WBBRBAS, the City Council of Bnqlewood, Colorado, pursuant to the Charter and Ordinance Bo. 14, Series 1965, of said City and the Laws of the State of Colorado, hereby find• and determines that there exists a necessity for the creation of Pavinq Diatrict Ro. 16, in said City, and the construction therein of certain street, avenue and alley improvement•, aa described herein: and WBBRBAS, the City Council has heretofore directed the City Enqineer to prepare plane, apecificationa, .. pa and achedulea in accordance with said laws: and WllBRBAS, the City Enqineer has filed with the Clerk of said City all the maps and certificate• of hi• aurvey, aa well as schedules, plans, specifications, approxi- .. tiona of coat, and all other matters and thinqa in complete form and substance as required by law: and WllBRBAS, the aaid report ao made and filed, toqether with details, specifications, ••tillatea, .. pa and achedulea, are hereby approved and adopted by said city Council: and WBBRBAS, the City council directed the City Clerk to publish in the Enqlewood Herald and Enterpriae, a newspaper of qeneral circulation in said City, Notice of a propoaition to create said Diatrict: and WBBRBAS, the Council haa heretofore set a date for the Hearinq on said proposi- tion to create Pavinq Diatrict Ro. 16, such date beinq February 28, 1966: and that on aaid date at 8100 o'clock P.M., all complaint• and objecticna that miqht be made in writing concerninq the propoaed improvement• by the owner· or owners of any real estate to be aaaeaaed, or any peraon or persona intreated qenerally, would be heard and detenained by the City Council of aaid Cityof Enqlewood, before final action of said Council thereon, and that after the determination of all complaints and objections was •ad•, aaid City Council would take up and consider an ordinance creating said District and ordering the propoaed improvements: and WBBRBAS, the City Clerk, by advertisement for a period of more than fifteen (15) daya prior to the aaid 28th day of February, 1966, qave notice in form and substance of the .. ttera and thinqa above mentioned as ordered to be given, in all respects in accordance with law and aaid order: and WBBRBAS, the City Clerk ha• mailed to each known owner of real property to be aaaeaaed with the coat of aaid improvements of Rotice of Intention to create said Diatrict, aa provided by the Reaolution adopted by the City Council on February 7, 1966: and WllBRBAS, at the time and place specified in said Rotice, to-wits February 28, 1966, the City Council met in open ••••ion for the purpose of hearing any objections or proteata that might be made against aaid improvements: and WBBRBAS, the City Council considered the followinq complaints and objections: STmfl 4000 S. Said Paving Di•trict Ro. 16 is hereby created and said improvements hereinafter deacrihed, consisting of street, avenue and alley improvements, are duly ordered after Botice duly given and Rearing duly held, all as required by law. Section 2. Said improvements and the streets, avenues and alleys on which such illprov .. enta shall be constructed or installed shall be as follows: 1. Said District shall be known as and the same is hereby designated "Pavin9 District Bo. 16•, Bnglewood, Colorado. Section 4. The construction of said street, avenue and alley improvements .. and for said District, as shown by the plans, specifications and maps thereof, prepared by the City Bn9ineer and approved by the City Council of said City and now on file in the office of the Clerk of said City, be and the same is hereby authorized and ordered, the •aterial to be used in the construction of said street improvemebts to be in accordance with such maps, plans and specifications. Section 5. By virtue of andin pursuance of the aforesaid laws and the Charter and Ordinance Bo. 14, Serie• 1965, of said City, local improvement bonds of the City ahall be issued for the purpose of paying for the local improvements in this Ordinance deacribed and provided to be constructed in said Paving District, in an amount not to exceed the coat of said ilDprovmaenta, including engineering, legal and all incidental •~naea, a• in said lava, Charter and Ordinance provided. Section 6. Said bonds shall be authorized by an Ordinance later to be passed in accordance with the Laws of the State of Colorado, the Charter and said Ordinance Bo. 14, Series 1965, of said City. Section 7. The Mayor and City Clerk are hereby authorized to advertise for bids to construct such iaprov ... nt• and for bids for said bonds to be issued, in three (3) consecutive weekly issues of '!'he Bnglewood Herald and Bnterpriae, a newspaper of general circulation published in said City, which advertisements may run concurrently with the publication of this Ordinance. Section 8. By reason of the fact that the completion at the earliest possible date of the iaprov .. enta described in thi• Ordiaance i• nece••ary to the inmediate preservation of the public property, health, peace and safety, it is hereby declared that an ... rgency exiata and that this ordinance •hall take effect upon its final pa••llCJe. Section 10. A public hearing on the ordinance will be held at the City Ball in BncJlewood, Colorado, on Monday, the 21st day of March, 1966, at the hour of 8:00 o'clock P.M.
