in .acozdanc• with aaid Ordinancer and

Section 4. 'l'he conatruction of •aid atreet and avenue
illprov.aent• in and for the Diatrict, •• ahown by the plans,
apecificationa and aapa thereof, prepared by the City Engineer and
approved by th• City Council of the City and now in file in the
office of the Director of Public Work•, be and the same is hereby
authorised and ordered, the .. terial to be u•ed in the construction
of aaid atr .. t iaprov ... nt• to be in accordance with auch maps,
plan• and •peeificationa.
Section 5. '1'he e•tiaated total co•t of •aid improvements
i• f325,570r it i• propoaed that the City of Bnglewood will pay
approxi•ately $81,500 toward the total coat of aaid improvements.
'fh• approxt•ate share of the total co•t to be aaaeased per front
foot upon any lot or tract of land fronting or abutting on said
illprovlllellt• and included within the Di•trict will not exceed the
•oant -t forth in the Botice of BeariDCJ, •• provided by a
Resolution adopted and paaaed by th• City council on the 3rd
day of Pebruary, 1969.
Section 6. Said a••e•••t• will be due and payable
without d•and within thirty (30) day• frcm and after the final
publication of the Ordinance •••e•aing the whole coat of said
iaprov•enta 1a9ainat the real eatate in aaid Di•trict. In the
event any owner of real eatate •hall fail to pay the whole of such
•••••-.it 1a9ain•t hi• property within •aid thirty (JO) days,
then the whole coat of the iaprov•ent ao •••e••ed against his
property •hall be payable in ten equal annual installments of
principal. '1'he firat of auch inatallaent• of principal shall be
due and payable at auch time aa will be -t forth in the Ordi-
nance levying •••••-•nt• and the r..ainder of •aid inatallments
8hall be due and payable •ucce••ively on the ••e day• in each
year thereafter until all are paid in full. 'the intereat rate on
inatalllaent• of ••••• .. enta ahall not exceed the net effective
intereat rate plua one half of one per cent (.5%) on the special
••••• .. ent bond• to be iaaued if the net effective interest rate
on •aid bond• aceed• •ix per cent (6"), but in no case shall

later adopted by the Council.
Section 7. By virtue of and pur•uant to the Charter
and Ordinance Bo. 14, Serie• 1965, •• .. ended, of the City, local
impro,,..ent bond• of the City •hall be iaaued for the purpose of
payiDCJ for the local iaprov-nt• described in thi• Ordinance,
in an 11110unt not to exceed the coat of •aid improvements, including
engineering, legal and all incidental expen•e•, a• provided in
•aid Charter and Ordinance.
Section 8. 'l'he iaauance of and payaent for said bonds
•hall be authorized by an ordinance later to be paased in accordance
with the Charter and •aid Ordinance Bo. 14, Serie• 1965, as amended,
of •aid City. '1'he llaXillua rate of intere•t on •pecial assessment
bond• for Paving Diatrict Bo. 18, shall not exceed seven (7)%,
per annwa, and auch aaximwa intereat rate •hall be set forth in
the llotice of Sale of aaid bond•.
Section 9. '1'he Mayor and Director of Pinance are hereby
authorized to advertiae for bid• to conatruct auch improvements
and for bid• for •aid bond• to be iaaued, in three (3) consecutive
weekly iaauea of 'l'he Bnglewood Herald, a newapaper of general
circulation publiahed in the City of Sn9lewood, which advertisements
aay run concurrently with the publication of thi• Ordinance.

Section 10. 'l'he City Council hereby find• and deter-
ain•• that the iaprov-ent• propo•ed to be conatructed and
inatalled will confer a •pecial benefit upon th• property within
the Di•trict and a general benefit upon th• City a• a whole.
Section 11. By reaaon of th• fact that the street
illprov-nta deacribed herein, within the City of Bnglewood, are
needed and ahould be conatructed and inatalled aa aoon as
poaaible, and that it i• nec•••ary to i••u• and •ell •pecial
•••••-.it bond• for the payment of the coat• and expenses of such
iaprov-•t•, it i• hereby declared that an .. rgency exists, that
thia Ordinance i• neceaaary for the imaediate preservation of
public property, health, peace and •afety, and •hall take effect
upon final pa••age.
Section 12. All ordinance•, or part• thereof in con-
flict herewith are hereby repealed. !'hi• ordinance, after its
final paaaage, •hall be recorded in a book kept for that purpose,
•hall be authenticated by the aipature• of the llayor and
Director of Pinance, ex-officio City Clerk, and •hall be
publiahed in a n9W8paper having general circulation in the City,
within •even day• after final pa•aage.
Section 13. A public Bearing on th• Ordinance will be
held at the City Ball in Bnglwood, Colorado, on llonday, the 21st
day of April, 1969, at the hour of 8100 o'clock P.M., before final
paa•ag• thereof, and that the Ordinance be publi•hed in full one
time in the edition of the Bnglewood Herald dated April 10, 1969.
