ORDINANCE NO. . 9-1( -SERIES OF 1974
AN ORDINANCE AMENDING CHAPTER 2, TITLE II, OF THE 1969 E.M.C.
RELATING TO THE ENGLEWOOD VOLUNTEER FIRE DEPARTMENT; AND DECLARING
AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ENGLEWOOD,
COLORADO , as follows:
ection 1.
Section 1, Chapter 2 of Title II of the 1969 E.M.C. is
hereb y amended to read as follows:
2-2-1 ENGLEWOOD VOLUNT~ER FIRE DEPARTMENT;
RECOGNITION, QUALIFICATION, MEMBERSHIP
There is hereby recognized the Englewood Vol-
unteer Fire Department, a Colorado not-for-profit
corporation, as an auxiliary firefighting force, the
membership of which may be called to duty during day-
light or nighttime hours in the event of fires or
when their assistance is otherwise needed, subject to
sue~ additional qualifications or limitations which
may be imposed by the by-laws of such corporation.
The membership thereof shall consist of persons
eighteen (18) year of age or older who shall otherwise
qualify.
Section 2.
Section 2, Chapter 2 of Title II of the 1969 E.M.C. is
hereby amended to read as follows:
2-2-2 COMPENSATION; DISABILITY, LENGTH OF SERVICE,
RETIREMENT BENEFITS
No member of the Volunteer Fire Department shall
receive any compensation for services as a member thereof;
provided however that service as a member of the Volunteer
Fire Department shall be considered as service in a
Volunteer Fire Department for the purpose of any disability

or length of service retirement benefits provided to
members of such department; and provided further that
the City Council may make payments to, or on behalf of,
the Englewood Volunteer Fire Department in reasonable
amounts determine d and budgeted for that purpose, such
payments to be used for equipment, the traini n g o f fir e-
fighters and other general expenses of the Eng l ewood
Volunteer Fire Department.
Section 3.
Sec tion 3, Chapter 2 of Title II of the 1969 E.M.C. is
hereby am nded t o read as fol lows:
2-2-3 OFFICERS; ELECTION AND TERMS
The o fficers of the Volunteer Fire Department
shall consist of such officers as shall be provided by
its by-laws ~nd shall be elected from non-probationary
membership of the Volunteer Fire Department.
Section 4.
Section 4, Chapter 2 of Title II of the 1969 E.M.C. is
h reby amended to read as foll ows:
2-2-4 FUTURE MEMBERSHIP; LIMITATIONS
The En glewood Volunteer Fire Department shall
recrui t, appoint and maintain a membership as established
herein and shall hereafter consist of a minimum membership
of t~enty-five (25) volunteer firefighters. Additional
volunteer appointments may be made by the CQuncil on the
recomm endations of the Englewood Fire Department and the
City Manager as needed.
Section 5.
The lack of firefighting personnel in both the paid and
volun teer departments has created a serious failure of fire respons e
within the City; the Council, therefore, finds and determines that
an eme rgency exists and that the passage of the within Ordinance
is necessary for the immediate preservation of property, health,
peace and safety.
This Ordinance shall take effect immediately upon passage
following final publication.
