BY AUTHORITY ORDINANCE NO. 7 , SERIES OF 1975 AN ORD I NANCE CREATING PAVING DISTRICT NO. 22 IN THE CITY OF ENGLEWOOD, COLORADO, ORDERING THE CONSTRUCTION AND INSTALLATION OF STREET PAVING, CURB AND GUTTER AND SIDEWALK IMPROVEMENTS; PROVIDING FO R THE I SSUANCE OF BONDS IN PAYMENT FOR SAID IMPROVE- MENTS; PROVIDI NG FOR NOTICE TO CONTRACTORS AND OTHER DETAILS IN CONNECTION ITH THE DISTRICT. HE REAS, the Ci~y Council of Englewood, Colorado, pursuant to the Charte r and the Municipal Code of the City, and the Laws or the State o f Colorado, hereby finds and determines that there exists a neces sity for the creation of Paving District No. 22, in the City, and the construction and installation therein of street paving, curb a nd gutter and sidewalk improvements as described herein; and WHERE AS, as ordered by the City Council, the Engineer for the District h as prepared and filed plans, specifications, maps and estimates o f cost for the proposed improvements; and WHE REAS, Notice of a public hearing concerning the creation of the District and the construction and installation of the improvements therein has been published once a week for three consecutive we eks in the Englewood Herald Sentinel, a newspaper of general cir culation in the City, and in addition, a notice has been mailed, p ostage prepaid, to each known owner or real property within the proposed District; and WHERE AS , at the time and place set forth in the notice, the City Council me t in open session for the purpose ot hearing any objections or p rotests that might be made against the proposed dis rict o r the i mpr o vements to be constructed or installed; and WHERE AS, the following streets were deleted from the list o f st reets to be improved: 1. South Elati Street, from South side of West Yale Avenu e to North side of West Amherst Avenue B! IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ENGLEWOOD, S ection 1. Creation of the District. That a special imp r oveme n t district for the construction, installation or impro vement of the improvements hereinafter described, is hereby c rea t e d a nd established in accordance with the Charter and the Municipal Co de of the City, and the Laws of the State of Colorado, and shall b e known and designated as "Paving District No. 22" . All p r oce e d ings heretofore taken and adopted in connection with the Dist r ict are hereby ratified, approved and confirmed. Sec tion 2. Engineering Plans and Specitications. That the engineer's reports, together with all of the details, specif!- cations, estimates, maps and schedules thereto attached or appended, as amended, are hereby approved and adopted. Se ction J. District Boundary. The extent of the District to be assesse d for the cost of the improvements and the area to be included within the boundary of the District, shall be all the real prope rty specially benefited, and frontin1 or abutting on the streets between the termini hereatter described, including the real prop erty within one half (1/2) block of such streets. Se ction 4. Description of Improvements. The kind of improvements and the streets on which such improvements shall be constructed or installed sha ll be as follows: -2- • • • 1 . I erovements Authorised. The construction or installation of the atreet pavinq, curb and gutter and sidewalk improvement• in and for the District, as shown by the plans, specification• and .. P• thereof, prepared by the City Engineer and approved by the City Couhc.il of the City, i~ hereby authorized and ordered, the material to be used in the conatruction of said improvements to be in accordance with such mapa, plane · and specifications. Section '· Aeaessment of Coats. The probable total cost of the improve .. nta to be constructed or inatalled is · $829,050.00; it is proposed that the City of Englewood will pay approximately 108,050.00; the remainder of the cost will be assessed aqainst the property within the diatrict and apecially benefited by the construction and inatallation of the improvements. The approximate share of the .total coat .to be ~sseased per front foot .aqainst any lot or tract of land frontinq or abuttinq on eaid improvements will be as more particularly set forth in the resolution passed and adopted on January 6, 1975, and which ia incorporated herein by specific reference. Section 7. Payment of Assessment•. The assessments will be due and payable without demand within thirty (30) days from and after th• final publication of the Ordinance assessinq the whole coat of aaid improvements against the real property in the District. In .the event any owner of real estate shall fail to pay the whole of auch aaaeaament against his or her property within said thirty (30) daya, then the whole coat of the improve- ments so asse sed again•t such property shall be payable in ten (10) equal annual inatallmenta of principal. The first of such installment• of principal ahall be due and payable at such I time as will be determined in the assessing ordinance and the remainder of said inatallments shall be due and payable successively on the .... day in each year thereafter, until all are paid in full. The rate of interest ~o b~_paid on unpaid and deferred inatallment• will be established by ordinance to be adopted by the City Council at a later date • Section 8. Special Improvement Bonda. Sec tion 9. Notice to Construction Bidders. The Mayor a nd the Dire ctor or FinancJ are hereby authorised to advertise for bids to construct such improvements in the time and manner required by the Charte r or the City and by the Municipal Code, which adver- tisement may run concurrently with the publication of this Ordinance. Sect ion 10 . General Benefits. The City Council hereby t!nd s and dete rmines that the improvements proposed to be constructed -. •nd installed will confer a special benefit upon the property within the District and a 1eneral benefit upon the Cit7 as a whole. Sect ion 11. Severability. Sect ion 12. Hearin1. In aooordance with Section 40 of the City Char t er, t~e City Council shall hold a public bearing on this ordinan c e , before tinal pas s age, at 7:30 P.M. on Tuesday, February 18, 1975. Sect ion 13. Publication and lftective Date. This Ordinance, af t er its final P••••1e, shall be numbered and recorded, and the adoption and p ublication shall be authenticated by the signature of the ayor and t he Director of Finance, ex-otticio City Clerk-Treasurer, ... and by the Cert i f icate ot Publication.
