J 9 , SERIES OF 1974 AN ORDINANCE AMENDING SECTION 21-7 OF THE 'MODEL TRAFFIC CODE FOR COLORADO MUNICIPALITIES, 1966, ' AS ADOPTED WITH AMENDMENTS BY ORDINANCE NO. 24, SERIES OF 1969, (CHAPTER 1, TITLE XIV, '69 E.M.C.) BY AUTHORIZING THE USE OF AIR HORNS ON FIRE VEHICLES ONLY. BE IT ORDAINED BY TilE CITY COUNCIL OF THE CITY OF .ENGLEWOOD, COLORADO, as follows: Section 1. That Section 21-7 of the Model Traffic Code, 1966 Edition, as amended, is hereby amended to read as follows: Section 21-7. Authorized Emergency Vehicles - Equipment -Privileges (a) EVERY AUTHORIZED EMERGENCY VEHICLE SHALL, IN ADDITION TO ANY OTIIER EQUIPMENT AND MARKINGS REQUIRED BY THIS MODEL TRAFFIC CODE, OR BY THE STATUTES OF THE STATE OF COLORADO, BE EQUIPPED WITH A SIREN, EXHAUST WHISTLE OR BELL CAPABLE OF GIVING AN AUDIBLE SIGNAL AND BE EQUIPPED WITH AT LEAST ONE LIGHTED LAMP EXHIBITING A RED LIGHT VISIBLE UNDER NORMAL ATMOSPHERIC CONDITIONS FROM A DISTANCE OF 500 FEET TO THE FRONT OF SUCH VEHICLE. A POLICE VEHICLE, MAY, BUT NEED NOT, BE EQUIPPED WITH THE RED LIGHT SPECIFIED HEREIN. THE FIRE DEPARTMENT VEHICLES MAY ALSO BE EQUIPPED WITII AIR HORNS FOR USE BY ITS DRIVERS SO AS TO CLEAR INTERSECTIONS. OTHER AUTHORIZED EMERGENCY VEHICLES MAY ALSO BE EQUIPPED WITH WARNING DEVICES, OTHER THAN AIR HORNS, THAT EMIT YELPS AND SCREECHES FOR USt; HY 'J.'llliJ.K UKJ.VEl<.S TO CLEAR INTERSECTIONS . -1- • • • (b) The driver of an authorized emer- gency vehicle, when responding to an emergency call or when in pursuit of an actual or suspected violator of the law, or when responding to but not upon returning from a fire alarm, may exer- cise the privileges set forth in this section, but subject to the conditions herein stated. (c) The driver of an authorized emergency vehicle may: (1) Park or stand a vehicle, irrespective of the provisions of this ordinance; (2) Proceed past a red or stop signal (3) or stop sign, but only after slowing down as may be necessary for safe operation; Exceed the prima facie speed limits so long as he does not endanger life or property; (4) Disregard regulations governing direction of movement or turning in specified directions. (d) The exemptions herein granted to an authorized emergency vehicle ,shall apply only when such vehicle is making use of audible and visual signals meeting the requir~ments of THIS MODEL TRAFFIC CODE OR STATE LAW, except that an authorized emergency vehicle being operated as a police vehicle while in actual pursuit of a suspected violator of any provision of this ordinance or any provision of State law applicable to drivers and vehicles in this municipality need not display or make use of audible and visual signals so long as such pursuit is being made to obtain verification of or evidence of the guilt of the suspected violator . -2- (e) The provisions of this section shall not relieve the driver of an authorized emergency vehicle from the duty to drive with due regard for the safety of all persons, nor shall such provisions protect the driver from the consequences of his reckless disregard for the safety of others.
