HomeMy WebLinkAbout1975 Ordinance No. 056. • .. • • • INTRODUCED AS A BILL BY CCXJNCILMAN SOVERN BY AUTHORITY ORDINANCE NO. 56 , SERIES OF 1975 AN ORDINANCE APPROVING AN AGREEMENT BETWEEN THE CITY OF ENGLEWOOD, COLORADO, A KJNICIPAL CORPORATION, AND NOT TO EXCEED SIXTEEN LIBRARY JURISDICTIONS, AS SHOWN HEREIN, FOR THE RECIPROCAL USE OF CIRCULATION SERVICES BY PUBLIC LIBRARIES PARTICIPATING IN THE CENTRAL COLORADO LIBRARY SYSTEM; AND DECLARING AN EMERGENCY. WHEREAS, the libraries listed herein are participating members of the Central Colorado Library System, a system designed to coopera- tively provide and improve library services at reduced cost to all residents of the eight-county Denver metropolitan area; and WHEREAS, ft fs fn the demonstrated public interest to extend all reasonable convenience to cftfzens pursuing publicly-supported library and fnfonnatfon services; and WHEREAS, the library admfnfstrators within the system have in the past successfully provided reciprocal use of their circulation services to all residents of the Central Colorado Library System area who have shown evidence of regf stratfon at any one of the participat- ing libraries in the system; and WHEREAS, library authorities signing the agreement wish to continue reciprocal borrowing services for residents of the Denver metropolitan area; and WHEREAS, the library jurisdictions whfch loan materials to residents who do not pay taxes in thef r jurf sdfctfons deserve due compensation for the services rendered; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ENGLB«>OD, COLORADO, AS FOLLOWS: Section 1 That the Cf ty of Englewood, Colorado, a municipal corporation, shall enter fnto an agreement with the following jurisdictions: Adams County Public Library, Arapahoe Regional Library District, Aurora Public Library, Boulder Public Library, Mlmfe Doud Eisenhower Public Library, Denver Public Library, Douglas County Public Library, John Tomay Manorial Library, Idaho Springs Public Library, Jefferson County Public Library, Lafayette Public Library, Edwin A. Bemis Public Library, Longmont Public Library, Louisville Public Library, Ward Public Library, and Westminster Public Library, all acting by and through their proper officers, according to the provisions of that certain written instru- -1- • • • . . ment captioned "Multilateral Agreement for Reciprocal Use of Circula- tion Services by Public Libraries Participating in the Central Colorado Library System." which is as follows: -2- • • • Multilateral agreement for recip rocal use of circulation services by public libraries participating in the Cent r al Colorado Library System This agreemen t is made and entered into as of the first day of December 1975, by and be tween the severa l library jurisdictions listed below. WITNESSETH TH AT: WHEREAS: 1. The lib raries l isted below are participating members of the Central Colorado Library System, a System designed to cooperatively provide improved library services at reduced costs to all residents of the eight-county Denver metropolitan are a; and 2. It is i n the demonstrated public interest to extend all reasonable con- venience to citizens pursuing publicly supported library and information services; and 3. Library administrators within the System have, in the past success- fully provided r eci procal use of their circulation services ·to all residents of the Central Colorado Library Sy s tem area who have shown evidence of regis- tration at any one of the part i cipating libraries in the System; and 4. Library authori t i es signing below wish to continue reciprocal bor- rowing services for residents of the Denver metropolitan area; and 5. Library jurisdictions which loan materials to residents who do not pay taxes in their jurisdictions deserve ·due compensation for the services rendered; NOW, THEREF ORE, in consideration of the mutual promis~s contained herein, it is agreed as follows: 1. Each library authority signatory hereto shall continue to honor a valid library registration card from any citizen who can present same from any of the other s ignatory libraries in the System area for purposes of reciprocal use of circu lation services; and -3 - , . 2. E c h library aut~ority signatory hereto shall receive $0.45 from Ll1c library jurisd i ction of the user's residence per circulation transaction accom- ~ p lished unde r this agreement; and • • 3. Each libra ry authority signatory hereto shall pay $0.45 per circula- tion transaction incurred by a resident of the library's political jurisdic- tion; and 4. Tile execu tive agent of the Central Colorado Library System shall receive monthly reports certified by the library administrators of such re- ci?rocal circulation transactions incurred by this agreement and shall prepare and distribute s t atements quarterly based upon these monthly reports; and 5. Tite libra ry adminis t rators receiving statements for obligations under this agreement shall make full payment against those obligations no later than sixty (60) days after receipt of the statements; payments shall be made to the Central Colorad o Library System; the executive agent of _the System shall, in turn, reimburse c reditor libraries which are due payment; and 6. Tile st aff of the Central Colorado Library System shall maintain records, render comprehensive monthly reports, and perform annual evaluations of the reciprocal services provided; services by the System staff shall be at no charge t o part i cipating libraries; and 7. Any of t he library jurisdictions signatory hereto may withdraw from this agreement upon due notification to all other signators at least 45 days in advance of inte nded withdrawal, all withdrawal dates to be effective the first day of the mo nth; no withdrawal shall act to the prejudice of any of the remaining signa t ories with respect to existing obligations due from the withdrawing lib r ary to the remain i ng signatories; and 8. It is fu rther understood that the libraries offering reciprocal ~ir- culation services under this agreement are in no way bound to offer other types of library services as a consequence of this agreement; and 9. Section 3 I nasmuch as the within agreement with the participating libra ry authorities is scheduled to become effective Decem- ber 1 , 1975, should the agreement not be ratified and ap- proved e ff ective as of that date, the City of Englewood would b e penalized as a result of a loss of revenues ac- cruing to it and, accordingly, the Council finds and de- termi nes that an emergency exists and that the passage of th e within ordinance is necessary for the immediate prese r v ation of public property, health, peace and safety, and s a i d ordinance shall become effective upon publication after fi nal passage.
