provided, however, that 8hould any preaent or future atate statute

(a) Bxcept •• provided in 121.3-4 hereof, no realty within
th• City of BncJlewood •• to which there ha• not been a plat pre-
pared, approved and filed with the Clerk and Recorder of the county
of Arapahoe, State of Colorado, prior to the effective date of
thi• ordinance, •hall be divided, a• defined in 121.3-5 hereof,
unl••• there ha• firat been a •abdiviaion plat prepared, approved
and recorded, in accordance with th• provi•ion• of th••• •ub-
di viaion rec)Ulationa and all other requir ... nt• thereof are first ••t.
(b) llo deed, lea••• or other in•trument of what•oever nature,
which "°'11.d have the effect of cau•ing a divi•ion in any realty,
•• defined in 12k,3-5 hereof, •hall be executed, delivered or
recorded, anl••• and until a plat therefor ha• been prepared,
approved and filed in accordance with the provision• of these aub-

(1) Realty con•i•tinq of a total of two (2) acres or
leaa, and which fora• a part of a previou•ly approved sub-
diviaion plat, which ha• been filed of record with the Clerk
and Recorder of the County of Arapahoer or
(2) Realty for which a special variance or exception
ha• been qranted by the Planninq and ZOninq Camniaaion of
the City of Bnqlewood, in accordance with 121.3-4 (b) hereof.
(b) Whenever a tract of land which,by virtue of the provisions
of 121.3-3, cannot be divi•ed without the preparation, approval and
filing of a .ubdiviaion plat, i• of •uch unu•ual •ize or •~ape, or
it• location and relationahip to preaently existing streets, alleys,
utility right•-of-way and other neighboring development is such
that no aub•tantial benefit• are to be gained by the City or by the
pablic frma requiring a •ubdivi•ion plat to be prepared, approved
and filed therefor, th• Planning and zoning CC1111i••ion may, upon
application therefor by th• owner or owner• thereof, waive the
nec•••ity for th• owner or owner• of ccmplying with the provisions
