The aeabera ot the Coaaisaion shall reside within the City of Englewood and poaaeaa the inte1rit7 and iapartialit7 to protect the public interest, as well as the interest ot the City and its eaployees. lleabera ot said Coaaiaaion shall be appointed, elected and selected, as follows: (a) Two •e•bera ot the co .. lsslon shall be appointed by the City Council tor teraa ot tour and three 7eara commencing May 15, 197J. (b) Two aeabera ot said Coaaiaaion shall be elected and reelected from tiae to tiae, aa hereinatter provided, by direct secret ballot by all tull-tiae re1ular eaplo7eea ot the City. (c) One ae•ber ot the Coaaiaaion shall be selected by the four members preYioual7 appointed by the Council and elected by the City eaplo7eea. Said aeaber shall be selected by a majority vote of the said tour aeabers and shall serve tor a term of four years. (d) All ae•bera shall be eli1ible tor reappointment or reelection for one aucceaalve tera ot tour 7eara. '-2-2 CODICIL APPOIITllS TO CABllR SIRVICI COllllISSION (a) At an7 re1ular or special aeaaion, the Cit7 Council shall appoint two co .. ieeioner• apecit7ing the initial terms and the effective dates of their appointaent. The initial term shall colDlllence May 1, 197J. Said appoint•enta shall be aade at least ten days prior to the date of election. (b) The Council shall aake appointaents to till vacancies for unexpired teraa ot their appointees. '-2-3 lllPLOYBI MDQIRS -NOMINATION -ILICTION -RUN-OFF -CERTIFICATION (a) Candidate• tor the Board or Career Service Co1DJDissioners shall be nomi- nated b7 petitions on torms supplied b7 the Director ot Finance, ex otticio Cit7 Clerk-Treasurer. A petition or nomination shall contain the n .. e and address or only one candidate. The petition may designate one or •ore City eaployeea as a coamittee to till a vacancy in such no•ination. (b) Noaination petitions aa7 be circulated and si1ned beginning on the sixtieth da7 and ending on the twen,ieth da7 prior to election. Each petition •hall be signed by at leas~ twenty-five qualified City employees. (c) Each no•ination petition shall be tiled with the Director of Finance no later than the twentieth da7 prior to the day ot election. Every such petition ehall be endorsed thereon the written affidavit of the candidate, acceptinc such nomination. The acceptance of nomination ·shall contain the full n .. e and place of residence of the candidate. Said initial election shall take place on the third Friday of April, 1973, and in subsequent 7ears as aa7 be applicable hereafter. (d) The City Election Coaaission, at least ten da7s before such election, shall give written notice ot the election, atatin1 the date thereof, establiishing polliDI place or places, in all locations convenient to said City employees, and lietine the names ot those candidates whose nominations have been certified b7 the Director ot Finance. (e) The City Election Comaisaion shall be 1uided in the conduct of said election b7 the 1eneral rules or election and suttra1e as contained in Chapter 49, I Section 22, c.a.s. '6J, as amended, insotar as they provide a guideline for I' the printin1 ot ballots, the selection ot observers, procedure, counting 1 ballot• and reportin1 results. The llection ColDlllission is hereby charged l with insurin1 the purity ot elections. ~ ~ (t) The Director ot Personnel shall provide to the Election Commission and, upon requeet, shall provide to an7 employee organization, a list ot names in alphabetical order and their departments of all employees who are eligible to vote. Such list aball be provided not later than fifteen days prior to the date ot election. (1) Absentee ballots or balloting by aail may be used if the Election Commission tinda .. plo7eea whose otricial duties tor the Cit7 prevent them from being preeent at a polliDI place ror who aa7 be on authorized leave of absence or vacation. (h) The noainee receivin1 the hi1heat pluralit7 of votes shall serve for a term ot tour years, and the nominee receiving the next highest plurality shall serve tor a tera ot three years. Said initial terms shall commence May 15, 1973. (i) In the event only two nominees are selected by said regular City employees, the noainee whose petition shall have been submitted first will serve for a tour-7ear tera. The nominee whose petition shall have been submitted sub- sequent thereto shall serve tor the three-7ear term. When an election in which the ballot provides for three or more choices reaulta in a tie vote tor either of the top two positions, a run-off election shall be conducted within fifteen calendar days of the initial election. '-2-4 APPOINTlllNT -FIFTH COIOIISSIONIR (a) Alter appoint•ent and election ot said tour Commissioners as above provided, aaid co .. iaaionera shall convene within ten da7s and select the fitth member thereof b7 -.. (b) With the selection of the fifth member the Board of Career Service Comliesioners shall be duly constituted and shall serve during their respective teras ot ottice or until their resignation, removal, or recall as hereinafter provided. I I 11 I -) - ,_2_, DUTIIS AID RISPONSIBILITIIS OF COllllISSIONIRS -RULES (a) The Board shall be 1enerally responsible for the administration of the Career Service Syatea ot the City ot Englewood, as the same is estab- lished b7 the provisions ot this Title, and shall pertorm such duties as aa7 now, or hereatter, be imposed upon them by the Charter or any Ordinance passed pursuant thereto. (b) The co .. ission is hereb7 authorized, tollowing notice and hearing, to adopt reasonable rules and procedures not inconsistent with the pro- vision• ot this or any other Charter or Ordinance Provision which are necea•ar7 or appropriate in the pertoraance ot its duties. '-2-6 JllllOYAL OR RECALL -PROCEDURES (a) Reaoval -Council Appointed Commissioners - The Cit7 Council by not leas than five aftirmative votes may remove any co .. i••ioner appointed b7 it tor continued neglect of duties or mal- tea•ance in ottice. (b) Recall .-laplo1ee Elected Co .. issioners - (c) (d) (•) To reaove an elected Coamiasioner trom Office, a petition shall be cir- culated requestin1 the recall of said member. Said petition, when signed b7 regular City eaplo7ees equal to 25S of the number of all City employees votina at the next previous election, shall be tiled with the City Election co .. i••ion, who will set a date tor a recall election to be held within thirt7 da7s tollowina the tilin1 ot the petition. The elected Commissioner to be recalled aay either resi1n or tile with the Election Commission a notice ot his intention to be· a candidate in the recall election. Other candidate• tor the ottice held by the elected otticer to be recalled will aake their intentions known in a manner prescribed by Section S-2-3 of thi• title. (Petition tor Nomination) The candidate receivin1 the hi1heat number of votes in the election shall be declared bolder ot the ottice. It the successful candidate is the elected otticer whoae recall is requested, he shall continue in office until the expiration ot his teraJ it the successful candidate is someone other than the recalled •••ber, he shall till out the unexpired term of the recalled Coaai••ioner. Vacanc1 Should a Coaaissioner duly elected by the City employees resign or other- •i•• becoae incapacitated so as to create a vacancy in office, the City eaplo1••• shall petition the City Election Commission to hold an election to till said unexpired term. '-2-7 PIBSOlllL DIRICTOR (a) The City Manager shall, atter consultation with the Board, appoint, suspend, reaove and tranater an eaplo7ee ot the City as Personnel Director who shall, tor purpo•e• ot Section 138 ot the Charter and Section 5-1-1 of this Code, be coneidered to be a department head. (b) The Per•onnel Director shall give such aid and assistance to the Board, in the pertoraance ot its responsibilities and duties, as may be necessary, includiq, without liaitation; (1) Generall7 supervisine all other eaployeea designated by the City Mana1er to render clerical and general oft ice assistance to ·· the Board. (2) Preparin1 and reco .. ending to the Board ··all necessary rules and r..iationa to carry out the provisions of this Title. (3) Interpreting and entorcing, subJect to review by the Board, all such rules and re1ulationa. (4) Assisting the appointing authority, all departments of the City, and the Board in establishing qualifications tor positions with the City, preparing and holding exaainations and passing upon the quali- fications or applicants, establishing eligibility lists and certify- ina eligible applicants to the appointing authority to fill vacancies. (') Preparina tor the approval ot the Board a position classification plan with apeciticationa, and revisions thereot when necessary; performing po•ition audits and reco .. endin1 to the Board the allocation or reallo- cation ot all positions to classes within the classification plan. -4 - (6) Establishing and aaintaining a tile ot all career service employees and such records, toras and procedures as necessary to facilitate personnel transactions. (7) Collectinc personnel data, relating to wages, trom throughout the Denver aetropolitan area coaparing the same with the presently ettective pay plan tor City employees. (8) Pertoraing such other duties as may be necessary to implement the career service. (c) In addition, the Personnel Director shall, under the supervision or the City Mana1er: (1) Recoaaend and administer an employee in-service training program. (2) Recoaaend and administer an employee safety program. (3) Consult with employees on matters relating to employee problems or coaplaints which cannot be resolved within any department and report thereupon to the City Mana1er. (4) Accuaulate personnel data relating to employee benefits of muni- cipal eaployees in the Denver Metropolitan Area and report thereupon both to the Board and to the City Manager. (') Carry out such other assignments, not inconsistent with the foregoing, which he aay be dele1ated, from time to tiae, by the City Manager. '-2-8 RECORDIHG SECRETARY In accordance with Section '3 ot the Charter, the City Manager shall designate a recordin1 secretary tor the Board, who shall keep a record of all the proceedings betore the Board. '-2-9 OTHER CLERICAL ASSISTANCE The City Mana1er may trom time to time, upon recommendation or the Board, designate such other and further employees ot the City to aid the Board in the pertoraance or necessary clerical and general office work. Section 2. Inasauch as it ls essential to implement the provisions or the Charter Amendment beretotore passed pursuant to its terms, City Council hereby finds and determines that an eaer1ency exists and that the enactment ot the foregoing Ordinance is necessary for the 1-aediate preservation or public health, peace, safety and good order; therefore, this Ordinance eball becoae ettective upon publication following final passage.
