HomeMy WebLinkAbout1975 Ordinance No. 020· . • • • • I TRODUCED AS A BILL BY COUNCILMAN BLESSING BY AUTHORITY ORDINANCE NO. ezo , SERIES OF 1975 A ORDINANC E REPEALING AND REENACTING CHAPTER 3, OF TITLE III, '69 E.M.C., ENTITLED, 'UNSAFE BUILDINGS, STRUCTURES OR UT ILITIES', AND ADOPTING BY REFERENCE THE "UNIFORM CODE FOR THE ABATEMENT OF DANGEROUS BUILDINGS", 1973 EDITI ON, TO PROVIDE METHODS, WHEREBY BUILDINGS OR STRUCTURES WHICH FROM ANY CAUSE ENDANGER LIFE, LIMB, HEALTH, MORALS, PRO PERTY, SAFETY OR WELFARE OF THE GENERAL PUBLIC OR THEIR OCCU PANTS, MAY BE REQUIRED TO BE REPAIRED, VACATED, OR DEMO LISHED; REPEALING ORDINANCES IN CONFLICT HEREWITH; AND PROVI DING A PENALTY FOR THE VIOLATION OF THE PROVISIONS OF SAI D CODE. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ENGLEWOOD, COLORADO, as follows: Section 1. That Chapter 3, of Title III, '69 E.M.C. is hereby r e pealed and reenacted to read as follows: ' CHAPTE 1 3. UNIFORM CODE FOR THE ABATEMENT OF DANGEROUS BUILDINGS 3-3-1 UNIFORM CODE FOR THE ABATEMENT OF DANGEROUS BUILDINGS -ADOPTED There is hereby adopted by reference thereto, the "Uniform Code for the Abatement o f Dangerous Buildings", 1973 Edition, published by the International Conference of Building Of ficials, 53 6 0 South Workman Mill Road, Whittier, Cal i fornia 90601, with the same force and effect as if the same were fully set forth herein, subje c t to the exceptions, modifications and amendment s thereto as hereinafter set forth. 3-3-2 SPECIF I C CHANGES IN ADOPTED CODE The following specific changes, modifications and amendments are hereby made in the provisions o f the Uniform Code for the Abatement of Dangerous -1 - • As defined in Chapter 3 Buildings, 1973 Edition, hereinabove adopted: 1. Delete Section 203, 'Violations'. 2. Delete Section 205, Board of Appeals, Page 8 - Dangerous Buildings. 3. Section 404(a), Page 15, Form of Notice should read: DANGER: KEEP OUT UNSAFE STRUCTURE Title III of the 1 9 6 9 Englewood Munici pal Code By Order of Assistant Director Dept. of Community Development Unlawful to remove or deface this sign. Date pos t ed: • By: 4. Section 80l(a), Page 24 -Dangerous Buildings. In the first sentence delete the words, "there- for to the Director of Public Works" and the words, "under the direction of said Director". Delete sub-section (b), Page 2 -Dangerous Buildings. 5. Delete Section 802, Page 24 -Dangerous Buildings. 6. Delete Chapter 9, Sections 901 through 912, Pages 25 through 27 -Dangerous Buildings. New Sections 901, 902, 903 and 904 are as follows: Section 901. NOTICE OF COSTS. Whe n any costs are incurred by the City in causing the repair or demolition of any building done pursuant to the provisions of Sect i on 70l(c) 3, of this Code, the City Manager shall cause a statement to be pre- -2 - • • • pared by the Director of Finance showing the whole c ost of repairing or demolition of any bu i lding, plus fifteen per cent (15%) administrative costs and such statement shall be mailed to the property owner(s) with in- structi o ns that said statement will be paid in full plus costs within thirty (30) days of said mailing date. Section 902. ASSESSMENT. If, after thirty (30) days from such mailing date, the full amount of such statement is not paid, the City Manager shall inform City Council of such fact and the Council shall, thereupon, enact an ordinance assessing the whole amount of such statemen t, plus an additional ten (10%) of such amount, against the lots or tracts of realty to which such statement shall appertain. Upon final passage of such ordinance, a copy thereof shall be sent to each person having a record interes t in any realty upon which an assessment is made and the Director of Finance shall certify such assessment to the County Treasurer who shall collect such assessments in the same manner as ad valorem taxes are collected. Section 903. ASSESSMENTS A LIEN. All such assessments shall constitute, from the effective date of the assessing ord- inance, a perpetual lien in the several amounts assess~d against each lot or tract of land, and shall have priority over all liens excepting general tax liens and prior special assessments. No delays, mistakes, errors or irregul arities in any act or pro- ceeding authorized herein shall prejudice or invalidate any final assessment; but the same may be remedied by subsequent amend-acts or proceedings, as the case may require. When so remedied, the same shall take effect as of the date of the original act or proceeding. Section 904. OTHER REMEDIES. The amount of any unpaid charge, plus all penalties added thereto, shall constitute a -3- •• • • Section 2 . 1,.;b ,J ,, ,i t y. Copies of th e sa i d Uniform Code for the Abatement ?f Dang~r ous Buildin gs, 1973 Edition, are available for inspectio n at the Office of the Director of Finance ex officio City Clerk-Treasurer , during all regular bu~iness hours. Sec tion 3. Any violation of the Uniform Code for the Abate- ment of Dangerous Buildings of the City of Englewood, Colorado , from and after the effective date thereof shall be punishable by a fine not e xceeding three Hundred ($300) Dollars, or imprisonment for a term not exceeding ninety (90) days or both such fi ne and imprisonment. Section 4 • That all ordinances and parts of ordinances in confli t or inco n sistent here with are hereby expressly repealed.
