INTRODUCE D AS A BILL BY COUNCILMAN MANN
BY AUTHORITY
ORDINANCE NO. 45 , SERIES OF 1976
AN ORDINANCE APPROVING AN AGREEMENT AND POLICY STATEMENT
BETWEEN THE CITY OF ENGLEWOOD, COLORADO, AND THE ENGLEWOOD
HOUSING AUTHORITY RELATING TO THE MANAGEMENT OF THE APARTMENTS
FOR THE ELDERLY.
WHEREAS, the City of Englewood, Colorado, and the
Englewood Housing Authority are desirous of entering into
an Agreement and Policy Statement relating to the management
of the apartment units for the elderly located at 3333 .South
Lincoln Street, Englewood, Colorado.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL
OF THE CITY OF ENGLEWOOD, COLORADO, as follows:
Sect ion 1.
That the City of Englewood,Colorado, shall enter into
an Agreement and Policy Statement with the Englewood Housing
Authority, according to the provisions of those certain
written instruments captioned "Agreement" and "Policy Statement
of Regulations, Priorities and Preference• for Eligibility,
Tenant Selection and Continued Occupancy", which are attached
hereto, consisting of thirteen (13) typewritten pages and are
hereby incorporated by reference herein. Said instruments
provide as follows:
1. The premises shall be uaed for the purpose of
providing housing for elderly · persons in the
City of Englewood according to applicable.Fed-
erz.l regulations under the Section 8 Hou~ing
Assistance Payment Program aa contained in the
Housing and Community Development Act of 1974.
2. The term of said Management Agreement shall be
for a period of one (1) year, beginning Jan-
uary 1, 1977, and shall be automically renew~ble
each year thereafter unle•• the other p~rty is
notified in writing thirty (30) days prior to
the expiration of said Agreement •

3. The current market rental will be established
in conjunction with the United StatesDepartment
of Housing and Urban Development under the pro-
visions of the Section 8 Program of the 1974
Housing and Conununity Development Act.
4. The Englewood Housing Authority will be respon-
sible for the management of the premises, in
accordance with current Federal requlations and
the stated policies of the Enqlewood Housing
Authority, a copy of which is attached
to said Management Aqreement and is incorporated
by reference.
5. It is understood between the parties that the
Englewood Housing Authority shall be solely
responsible for the maintenance and operation
of the premises .and the •election and supervision
of all personnel required for such maintenance
and operation. The Authority aqrees that should
any major repairs be necessary to the premises,
a request shall be submitted to the City of
Enqlewood in writinq for approval of same.
All maintenance and operatinq coats shall be
borne by the City of Enqewlood through the
special account established by the City for
the exclusive use of the premises.
6. The City of Englewood shall acquire the necessary
insurance for the premises.
7. The Englewood Housinq Authority shall not dis-
criminate against any applicant because of race,
color, sex, national oriqin, appearance, religious,
political or other affiliation1 and, no preference
shall be shown any applicant because of political
affiliation or his acquaintance with any public
official at the Federal, State or local level.
Section 2.
The City Council of the City of Enqlewood, Colorado
hereby authorizes the Mayor of the City of Englewood,
Colorado, to subscribe his name to said Management Agreement
on and in behalf of the City Council and the City of Engle-
wood, Colorado, and the Director of Finance, ex officio City-
Clerk Treasurer attest the same .

AGREEMENT
T HIS AGR EEMENT made and entered into this //a-ti>
day of August, A.O., 1976, by and between the City of Englewood,
a Municip al c orporation, hereinafter referrred to as "Engle-
wood", and the Ho us ing Au thority of the City of Englewood,
hereinafte r referre d to a s "Housing Authority".
WI TNESSETH:
WHERE AS, the C ity of Englewood has heretofore entered
into a Lea se Agreement with the Housing Authority and is
presently c onstructing an apartment structure of one hundred
and four (1 04) un i ts for the elderly upon said premises, and
the City i s d e s i rous of e ntering into a Management Agreement
with the En g lewood Hous i ng Authority to handle the management
of certain apartment units to be located thereon; and
WHERE AS, the Engl e wood Housing Authority has agreed
that it would man a ge sa i d units according to the terms hereof.
NOW, THE REFORE, FOR AND IN CONSIDERATION of the mutual
promises and c ove nants h e r e in expressed it is agreed by and
between the parties as follows:
1. P REMISES
Upon a nd subject to the conditions and limitations
s et forth below, the Englewood Housing Authority shall manage
certain imp rovements located at 3333 South Lincoln Street,
Englewood , Colorado consisting of one hundred and four (104)
apartment uni ts located on the following real property situated
in the Ci ty of Englewood, County of Arapahoe, State of Colorado,
more particul arly described as follows:
Part of the SW 1/4 of the SE 1/4 of Section 34,
Township 4 South, Range 68 West described as
f ollows:
BE GINNING at a point 30 feet South and 140 feet
East of intersection of East line of Broadway
and North line of said SW 1/4 of the SE 1/4 of
S e ction 34; thence East 126 feet, thence South
319 feet; thence West 126 feet; thence North
3 19 feet to place of beginning.

2. USE OF PREMISES
The premises shall be used for elderly persons in
the City of Englewood according to applicable Federal reg-
ulations under the Section 8 Housing Assistance Payment Pro-
gram as contained in the Housing and Community Development
Act of 1974.
3. TERM OF AGREEMENT
The term of this Agreement shall be for a period of
one (1) year, commencing on January 1, 1977, and shall be
automatically renewable each year thereafter unless the
other party is notified in writing thirty ·(30) days prior
to the expiration of this Agreement.
4. RENT
The current market rental will be established in
conjunction with the United States Department of Housing
and Urban Development under the provisions of the Section 8
Program of the 1974 Housing and Community Development Act.
The amount of rent to be paid by each tenant will be deter-
mined by the Executive Director of the Englewood Housing
Authority according to the Federal regulations •
5 • MANAGEMENT
The Englewood Housing Authority will be responsible
for the management of the premises. In accordance with
current Federal regulations and the stated Policies of the
Englewood Housing Authority, a copy of which is made part
of this Agreement, the Englewood Housing Authority will
have the sole responsibility of selecting tenants for vacant

unit s. The E~glewood Housing Authority will be responsible
for the c ollection of security deposits, the collection of
month ly r e nts, the inspection of any vacated premises, the
retu r n of any remaining se~urity deposit to the previous
t e nant , with an explanation of use made of the withheld
deposit s.
The Englewood Housing Authority shall also be
responsi ble for the collection and submission to the City
of Englewood of all bills incidental to the operation of the
premises. No bill shall be paid by the City without prior
a ppr oval of the Englewood Housing Authority. It is under-
s tood be tween the parties that a separate account shall be
set up a s a separate part of the operating budget of the City
o f Eng lewood. All revenues received by the Englewood
Ho using Authority shall be forwarded to the. Director of
Finance of the City of Englewood.
6. MAINTENANCE AND OPERATION
It is understood between the parties that the Engle-
wood Hou sing Authority shall be solely responsible for the
maintena nce and operation of the premises. The Englewood
Housing Authority shall be responsible for the selection and
supervis ion of all personnel required for the maintenance
and operation of the premises. The Englewood Housing Authority
agrees t hat should any major repairs be necessary to the
premises, it shall submit a request to the City of Englewood
i n writing for approval of same. All maintenance and operating
costs sh all be borne by the City of Englewood through the
special a ccount established by the City for the exclusive use
of the p r e mises.
7. LIABILITY
The City of Englewood shall acquire necessary insur-
ance for the premises. The Englewood Housing Authority shall
hold the City of Englewood harmless for any of the acts or

omissions of the City, its agents or employees.
8. NON-DISCRIMINATION
The Englewood Housing Authority shall not dis-
criminate against any applicant because of race, color,
sex, national origin, appearance, religious, political
or other affiliation. Conv~rsely, no preference shall
be shown any applicant because of political affiliation,
or his acquaintance with any public official at the
Federal, State, or local level. In addition, there shall
be no discrimination against any applicant receiving part,
or all, of his income from public assistance,providing
such applicants are otherwise eligible for admission.
