Section 1. '!'hat the whole coat and apportionment of the
•-e, •• aet forth in aaid Reaolution and Rotice, and •• amended
herein, ia hereby approved and confirmed, and said apportionment

ia hereby declared to be in accordance with the benefits which the
property in the Diatrict will receive by reaaon of the construction
of aaid illprov-enta, and a ahare of aaid coat is hereby assessed
to and upon each lot or tract of land within the District in the
proportion• and ..aunt• aet forth in aaid Resolution and Notice,
•• -nded.
Section 2. '!'hat aaid aaaeaament• shall be due and pay-
able at the office of the Director of Finance, within thirty days
after the final publication of thia Ordinance, without demand:
provided that all auch aasesamenta may, at the elction of the
property owner, be paid in installments, with interest as here-
inafter provided. Failure to pay the whole assessment within
aaid period of thirty days •hall be conclusively considered and
held an election on the part of all peraona interested, whether
under diaability or otherwiae, to pay in such inatallments.
Such election •hall be concluaively held and considered
aa a waiver of any riqht to queation the power or jurisdiction of
the City of Bnqlewood to conatruct the improvements, the quality of
the work, the reqularity or aufficiency of the proceedings, or the
~alidity or the correctneas of the •••e•mnents, or the validity of
the lien thereof. ·

In the event of auch election to pay in inatallments,
the aaaea ... nta •hall be payable at the off ice of the County
Treaaurer of Arapahoe county, Colorado, in ten (10) equal annual
inatallllent• of principal, the fir•t of which in•tallments of princi-
pal ahall be due and payllble on or before the lat day of January,
1970, and the r ... inder of •aid in•tall.Jaent• ahall be due and
payable •ucc•••ively on or before the l•t day of January, in each
year thereafter, until paid in full, with intere•t on the unpaid
principal at the rate of •ix per centua <•> per ann\DD frcm January
1, 1970, payable each year at the tiae of payin9 in•tallments of
principal.
Section 3. Failure to pay any inatallment, whether of
principal or intereat, when due ahall cauae the whole of the
unpaid prineipal to become due and payable imaediately, and the
whole llllOUnt of the unpaid principal and accrued interest shall
thereafter draw intereat at the rate of one per centum (1%) per
110nth, or fraction of a month, until the date of tax sale, as by
provided by law. At any time prior to the date of the tax sale,
any owner .. Y pay the amount of all unpaid inatallment• with interest
at one per centma (l") per 110nth, or fraction of a month, upon all
delinquent in•tallllenta, and all penalti•• accrued and ahall
thereupon be reatored to the ri9ht thereafter to pay in install-
•ent• in the .... manner aa if default had not been auffered.
!'be owner of any property not in default a• to any installment or
payment .. y, at any time, pay the whole of the unpaid principal
with accrued intere•t to the date of the next aaaeaament install-
•ent payment date.
Section 4. Payment• -Y be made to the Director of
Finance at any tille within thirty day• after the final publication
of thi• Ordinance, and an allowance of five per cent\DD (5%) will
be .. de on all payment• -de during auch period, but not thereafter.
Illllediately after the expiration of •uch thirty day period, said
a•••• ... nta ahall be certified to the County Trea•urer of Arapahoe
County, Colorado, for collection, a• provided by law.
Section S. That if any tract or parcel of property
included within PaviDCJ Di•trict Ro. 17 i• hereafter divided or
aubdivided into tvo or 1DOre auch tract• or parcel•, the Director
of Pinance, with the •••i•tance of the Director of Public Works,
ia hereby authorized and directed, frma time to time as occasion
aay ariae, to divide the aaaea ... nta of auch apecific parcels with-
in the Di•trict, proportionate to the diviaion of the parcels of
real property avain•t which the .... may be ••••••ad, and to
certify the reviaed a••••m.enta to the Treaaurer of Arapahoe
County, Colorado.
Section 6. '!'hat if any one or more aections or parts
of thi• Ordinance ahall be adjud9ed unenforcellble or invalid, such
judgllent ahall not affect, illpair or invalidate the r ... ining pro-
vi•iona of thi• Ordinance, it bein9 the intention that the various
proviaion• hereof are aeverable.
Sec~ion 7. By reaaon of the fact that bonds of said
Paving Diatrict Ro. 17 are now outatandin9 and interest thereon
will ahortly beccm• due and payable, fund• must be made available
frma a• .. •811eftta at the earlieat poaaible date for payment of such
intereat, and for the illmediate preaervation of the public property,
health, pew and •afety, it ia hereby declared that an emergency
exi•t• and that thia Ordinance •hall take effect upon its final
pa••age.
Section 8. All ordinance•, or parts thereof, in conflict
herewith are hereby repealed. !'hi• Ordinance, after its final
pa••llCJe, •hall be recorded in a book kept for that purpose, shall
be authenticated by the aignaturea of the Mayor and Director of
Finance, and ahall be publiahed in the Bn9lewood Herald, a news-
paper of general circulation publiahed in said City, within seven
day• after it• final pa•aa9e, and ahall be and remain irrepealable
until the a•••• ... nta hereby made ahall be paid in full.
Section 9. A public Bearing on the Ordinance will be
held at th• City Ball in Bnglewood, Colorado, on Monday, the 16th
day of June, 1969, at the hour of 8100 o'clock P.M., before con-
aideration by the City Council of it• final passage and adoption.
