WBBRBAS, the City council of the City of Bnglewood, Colorado, pur-
auant to the Charter and Ordinance &o. 14, Seri•• of 1964, of said City and
the Lawe of the State of Colorado, hereby find• and determines that there
exiata a neceaaity for the creation of Sidewalk Improvement District No. 71,
in aaid City, and the conatruction therein of aidewalk improvements, as
deacribed hereinr and
1111BRBAS, the City council baa heretofore directed the Director of
PUblic work8 to prepare plan•, •pacification•, map• and •chedules in accor-
dance with aaid lawar and
"8BRBAS, the Director of PUblic works baa prepared all the maps and
certificate• of hi• aurvey, aa well as achedules, plane, apecifications,
approximation• of coat, and all other matters and things in complete form and
aubatance a• required by law: and
WBBRBAS, the said maps and certificates of hia survey, as well as
achedulea, plane, apecificationa, approximations of coat, and all other
matter• are hereby approved and adopted by the City council: and
WBBRBAS, &otice of a public hearing concerning the creation of the
Diatrict and the conatruction of the improvements therein and upon this
ordinance baa been publiahed once a week for three weeks in the Englewood
Herald, a newspaper of general circulation in the City, and, in addition, a
copy of the llotice baa been mailed, poatage prepaid, to each known owner of
real property within the propoaed Diatrict: and
WBBRBAS, at the time and place specified in said Notice, the City
Council met in open session for the purpose of hearing any objections or
proteats that might be made against said improvements: and
WBBRBAS, all objections and complaints having been duly heard and
conaidered, the council baa determined that such objections should be denied
except aa thi• ordinance baa accepted them and incorporated herein changes
in aaid Diatrict baaed upon said objections.
BOW, 'l'BBRBFORE, BE IT ORDAillBD BY '1'HE CITY COUNCIL .OF THE .CITY OF
BIJGLBMOOD, COLORADO, as follows:
Section 1. Sidewalk Improvement Diatrict Bo. 71 is hereby created
and the improvements hereinafter described, consisting of certain sidewalk
improvements, are duly ordered after Botice duly given and Bearing duly held,
all aa required by law.
Section 2. The extent of the Diatrict to be aaaeaaed for the cost
of the improve .. nta shall be all the real property apecially benefited and
aa 110r• particularly aet forth in the Rotice of Bearing a• provided by a
Reaolution of th• City council paaaed and adopted on the 17th day of May,
1971. 'lh• kind of improvements and the sidewalk• on which such improvements
ahall be aa follows:

Section 6. All •••••amenta levied against the aforesaid parcels of
real property will be due and payable, without demand, within thirty days from
and after the final publications of an ordinance assessing the costs of said
improvement• again•t the real property in the di•trict. In case any owner of
real property shall fail to pay the whole of •uch ••••••ment against his
property within said thirty days, then the pro rata coat of said improvements
•o ••••••ed against his property, together with intere•t at the rate of six
per cent (6") per annum on any unpaid balance, shall be payable in five equal
annual installment•. 'l'he fir•t of •uch in•tallmenta of principal and interest
•hall be due and payable at •uch time •• may be determined in and by the
••••••in9 ordinance, and the remainder of •aid installments shall be due and
payable •uccea•ively on the ••me day of each year thereafter, until all are paid
in full.
Section 7. 'l'h• Mayor and Director of Finance are hereby authorized to
adverti•• for bid• to con•truct •uch improvement• in three (3) consecutive weekly
i•auea of a newapaper of general circulation, which advertisements may run
concurrently with the publication of thi• Ordinance.
Section 8. The City council hereby find• and determines that the
improvements proposed to be constructed and installed will confer· a special
benefit upon the property within the Di•trict and a general benefit upon.~he
City •• a whole.
Section 9. All ordinance•, or parts thereof, in conflict herewith are
hereby repealed. '!'his Ordinance, after it• final p•••age, shall be recorded in
a book kept for that purpo•e, shall be authenticated by the signatures of the
Mayor and Director of Finance, •hall be publi•h•d in ••id City.
