BY AMENDING CHAPTER 1, SECTION 1, THEREOF AND ADDI NG A NEW SECTION TO CHAPTER 2 TO BE KNOtv"N AS SECTION 11, TO CHANGE THE DEFINITION OF "VEH.ICLE" CO NT/\! NED IN THE MODEL TRAFFIC CODE SO THAT BICYCLES ARE INCLUDED IN THE DEFINITION. WHEREAS, the existing definition of "vehicle" as contained in the Mod e l Traffic Code read together with other provisions of said Cod ~, give rise to conflicting inter-. pretations as to which provisions apply to bicycles; and WHEREAS, such conflicts are not conducive to fair administration of justice; and WHER EAS, som e compelling interpretations leave bic yc l e r i de r s un p r o t c t d · in certain critical traffic situations on the streets of the City of Englewood . . NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ENGLEWOOD, COLORADO, as follows: Section 1. Title XIJ, Chapter 1, Section 1, ~f the 1969 E.M.C. is hereby amended to r e ad as follows: 14-1-1: Adoption (a) There is hereby adopted as a part of the Englewood Municipal Code, with the same force and effect as though the same ware set forth in full herein, that certnin code known as "Model Traffic Code for Colorado Municipalities, 1966" (hereinafter referred to as "Model Traffic Code") as of~icially approved • -1- ... • • • Section 2. adopted and published by the Colorado Highway Safety Council, by Resolution thereof dated February 17, 1966, except the following articles and sections thereof, which are declared to be inapplicable to this municipality artd are hereby expressly deleted: (1) (2) (3) (4) (5) (6) (7) Section 2-1 of Article II thereof; Section 4-1 4-2 4-3 4-5 and , ' ' ' 4-7 of Article IV thereof; Section 6-6 of Article VI thereof; Section 10-1 of Article X thereof; Section 15-5 (f) of Article XV thereof; Section 17-9 of Article XVII there- of; Section 25-2 (ff) of Article XXV thereof; (8) All of Articles XXII, XXIII, XXIV, XXVI and XXVII thereof. (b) Wh e never any provision of the Model Traffic Code makes reference to any of the provisions thereof appearing .in those portions of the Model Traffic Code set forth in subsection (a) (1) through (8), the same shall be taken to refer to the substituted provisions therefor, if any, contained within this Title. · . .. Vehicle Any device which is capable of moving itself or of being moved from place to place upon wheels or endless tracks, including a· bicycle, but such term shall not mean or include any farm tractor or implement of husbandry designed primarily or exclusively for use and used in agricultural operations or any device moved exclusively over station- ary rails or tracks or designed to move pri- marily through the air .
