APPROVING AN AGREEME NT BETWEEN THE CITIES OF E GLEWOOD A D LITTLETON , COLORADO , RELATING TO THE ORDERLY T RAN SFER OF ENGLEWOOD AND LITTLETON EMPLOYEES TO THE BI-CITY WASTE WATE R TREATMENT FACILITY . WHEREAS, both municipalitie s previously entered into an Agreement on July 2 , 1973, for the purpose of combining their indivi dual r e source s a nd joint ly constructing a waste water treatment facility for the us e of both municipalities; and WH EREAS, it is in the be s t i nterests of the City of Littleton that it c e a se operations of its existing sewer plant at he t i me tha t the joint use waste water facility is placed o n line; and WHE REAS , it is the desi re of both municipalities to establish an orderly transition between the phasing out of existin sew r r e t m nt faci l itie s in b o t h municipalities, and the phasi n g in of the joint use was t e water treatment facilities; a nd WHEREAS , it i s in the be st i nterests of both municipalitie s that the c omplime nt of the staff of the joint f ility s hould c onsist , when e v e r possible, of Littl eton a n d Englewood employees wh o have previous experience in waste wate r management . NO W, THEREFORE , BE IT ORDAI NED BY THE CITY COUNCIL OF THE CITY OF ENGLEWOOD, COLORADO, as follows: S e ct ion 1 . That the City o f Englewood and the City of Littleton s hall ente r in t o an Agreement according to the provisions of that certain wr i t te n i nstrument captioned "Agreement", which is attached he r e t o , consisting o f thre e (3) typewritten pages, and is hereby incorporate d by referen ce herein. Said instrument generally provides t h a t : -1 - • • • 1. Pursu nt to the Agreement entered into between the municipalities on July 2, 1 9 73, the parties reaffirm that the City of Englewood shall operate the joint treatment plant under the control of the Supervisory Committee. Engle- wood shall be reimburse d for i ts ex penditures in operating the plant based upon actual verifiable costs, plus three (3%) percent of such cost for administra tion. Individuals presently employe by either City have priority in employment by the operators f th ·oint plant, based , wherever possible, on a pl n of lt rn ting he selection of employees between the Cities, s id plan to be devised and administered by the Super- visory Cornrnitt e . 2. Pursuant to the terms of the contract entered in o on July 2, 1973, Littleton 's p roportionate share of the cost of operation as determined purs uant to Section 3 of said contr ct, shall be credited with the cost of salaries and benefits paid by Littleton to those Littleton employees who are ssigned to th joint use waste water treatment facilities. 3. Thos employees design ated in the Agreement attached hereto, shall remain City of Littleton employees, and shall be eligible for all benefi ts afforded all other City of Littleton employe s. 4. Said employees shall have the right to apply to the City of Englewood for mployment, but must go through all applic ble procedur s r la ing t o applications for employ- ment . employees facility, at said f not be ex Englewood motion of 5. Should any employee listed in attached Agree- ment be dismissed or should choose to resign from the employ of the City of Littleton , or choose to be reassigned from said facility to nether position of employment within the City of Littleton, then said vacated position shall be filled by the City of Englewood . -2- • • 7 . The te rms of the a ttached Agreement are to be an implementa ti o n of t he plan to b e administered by the Supervisory Committee as set fo r t h in Section 7.1 of the Agreement between Englewood and L ittleton dated July 2, 1973. 8 . Supervis io n of those employees shall be through the est blished chain of command at the joint use waste water treatment facilit i es. If said e mp loyees desire to avail them- selves of any grieva ce and disci plinary procedures, they shall make use of ~hos e procedures established in the Englewood Career Service Ru l e s and Regulations, a n d all applicable ordinances and charter provisions set forth by the City of Englewood. Section 2 . The City Council of the Ci ty of Englewood, Colorado, hereby uthorizes the Mayor of the C i ty of Englewood, Colorado, to subscribe h"s name to sa id Agreeme nt on and in behalf of the Ci y Counc"l nd the City of En glewood, Colorado, and the Di c or of Fin nee , e x officio City Clerk-Treasure r shall attesl: th s me .
