INTRODUCED AS A BILL BY CO UN~IL~ BROWN
BY AUTHORITY
OR DI NANCE NO. 2 1 , SERIES OF 1976
AN ORDIN ANCE APPROVING THE MAINTENANCE AGREEMENT 0F THE
ENGLE OOD DAM BETWEEN THE CITY OF ENGLEWOOD, COLORADO,
AND THE URBAN DRAINAGE AND F LOOD CONTROL DISTRICT.
WHEREA S, the Ci t y of Englewood, Colorado and the
Urban Drainage a nd Flood Cont rol District are desirous
of cooperating t oge ther for maintenance services on the
Englewood Dam; a nd
WHEREAS , i n Ap ril of e ach year, the Urban Drainage
and Flood Control Di stric t shall inspect the dam and associated
areas, in luding o u t l e t work s , earthen embankment and s pillway,
to insure that the i n let a n d outlet are both free of sediment
and debris, that the emb ankme n t is free from excessive erosion
and undermining by p ra rie dog s, and the spillway embankments
and cuts are free f rom e x ce s sive erosion.
NOW, THREF ORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF ENG LEWOOD, COLORADO, as follows:
Section 1 .
Tha h City of Eng l e wood, Colorado shall enter into
an agr ment with the Urban Dr ainage and Flood Control District,
according to the fo llow ing provisions:

In Apr il of each year: The City shall police
the a r ea s urrou n d i ng the dam, including outlet
wo r k s and s pillway. All material, junk, debris,
and t rash that is not "n atural" shall be removed.
Du r i ng May th r o ugh September of each year: The
dam and surroun di ng area should be checked for
tras h and d ebris after heavy rains, or at least
once p e r mo nth. A crew shall be sent to the
dam to r e mo v e de br i s and junk as determined
by the s a i d mo nthly inspections .

3. During the monttEof November and February:
Th City shall check for and remove accumulated
trash and debris during said months.
4. The City shall advise the District of any items
needing repair or replacement,such as dead trees,
signs, logs, steps, retaining walls, etc.
Necessary repairs or replacements as determined
by the District, may be made by Englewood upon
written authorization by the District.
5. Written Monthly Maintenance Reports will be pro-
vided to the District by the City.
6. The City will bill the District on a time and
materials basis once per year after the September
cleanup. The base wages used for City personnel
are to be adjusted for fringe benefits, per
Exhibit B, and cost of manpower and equipment
will be based on the attached Schedule, Exhibit A.
Both Exhibit A and B are attached hereto and made
a part of this agreement and ordinance. It is
further understood that adjustments may be made
to this Schedule by the City of Englewood as
costs increase.
7. Seventy-five (75%) percent of the billing amount
shall be Englewood's share of the maintenance of
Englewood Dam per the agreement dated May 1, 1974,
between the City of Englewood, the City of Cherry
Hills Village, the City of Greenwood Village,
Arapahoe County, and the Urban Drainage and
Flood Control District.
8. Cash disbursements for the remaining twenty-five
(25%) percent shall be made to Englewood by the
District .
Section 2 .
The Mayor is hereby authorized and directed to execute
said agreement for and on behalf of the City of Englewood, and
the C ity Clerk is directed to attest the same and affix the
official seal of the City thereto.
