BY ADDING TWO NEW SECTIONS THERETO RELATING TO MOTOR VEHICLE NOISE. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ENGLEWOOD, COLORADO, as follows: Section 1. That Chapter 2, Title XIV of the 1969 E.M.C. is hereby amended by adding Sections 13 and 14, relating to mufflers and motor vehicle noise. 14-2-13: Mufflers -Prevention of Noise. It shall be unlawful for any person to operate, or for the owner to cause or knowingly permit the operation of any vehicle or combination of vehicles, within this municipaiity, which is not equipped with an adequate muffler in constant operation and properly maintained to prevent any unnecessary noise, and no such muffler or exhaust system shall be modified or used with a cutoff, bypass or similar device. No person shall modify the exhaust system of a motor vehicle in a manner which will amplify or increase the noise emitted by the motor of such vehicle above that emitted by a muffler of the type originally installed on the vehicle. 14-2-14: Motor Vehicle Noise. It shall be unlawful for any person to drive or move, or for the owner to cause or knowingly per- mit the operation of any motor vehicle having a manufacturer's gross vehicle rating of less than 10,000 lb., except a motorcycle, within this munici- pality, which exceeds 95 dB (A), measured not less than -1- , • • • 20 inches (508 nm) t'ran the exhaust outlet. The measured exhaust system sound level of a stationary vehicle shall be the highest reading obtained during the test, disregarding unrelated peaks due to extraneous ambient noise. When there is more than one exhaust outlet, the reported sound level shall be for the loudest outlet. When there is more than one exhaust outlet extending from a single muffler, separated by less than 12 inches (305 mm), measurements shall not be made on the outlet furthest from the side of the vehicle. Section 2. That all ordinances and parts of ordinances ·in con- flict h erewith are hereby expressly repealed. Introduced,read in full and passed on first reading on the 15th day of March, 1976.
