AN ORDINANCE APPROVING A RIGHT-OF-WAY AGRBEMBNT BETWEEN
MELVIN J. DENNING AND VERLA N. DBNHING AND THE CONTINENTAL
NATIONAL BANI< (GRANTORS) AND TBB CITY or BNGLBWOOD1 AUTHOR-
IZING THB EXECUTION AND DELIVERY or CBRTAIN REAL PROPERTY
AS DESCRIBED HBRBIN1 AND AUTHORIZING AND DIRECTING THE
MAYOR TO EXECUTE SAID AGREBMBNT AND CONVBYANCE1 AND
DIRECTING THE DIRECTOR OF FINANCB TO A'l"l'BST TBB SAME.
WHEREAS the previous owners of that realty
hereinafter deecribed as heretofore conveyed to the
City title to the aame; and
WHEREAS a review of the tranaaction indicates
that it was the mutual intent of the parties to grant
to the City rights in the said realty auff icient to
enable ·the City to cause to have constructed, erected
and maintained a certain ditch, conduit and related
facilities and not absolute fee title thereinr and
WHEREAS the City Council baa found and deter-
mined that it ia unneceasary for any municipal purpose
for the City to hold fee simple title to the realty
so long aa the City is assured that it ahall have a
perpetual easement and right-of-way in, to and over
the said deacribed property and that the aaid relocation
of the City ditch within said perpetual eaaement and
right of way shall be accomplished at aole coat and
expense of the Grantees herein.
NOW, THEREFORE, BE IT ORDAIHBD BY THE CITY COUNCIL
OF THE CITY OF ENGLEWOOD, COLORADO, AS FOLLOWS:
Section 1.
The Mayor and Director of Finance of the City,
as the ex officio City Clerk, are hereby authorized and
directed to execute, and to deliver to Melvin J. Denning
and Verla N. Denning, a quit-claim deed, conveying all of
the City's right, title and interest, except for those
rights ariaing out of that certain agreement bearing even
date with the date of such deed, in and to the following
described realty situate in Arapahoe County, Colorado:
A strip of land 20 feet in width
situated in Lots 1 through '• Block ,, Hamilton
and Killie'• Broadway Beighta, being alao part
of the NE 1/4 of the aaid NW 1/4 of Section 3,
Township 5 South, Range 68 Weat of the 6th P.M.,
said strip being 10 feet on each aide of the
following described centerlines Beginning at

Section 2.
the point of interaection of the centerline of
the existing City Ditch and th• North line of
West Kenyon Avenue whence the Southwest corner
of the NE 1/4 of the NW 1/4 of aaid Section 3
bears South 79°11'40" Weat, a diatanca of
173.4 feat more or le••1 thence North 26~06 East,
a dietance of 11.l feet1 thence North 89°50'30"
East 108.l feet; thence North 105.9 feat1 thence
North 36°20' East 16.9 feet, more or less to the
point of terminus, said point being on the West
line of South Cherokee Street.
The Mayor and director of Finance are hereby
authorized and directed to execute, and accept on behalf
of the City, that certain agreement a copy of which is
attached hereto and incorporated herein, coneiating of
three (3) typewritten pages.
Section 3.
All ordinances, resolution•, motion• and other
legislative act• of any nature, inconaiatent with the
term• of this ordinance are hereby repealed •
Section 4.
The effective data of thi• ordinance shall not
commence prior to execution of the Agreement by all parties.
