Section 1. 'l'bat the whole coat and apportionaent of the same, as set forth
in aaid Re80lution and llotice, and •• -nded herein, i• hereby approved and confirmed,
and aaid apporticxrent ia hereby declared to be in accordance with the special benefits
which the pEOperty in the Di•trict will receive by reason of the construction of said
illpzov1a1nt•, and a •bar• of said coat i• hereby ••••••ed to and upon each lot or tract
of land within the District in th• proportion• and amount• aet forth in said Resolution
and llotice, u •.-.ded.
Section 2. 'fhat •aid •••••-nt• •hall be due and payable at the office
of the Director of Pinance, within thirty day• after the final publication of this
Ordinance, without d-.idr Drovided that all auch aaaea .. ent• may, at the election of
th• property owner, be paid~n lnatallaenta, with intereat as hereinafter provided.
Pailure to pay th• whole •••••-.it• within aaid period of thirty day• •hall be con-
claaively oon•idered and held an election on · the part of all persona interested, whether
under disability or otherwise, to pay in auch inatallaenta.
Such election shall be concluaively held and oonaidered as a waiver of any
ript to queation the power or jurisdiction of the City of Bn9lwood to conatruct the
illprov•ent•, the quality of the mrk, the regularity or sufficiency of the proceedings,
or tbe validity or the oorrectn .. • of the aaaea-.nta, or the validity of the lien
thereof. .
In the event of •uah election to pay in inatallmenta, the assessments shall
be payable at th• office of the county Treasurer of Arapahoe county, Colorado, in ten
(10) equal annual in•tallaenta of principal, the first of which installments of
principal •hall be due and payable on or before the lat day of January, 1971 and the
r•·inder of said iutallment• •hall be due and payable aucceaaively on or before the
l•t day of January, in each year thereafter, until paid in full, with interest
on the mpaid principal at th• rate of six per centma (6") per ann1DD, comencing
on January 1, 1972, and payable each year at the tiae of paying installments of
principal.
Section 3. Pailure to pay any installment, whether of principal or
intereat, when due ahall cauae the whole of the unpaid principal to become due and
payable t ediately, and the whole amount of the mlpaid principal and accrued
intereat ahall thereafter draw interest at the rate of one per cent1DD (l") per month,
or fraction of a aonth, \Ultil th• date of tax sale, •• by provided by law. At any
time prior to th• date of th• tax •ale, any owner may pay the amount of all unpaid
inatallllellta with intereat at one per centma (l") per month, or fraction of a month,
upon all delinquent inatal1--nt•, and all penalties accrued and shall thereupon be
reatored to th• ri9ht thereafter to pay in inatallment• in the •ame manner as if
default had not hem suffered. 'fhe owner of any property not in default as to any
iutallment or payment -y, at any tiae, pay the whole of the unpaid principal with
accrued interest to th• date of the next •••eamaent inatallment payment data.
Section 4. Payment• .. y be made to the Director of Finance at any time
within thirty days after th• final publication of thi• ordinance, and an allowance
of five per c•tma (5") will be made on all payment• made during •uch period, but
not thereafter. r ediately after th• expiration of such thirty day period, said
a•••• ... nta shall be certified to the CO\Ulty Treasurer of Arapahoe county, Colorado,
for collection, u provided by law.
Section 5. !hat if any tract or parcel of property included within Paving
Diatrict llo. 18 i• hereafter divided or subdivided into two or more such tracts or
parcel•, the Director of Finance, with the •••i•tance of the Director of Public works,

Section 6. !bat if any one or more aectiona or part• of this Ordinance shall
be adjudged an•forceabl• or invalid, auch judgment: •hall not affect, impair or invali-
date th• r••ining pmviaion• of thi• Ordinance, it beinq the intention that the various
pzoviaiona hereof are aeverllble. .
Section 7. By reaaon of the fact that bond• of aaid Paving District Bo. 18
an now oatatancling and int:ereat: thereon will ahort:ly becoaae due and payable, funds

Section 8. All ordinance•, or part• thereof, in conflict herewith are hereby
repealed. 'fhi• orcllnance, after it• final pa••acJ•, •hall be recorded in a book kept
for that parpoee, 8ball be autb•tiaated by the aignaturea of the Mayor and Director
of Pinwe, and •hall be pabliabed in th• Bngl.-ood Herald, a newapaper of general
airaalation pabli8bed in aaid City, within aeven daya after it• final paaaaqe, and
8ball be and r••in irrepealllbl• until the aaaea ... nt:• hereby made •hall be paid in
fall.

in Sngl.-ood, COlorado, on Jlonday, th• 20th day of April, 1970, at the regular meeting
