SS , SERIES OF 197 4 AN ORDINANCE AMENDING CHAPTERS 3, 4, 6 AND 9 OF TITLE V, OF THE 1969 E.M.C., RELATING TO PROMOTIONS; ANNUAL, SICK AND INJURY LEAVES; OFFI CIAL HOLIDAYS; SALARIES; ;LONGEVITY; AND RETIREMENT PLAN BENEFITS; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ENGLEW OOD, COLORADO, as follows: Section 1. That Sub-section 8(a), Chapter 3, Title V of the 1969 E .M. C. is hereby ar.1 ended to read as follows: 5-3-8 PROMOTIONS (a) Competitive examinations for positions above the entrance level shall be open to other City employees, and the final score of each applicant shall include appropriate considerations of the appli- cant's qualifications, record of performance, and seniority with the City.an6-shall-inelttde the-veterants-~referenee-ere6it; The re- classification of a position occupi~d by a permanent employee shall not be considered as a promotion. Section 2. That Sections 1, 6. 12 and 17, Chapter 4, Title V, of the 1969 E.M.C . are hereby amended to read as follows: 5-4-1 ANNUAL LEAVE (V ACATION); ACCRUAL; QUALIFICATIONS (b) All employees classified under Sections 5-6-9 and 5-6-10 (Police and Fire Departments), working a forty-hour week, shall be entitled to ninety-six-{96~-he~rs FIFTEEN (15) DAYS of annual leave each year. (c) All employees in the Classified Service working assigned periods of twenty-four (24) hours (Fire Department) shall be entitled to ene httndred-thirty-nine-ana-seven-tenths-(1~9~7~ hettrs SEVEN (7) SHIFTS of annual leave each year. Annual leave for those employees shall accumulate at the rate of eleven-and sixty-f~~r-h~ft~r~~th!-(ll~~·~ FOURTEES (14) hours p~r each month of active service and may accumulate to a maximum accumulation of twe-httndred-seventy-nine-and-thirty-nine- buadre&ths (219.~') THPEE HUNDRED FIFTY (350) hours. Qualification for annual leave shall be the same as for other employees . (d) After ten (10) years of continuous service, regular employees shall receive twelve (12) hours of :annual leave per month of active service, and firefighters will receive sixteen EIGHTEEN (18) hours of annual leave for each month of active service. AtL FORTY (40) HOUR PER WEEK FIREFIGHTERS WIL ACCRUE ONE AND ONE-HALF (l~) DAYS (12 HOURS) PER MONTH WITH OVER TEN (10) YEARS OF ACTIVE SERVICE. Police officers will receive ten TWELVE (12) hours of annual leave per month of active service. The maximum accumulation for regular employees other than fire and police working forty (40) hours shall be two hundred forty (240) hours. THE MAXIMUM ACCUMULATION FOR POLICE OFFICERS SHALL BE THREEE HUNDRED TWENTY (320) HOURS; and for firefighters shall be three-httnared-ferty- nine-aR~-tweRty-feHr-httn~re~ths-(349~ 243 FOUR HUNDRED SIXTY-FIVE (465) hours. (e) Annual leave shall neither be authorized nor computed for any purpose after the maximum accumulations of said leave have been reached . -2- ,, 5-4-6 • • • • • • f SICK LEAVE; ACCRUAL; QUALIFICATIONS; CONVERSION Ca) Accumulations. Sick leave for all class1£1ed employees other than those classified under Section 5-6-10 (Fire- fighters) shall accumulate monthly at the rate of eight-{8)-hettrs ONE AND ONE- QUARTER Cl•) DAYS per each month of active service, and said employees shall b~ entitled to ninety-six-(96~-hetirs FIFTEEN (15) DAYS of sick leave each year. AFTER TEN (10) YEARS OF CONTINUOUS SERVICE ALL CLASSIFIED EMPLOYEES OTHER THAN FIREFIGHTERS SHALL ACCUMULATE SICK LEAVE AT THE RATE OF ONE AND ONE-HALF (lit) DAYS PER MONTH OF ACTIVE SERVICE, AND SHALL BE ENTITLED TO EIGHTEEN (18) DAYS OF SICK LEAVE EACH YEAR. ALL FORTY (40) HOUR PER WEEK FIREFIGHTERS WILL ACCRUE ONE AND ONE-FOURTH Cl•) DAYS (10 HOURS) PER MONTH OF SICK LEAVE WITH UNDIRTEN (10) YEARS OF ACTIVE SERVICE AND ONE AND ONE-HALF (l~) DAYS (12 HOURS) PER ·MONTH FOR OVER TEN (10) YEARS OF ACTIVE SERVICE. THE MAXIMUM ACCUMULATION OF SICK LEAVE FOR SAID EMPLOYEES, REGARDLESS OF YEARS OF SERVICE, SHALL NOT EXCEED ONE HUNDRED FIFTY (150) DAYS lllH flail. Sick leave for employees classified under Section 5-6-10 (Firefighters) shall accumulate at the same rate and under the same conditions as annual leave. AFTER TEN (10) YEARS OF CONTINUOUS SERVICE FIRE- FIGHTERS SHALL ACCUMULATE SICK LEAVE AT THE RATE OF EIGHTEEN (18) HOURS PER MONTH OF ACTIVE SERVICE, AND SHALL BE ENTITLED TO NINE (9) SHIFTS OF SICK LEAVE EACH YEAR. THE MAXIMUM ACCUMULATION OF SICK LEAVE FOR SAID FIREFIGHTERS, REGARDLESS OF YEARS OF SERVICE, SHALL BE ONE THOUSAND SEVEN HUNDRED FIFTY {1750) HOURS PER YEAR. For those employees classified under Section 5-6-10 -3- . r . • • S-4-12 • (Fire Department) of this title working alternate periods of twenty·four (24) hours, sick leave may be converted to annual leave after the accumulation of at least ene-thettsand-ferty-seven-and- seventy-three-httndredths-(1;941~ 1;3-hettrs; ONE THOUSAND TWO HUNDRED EIGHT (1,280) HOURS, at the rate of forty-eight (48) hours of sick leave to twenty-four (24) hours of annual leave. All such leave accumulated after the maximum of nine httndrea-sixty-(969~-he~rs-er-ene-thettsand three-httndred-ninety-six-and-ninety-seven httndredths-{l;396~91)-he~rs-(Fire-Bepartment3 ONE HUNDRED FIFTY (150) DAYS FOR GENERAL AND POLICE DEPARTMENT EMPLOYEES; AND ONE ONE THOUSAND SEVEN HUNDRED FIFTY (1,750) HOURS FOR FIRE DEPARTMENT EMPLOYEES, shall automatically convert to annual leave at the rate of two (2) to one (1) (2:1). SAME; INJURIES -TEMPORARY, TOTAL DISABILITIES (a) On-the-Job In~ury-Comecnsation. For a~y on -the-Job inJury, which causes any employee to be absent from work as a result of such injury, the City shall pay to such employee his full wages from the first day of his absence from work up to and including .the ninet i eth (90th) calendar day of such absence, less whatever sums received by the employee as temporary total disability benefits under Workmen's Compensation. Absence from the job as a result of an on-the-job injury, during the first ninety (90) calendar days thereof, shall not be charged against the employee's sick leave. The City reserves the right to require any employee on injury or disability leave to submit to an examination by a City appointed physician at the City's expense. -4- " • (b) • (c) • Permanent DisabilitI -Police Officers - Pre-Ref1rement Bene it. Should any employee become permanently disabled, whether as a result of an on-the-job I!· injury or an off-the-job injury, so that he becomes eligible for the total dis- ability benefits provided under the police pension fund, the City will pay, out of a separate police retirement fund, in addition to any payments to be received by the employee from the police pension fund,. ~n amount equal to 20\ of said employee's salary, so that the e•ployee shall receive a total of 70\ of his salary -sot from the police pension fund and 20\ from the separate police retirement fund. In the event that the primary pension fund does not provide for the disability benefit for any reason, the separate police retirement fund will provide 70t coverage. The City will continue such payments until such time as the employee would have been eligible to receive normal non-disability retirement benefits under the police pension fund. Permanent Disabilitt -Firefighters - Pre-Retirement Bene it. Should any employee become permanently disabled, whether as a result of an on-the-job injury or an off- the-job injury, so that he becomes e1igible for the total disability benefits provided under the fire pension fund, the City will pay, out of the separate existing fire pension fund, an amount equal to 20\ of said employee's salary in addition to any payments to be received by the employee from the fire pension fund, so that the employee shall receive a total of 70\ of his salary -sot from the fire pension fund and 20\ from the separate existing fire pen- sion fund. In the event that the primary pension fund does not provide for the dis- ability benefit for any reason, the separate existing fire pension fund will provide 70\ coverage. The City will continue such pay- ments until such time as the employee would have been eligible to receive normal non- disabili ty retirement benefits under the fire pension fund . -5- ,, r • • • 5-4"17 Section 3. Based on quarter· hours of college or junior college work in the field of Police Science, the education program is as follows: 0 -45 46 -93 $240.00 per year A.A. Degree or equivalency $480.00 per year Bachelor's Degree $600.00 No additional payment shall be made for those employees who have completed 45 or less quarter hours work at the college level.· For those individuals who hav·e com- pleted at least 46 quarter hours of work at the college level, in any field, there shall be paid $20.00 per month, or $240.00 per year, in the manner provided below. For those individuals who have received an A.A. Degree, or its equivalency, in the field of Police Science or related field, there shall be paid the sum of $40.00 per month, or $480.00 per year in the manner set forth below. For those individuals who have received a Bachelor's Degree in the field of Police Science, or related field with an A.A. Degree in Police Science, there'shall be paid the sum of $50.00 per month, or $600.00 per year, in the manner provided below. The compensation provided herein shall be paid as soon after December 1 of each year as possible. Accumulation of this compensation, on a monthly basis, shall begin after the first full calendar month of work following a certification that the employee has completed the necessary educational level. Each employee shall be responsible for providing a copy of the transcript of grades or diploma to the Personnel Office to be placed in the employee's permanent personnel file • -8- II • • • 5-6-10 SALARIES FOR FIRE DEPARTMENT CLASSlFI-CATIONS (a) The classified positions of the uniformed members of the Fire Department are hereby classified within the wage and salary schedule as set forth below: Rank Salary I' Firefighter 4th Class Fi refighter 3rd Class Firefighter 2nd Class Firefighter 1st Class Driver/Operator/Engineer Lieutenant $ 846 963 1,043 1,127 1 ,214 1,282 1,393 1,505 1,631 Captain Battalion Chief Deputy Chief (b) Subject to the provisions of Section 5-6-2, relating to the hiring of employees at (c) other than the entry level, pay increases for uniformed members of the Fire Department classified as firefighters shall not be auto- matic, but shall be treated as anniversary increases under the provisions of Section 5-6-4; provided, however, that no uniformed member of the Fire Department classified as a firefighter shall be entitled to•an anniversary increase at the end of their first six (6) months of service, but shall receive such anniversary increase, if at all, in accordance with the schedule set forth in Subsection (a) hereof, anything to the contrary contained within Section 5-6-4 notwithstanding. Tuition and .Books Refund Program. The City will reimburse any firefighter for tuition and books for job-related course work at an accredited junior college or university . -9- 11 11 ' • • • 5-6-11 . LONGEVITY COMPENSA"TlON (a) In addition to the monthly salaries or wages established herein, each employee of the City, whether or not he is in the Classified Service, who qualifies therefor, shall receive additional annual compensation in the form of longevity compensation, which compensation shall be paid to each employee once annually on or about the first day of December of each year. The amount of such compensation shall be based upon the number of years of continuous service with the City and shall be derived from the following schedule: Years of Service Amount of Compensation 0 -4 None 5 -9 10 -14 15 -19 $12.00 per month for $144.00 per year, except for those employees who have not completed six (6) full years of continuous service on December 1 of any year, which employees shall receive an amount equal to twelve dollars ($12.00) for each full month of completed continuous service after completion of five (5) years of continuous service up to Dec- ember 1. $24.00 per month for $288.00 per year, except for those employees who have not completed eleven (11) full years of continuous service on December 1 of any year, which employees shall receive one hundred and forty-four dollars ($144) plus an amount equal to twelve dollars ($12) for each full month of completed continuous service after completion of ten (10) years of continuous service up to December 1. $36.00 per month for $432.00 per year, except for those employees who have not completed sixteen (16) full years of con- tinuous service on December 1 of any year, which employee shall receive two hundred and eighty-eight dollars ($288) plus an amount equal to twelve dollars ($12) for -10- • • • Years of Service (Continued) 20 or more Section 4 • Amount of Compens ·a·tton each full month of completed continuous service after completion of fifteen (15) years of service up to December 1. $48.00 per month for $576.00 per year, except for those employees who have not completed twenty-one (21) full · years of · continuous service on December 1 of any year, which employee shall receive four ~undred and thirty-two dollars ($432) plus an amount equal to twelve dollars ($12) for each full month of completed continuous service after completion of twenty (20) years of continuous service up to December 1. No member shall be required or permitted to make contributions to this Plan during any period of employment beyond his normal retirement date or for any other period of employment for which he is not receiving credit for current service . -11- fl ' . • • 5 -9-21 NORMAL RETIREMENT BENEFIT (b) For Current Ser'vice: (1) 9fte-~ereeftt-{lt~ ONE AND THREE-TENTHS PER~ENT (1.3\) of his compensation during each year of current service credited to him, plus: (2) FOR ANY FRACTIONAL YDAR OF CURRENT SERVICE, ONE AND THREE-TENTHS PERCENT (1.3%) OF HIS COMPENSATION FOR SUCH FRACTIONAL YEAR. . Section 5. Inasmuch as the contracts of employment with e mployees are scheduled to begin January 1, 1975 and it is imperative that this ordiance be in affect at that time, the Council, therefore, linds and determines that an emergency exists and that the passage of the wi thin ordinance is necessary for the immediate preservation of property, health, peace and safety .
