WBBRBAS, there pr•••ntly exi•t• a public alley lying between west Hampden Avenue on the north and Little Dry cr-k on the •outh, known as the Broadway/Acoma Alley: and WBBRBAS, Key saving• and Loan Aaaociation ha• agreed to construct a pede•trian walkway to be dedicated to public u•• a• ace••• to the park land •outh of Dry Creek in lieu of aaid alley: and WBBRBAS, a parking lot layout and land•caping plan of said Key Savinq• and Loan A••ociation will be contingent upon approval by the City of Englewood Planning and zoning commi•aion: and WBBRBAS, the Planning and Zoning Commi••ion of the City of Engle- wood ha• heretofore recommended that said alley hereinafter described be vacated: and WBBRBAS, all of the land adjoining •aid alley i• contained within the City of Englewood, Colorado and does not con•titute a boundary line between the City of Englewood and any county or other municipality: and WBBRBAS, •hould •aid alley be vacated, no land adjoining said alley ahall be without an eatabliehed public road connecting said land with another e•tabli•hed public road. BOW, TBBRBPORB, BE IT ORDAIBBD BY '1'llB CITY COUBCIL OF '1'BE CITY OF BllGLBWOCI>, COLORADO, as followa: Section 1. '!'hat the following deacribed alley located within the City of EngleWOOd, Arapahoe county, Colorado be and the ••me is hereby vacated: to-wit: All of that portion of the Broadway/Acoma Alley, located from We•t Hampden Avenue on the north to Little Dry Creek on the •outh, which portion i• all within the City of Englewood, Arapahoe County, Colorado. Section 2. Provided, however, that the City of Englewood shall retain and •hall re•erve the right to in•tall, maintain, operate, repair and replace by it•elf or by any licen••e or holder of a franchise from the City, any pole•, wirea, pipe•, conduit•, aewer main• and water mains or any other utility now located in the alley or any portion thereof vacated by this ordi- nance. And provided further, that the City of Bnglewood hereby reserve• the right to in•tall and maintain in that portion of the vacated alley, aur£ace and •ubsurface storm drainage facilities.
