HomeMy WebLinkAbout1975 Ordinance No. 043• • I TRODUCED AS A BILL BY COUNCILMAN BY AUTHORITY ORDINANCE NO. 43 , SERIES OF 1975 A ORDIN ANCE AMENDING CHAPTER 4, TITLE XV OF THE 1969 E.M.C BY REVISING THE SCHEDULE OF RATES AND CHARGES FOR SANIT ARY SEWAGE SERVICE. WHEREAS, the City Council, having reviewed the sanitary sewage service needs of the city and costs incident thereto, finds and concludes that the rates and charges for sanitary sewage service are in need of revising; NOW , THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ENGLEWOOD, COLORADO, AS FOLLOWS: Section 1. That Section 9, Chapter 4, Title XV of the 1969 E.M.C. hereby is amended to read as follows: 15-4-9. RATES AND CHARGES FOR SEWERAGE SERVICE (a) There is hereby levied and charged on each lot, parcel of land, and premises served by or having sewer con- nections with the sanitary sewer of the City of Englewood, or otherwise discharging sanitary sewage, industrial wastes, or other liquids, either directly or indirectly into the city sanitary sewer system, an annual service charge which shall be computed and payable as follows: (1) The minimum annual charge for service, both inside and outside the city, shall be twenty dollars ($20.00). (2) Customers with metered water service shall pay nineteen cents ($0.19) per 1000 gallons of wastewater treated, but in no event shall they pay less than the minimum annual charg e. Wastewater generated by each customer shall be calcu- lated using winter water usage information from the months of November through April. SPECIAL CASES: (A) Industrial waste class customers shall pay charges based upon one hundred ten percent (110%) metered water used. (B) Schools operating on a nine-month school year shall be billed seventy-six percent (76\) of the charges which would normally accrue for similar usage by a residential customer. (C) Industries, car washes and other commercial users may be billed based upon annual rather than winter- peri od water usage, where in the opinion of the Director of Utili ties annual usage more accurately represents sewage con- tribu tion. (3) Where metered water usage information is not available, sewage treatment charges shall be computed and will be payable as follows: (A) Each single-family unit of dwelling: twenty dollars ($20.00). (B) Each multiple dwelling unit: thirteen dollars ($13.00). (C) Other cases: based upon reasonable estimates of projected flow. (4) Outside city customers shall pay one hundred ten percent (110\) of the charges assessable to inside city cus- tomers under provisions of paragraphs (2) and (3). (b) The above rates and charges for inside city limits shall be billed in quarter annual installments in advance. Rates and charges for sewer-only accounts outside the city may, at the discretion of the Director of Finance, be billed annually where this would not conflict with specific provi- sions of a connector's agreement. All bills shall become due and payable upon receipt of the bill and shall become delinque nt f ifteen (15) days after date of bill. (c) Nothing in this section shall be construed to pre- vent any special agreement as hereinabove provided between the City of Englewood and other persons, cities, towns and incorpo rated sewer districts and sanitation districts, and agencies thereof served by the city sewer system. The amendment hereinabove set forth shall become ef- fecti ve commencing at 12:01 A.M., M.S.T., January 1, 1976. -2 - I ntroduced, read in full and passed on First Reading on the 3rd day of November, 1975.
